SUBJECT: CONDITIONAL USE REQUEST CU03-43
RECOMMENDATION:
Staff recommends the City Council consider the applicant's request to table Conditional
Use Request CU03-43 to the December 16, 2003 meeting, and take any other action
necessary.
BACKGROUND:
Conditional Use Request CU03-43 is a request to allow on -premise alcohol beverage
sales and consumption in conjunction with a restaurant with dancing and live music in
the space presently occupied by "Just For Feet" at the Grapevine Mills mall. The
applicant is requesting to table their application until the December 16th meeting to give
them more time to prepare for the public hearing. See the attached letter.

Our client, Midnight Rodeo Franchise Company, is currently in the process of applying for
a Conditional Use Permit. They are scheduled on the November le Planning & Zoning Commission
Meeting Agenda. Because our law firm has just been retained as of this week to assist in the
application process, our ability to prepare for the meeting on such short notice is limited,
Accordingly, we would like to table that request and ask that they be moved to the December I&
Agenda. It is our understanding that we will not be required to re -file any documents..
