SUBJECT: APPROVAL OF A RESOLUTION FOR PARTICIPATION IN AN
INTERLOCAL AGREEMENT WITH THE TEXAS DEPARTMENT
OF PUBLIC SAFETY
RECOMMENDATION:
City Council to consider a resolution to approve participation in an interlocal agreement
with the Texas Department of Public Safety for the purchase of DPS public safety forms.
BACKGROUND:
The request to establish this agreement is in accordance with Texas Local Government
Code, Chapter 271.102 that authorizes political subdivisions to contract with each other
for governmental functions such as the purchase of goods and/or services. A local
government that purchases goods or services under this subchapter satisfies any State
law relative to the competitive bidding statutes.
The Texas Department of Public Safety provides public safety forms currently in use by
the Police Department. Before the forms can be sold to another agency or municipality,
DPS requires that an interlocal agreement be established between DPS and that
agency. The cost and annual expense of the forms are minimal and budgeted as
operating supplies. The current DPS contract for these forms with this vendor is in effect
from September 1, 2003 until August 31, 2005. Attached is the Interlocal Cooperation
Contract provided by DPS and Attachment "A" contains a list and price for each form.
Prior to this time, the Police Department has been buying these forms from the State at
the prices listed on the attached price sheet. The State now advises us that in order to
continue selling these forms to the City, they will need an approved interlocal agreement.
Purchasing items from the State is less expensive than having our own forms printed.
Staff recommends approval.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER
OR THE CITY MANAGER'S DESIGNATE TO ESTABLISH
CONTRACTS FOR CELLULAR PHONE SERVICE THROUGH
AN ESTABLISHED COOPERATIVE PURCHASING
AGREEMENT WITH THE STATE OF TEXAS AND
PROVIDING AN EFFECTIVE DATE
'WHEREAS, the City of Grapevine, Texas is a local government in the State of
Texas and as such is empowered by Texas Local Government Code, Section 271.082
and 271.083 to enter into a cooperative purchasing program agreement with other
qualified entities in the State of Texas; and
WHEREAS, the State of Texas Department of Information Resources is a qualified
entity as authorized by Section 271.082 and 271.083 of the Texas Local Government
Code; and
WHEREAS, the City of Grapevine, Texas, has an established Cooperative
Purchasing Agreement with the State of Texas and wishes to utilize established contracts
with Cingular Wireless, AT&T Wireless, Verizon Wireless and Sprint PCS meeting all
State of Texas bidding requirements for cellular phone equipment and services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all matters stated in the above preamble are true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Council of the City of Grapevine authorizes the
establishment of contracts with Cingular Wireless, AT&T Wireless, Verizon Wireless and
Sprint PCS for cellular phone equipment and services.
Section 3. That the City Manager, or his designee, is authorized to take all steps
necessary to consummate the contracts of said cellular service.
Section 4. That this resolution shall take effect from and after the date of its
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 19th day of October, 2004.
