SUBJECT: BIG BEAR CREEK TRAIL PROJECT CHANGE ORDER NO. 1
RECOMMENDATION:
City Council to consider approval of Change Order No. 1 to the Big Bear Creek Trail
contract with Reliable Paving, Inc. in the amount of $164,530 and to authorize the City
Manager to sign a Settlement Agreement and Release with Reliable Paving, Inc.
FUNDING SOURCE
Funds are available through a 75/25 matching grant received from the Texas
Department of Transportation Enhancement Program and the 2000 GO Bonds for trail
construction. Funds for trail replacement at Rose Cliff Terrace were available in the
Miscellaneous Park Improvement account.

BACKGROUND:
The City Council originally approved a contract with Reliable Paving, Inc. at the January
20, 2004 meeting for $1,465,933.08. During the course of the construction of the trail
project, several right-of-way issues arose that created delays in completing the project
as well as increasing the cost in several areas. The acquisition of the Wall -Farrar Park
property helped alleviate a right-of-way problem; however, delayed the surveying, and
remobilization. The most costly unforeseen addition to the project was the requirement
by TXDOT that the contractor develop and install an extensive shoring system under the
William D. Tate Avenue frontage road bridge prior to the trail being constructed. This
single element of construction slowed the project by two months and cost $80,000 to
complete. Because of the cost to remanufacture railings, and redesign portions of the
trail, which caused an overall delay in the completion of the project, a settlement has
been agreed upon that will close out this project with the approval of TXDOT, the City,
and Reliable Paving, Inc.
While the contractors were constructing the trail east and west of Parr Park, staff
negotiated with the contractor to replace a section of trail running west of Rose Cliff
