SUBJECT: ONCOR STREET LIGHT AGREEMENT FOR DOVE ROAD AND
AN UPDATE ON THE CITY'S CAPITAL PROJECTS
RECOMMENDATION:
City Council consider approving an Agreement with Oncor Electric Delivery Company for
street lighting on Dove Road between Park Boulevard and Kimball Road as part of the
Dove Loop Construction Project in the amount of $19,383.81 , authorize staff to execute
said agreement, take any necessary action and receive an update on the status of the
City's capital projects.

0 BACKGROUND:
The median construction in Dove Road from Dove Loop to Kimball Road includes plans
for the installation of street lights in the medians. The medians are nearing completion
from Park Boulevard west to Kimball Road. Street light pole foundations have been
installed by the City's contractor. The final step is for Oncor to pull the wire and set the
poles.
Additional street lights will be erected on Dove Road from Park Boulevard east to Dove
Loop after the medians are constructed this summer.
The cost for the installation of the 15 street lights exceeds staff's authority for approval
and requires Council action.
Staff recommends approval.

Under these additional conditions (if any) City is responsible for all the civil construction which includes installation of 2
inch conduit from standard to electric source provide bases for standards and pull tape
1. City agrees to pay Company $19, 383.81 in consideration of Company's agreement to install said street lights and
understands that no construction work will begin until after Company has received full payment.
2. Company agrees to install, own, operate and maintain said street lights in accordance with its street lighting
agreement with customer. However, if City or Developer fails to pay, on demand, the amount indicated above, this
supplemental agreement is automatically terminated.
3. All parties agree that Company will retain for its use and benefit the payment received hereunder in consideration of
its obligation to install said street lights and that Company at all times has title to, and complete ownership and control
of, said street lights.
4. Company is not liable for loss or injury caused by delay or failure to install the electric facilities necessary to serve
customer because of delay in receiving shipment of required material, orders or formal request of governmental
agencies, acts of God or the public enemy, inevitable accidents, fire, explosions, strikes, riots, war, or any other
causes reasonably beyond control of the Company. If Company is prevented from installing such electric facilities
by any of the above causes, Company agrees to return to City or Developer, without interest, the entire amount of
City or Developer's payment, thereby terminating this supplement and Company's obligation to provide the electric
facilities described herein.
This agreement is entered into subject to the terms of the Agreement for Street Lighting Service between City and
Company dated
