HomeMy WebLinkAboutItem 06 - Naming of StreetsITEM • r.__.6__ MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGERA/ MEETING DATE: DECEMBER 16, 2003 SUBJECT: NAMING OF STREETS, PUBLIC WAYS, DRIVES AND THOROUGHFARES RECOMMENDATION: City Council consider adopting an Ordinance amending Chapter 20 Streets, Sidewalks and Other Public Ways, Section 20-4 to require that all names of streets, public ways, drives and thoroughfares be approved by the City of Grapevine and take any necessary action. BACKGROUND: The development of the Gaylord Texan Resort & Convention Center on Lake Grapevine has identified an area of concern to staff regarding naming of streets and other access routes. The code of ordinances currently does not provide the City the authority to control the names of private drives, access easements, or other privately owned routes used by the public. Of particular concern is the issue of 911 response to specific locations that may be located on non-public routes yet have an acknowledged name. Changes in these route names by the private owners without City approval could result in confusion during an emergency for the responding units. By requiring City approval, the notification of the name changes will be broadcast to the appropriate agencies to update their databases. Staff recommends approval. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE CODE OF ORDINANCES, CHAPTER 20 STREETS, SIDEWALKS, AND OTHER PUBLIC WAYS, BY THE AMENDMENT OF SECTION 20-4, SAME- ASSIGNMENT OF NUMBERS, REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine City Council deems it necessary for the protection of the health, safety and welfare of the public to regulate the naming and numbering of street addresses in the City; and WHEREAS, the City of Grapevine is authorized to adopt ordinances to protect the health, safety, and welfare of its citizens; and WHEREAS, the City of Grapevine has determined that it is a necessity to regulate the activities as provided for herein to safeguard the public; and WHEREAS, the City of Grapevine is authorized by law to adopt the provisions contained herein, and has complied with all prerequisites necessary for the passage of this ordinance; and WHEREAS, the City has determined that the adoption of this ordinance is in the best interest of the City, and its citizens. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. All matters stated in the preamble are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That Chapter 20 Streets, Sidewalks, and Other Public Ways, Section 20-4, Same- Assignment of numbers, is hereby amended in its entirety and renamed and replaced as follows: "Sec.20-4. Assignment of Numbers and Street Names. (a) It shall be the responsibility of the City to assign the proper numbers for all buildings. (b) It shall further be the responsibility of the City to authorize and approve the naming of any street, public way, drive, or thoroughfare within the City, including any amendments or changes thereto. (c) The owner of a parcel shall state the name of the street, public way, drive, or thoroughfare upon which the parcel fronts, lot number, block number, side thereof upon which the parcel is situated, and the exact distance from the nearest cross street. (d) A complete record of the numbering of all buildings and street, public way, drive, or thoroughfare names shall be kept by the City, and such record shall be supplemented upon the approval of the City of any additions or amendments thereto. (e) Building numbers shall be public property, and subject to change by the City, with or without notice or right to compensation from the City." Section 3. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect; provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas, shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding not guilty or nolo contendere, or dismissal. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
