HomeMy WebLinkAboutItem 06 - Prevailing Minimum Wage RatesMEMO TO: FROM: MEETING DATE: SUBJECT: RECOMMENDATION: ITEM # HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER /W/ APRIL 6, 2004 ADOPTION OF AMENDED GENERAL PREVAILING MINIMUM WAGE RATES FOR CONSTRUCTION OF PUBLIC WORKS City Council consider adopting a resolution establishing general prevailing minimum wage rates for laborers, workmen, and mechanics employed by or on behalf of the City of Grapevine engaged in the construction of street, drainage, water and wastewater projects, excluding maintenance work, within the corporate city limits of the City of Grapevine, Texas as noted in Exhibit 'A' and take any necessary action. BACKGROUND: Chapter 2258 of the Texas Government Code specifically requires that not less than the general prevailing rate of per diem wages for work of a similar character in the locality in which the work is performed, and not less than the general prevailing rate of per diem wages for legal holiday and overtime work, be paid to all laborers, workmen and mechanics employed by or on behalf of the State of Texas or by or on behalf of any county, city, town, and district or other political subdivision of the State, engaged in the construction of public works, exclusive of maintenance. Section 2 states that the public body may conduct a survey to determine the prevailing wage or adopt the prevailing wage rate as determined by the U. S. Department of Labor. Prevailing wage rates for streets, drainage, water and wastewater construction were adopted by Resolution 87-34 on September 1, 1987, identifying wage rates dated June 1, 1986. The prevailing wage rates were subsequently amended by Council on January 15, 1991 by Resolution 91-02 and on April 5, 1994 by Resolution 94-12. The prevailing wage rates were then again amended by Council on April 6, 1999 by Resolution 99-17. The proposed general prevailing minimum wage rates for Highway Construction Projects have just been recently issued by the United States Department of Labor, Wage and Hour Division for Tarrant County under General Decision Number TX20030045. March 30, 2004 (10:17AM) . These wage rates will not affect the City employee pay ranges. They are targeted only at contractor employees performing construction work for the City. WAGE DETERMINATION APPEALS PROCESS 1.) Has there been an initial decision in the matter? This can be: • an existing published wage determination • a survey underlying a wage determination • a Wage and Hour Division letter setting forth a position on a wage determination matter • a conformance (additional classification and rate) ruling On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis -Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed. With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING RESOLUTION 87-34, RESOLUTION 91-02, RESOLUTION 94-12 AND RESOLUTION 99-17 RELATIVE TO MINIMUM WAGE RATES FOR STREET, DRAINAGE AND UTILITY CONSTRUCTION PROJECTS WITHIN THE CORPORATE LIMITS OF THE CITY OF GRAPEVINE, TEXAS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine, Texas on September 1, 1987 approved Resolution No. 87-34 adopting wage rates for street, drainage and utility construction projects within the corporate limits of the City; and WHEREAS, the City has previously amended Resolution 87-34 by adopting Resolution No. 91-02 on January 15, 1991; and WHEREAS, the City has previously amended Resolution 91-02 by adopting Resolution No. 94-12 on April 5, 1994; and WHEREAS, the City has previously amended Resolution 94-12 by adopting Resolution No. 99-17 on April 6, 1999; and WHEREAS, the City Council desires to amend said resolutions in order to update the prevailing wage rates. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That resolution No. 87-34, adopted by the City Council on September 1, 1987, amended by Resolution 91-02 adopted by the City Council on January 15, 1991, amended by Resolution No. 94-12 adopted by the City Council on April 5, 1994, and amended by Resolution No. 99-17 adopted by the City Council on April 6, 1999, is hereby amended by amending Section 1, relative to wage rates for streets, drainage and utility construction projects as set forth in Exhibit "A" attached hereto and incorporated herein for all purposes. Section 2. That from and after the date of passage of this resolution, the "Prevailing Wage Rate for Highway Construction Projects, General Decision No. TX 20030045, dated June 13, 2003, attached hereto as Exhibit "A" shall be utilized. Section 3. That all matters stated in the preamble are true and correct and are incorporated herein as if copied in their entirety. Section 4. That this resolution shall take effect from and after the date of its PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 6th day of April, 2004.
