HomeMy WebLinkAboutItem 11 - Creekwood Estatesam # // iliw-� MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER MEETING DATE: MARCH 23, 2004 SUBJECT: UTILITY EASEMENT ABANDONMENT — LOT 10R, BLOCK 1, CREEKWOOD ESTATES RECOMMENDATION: City Council consider adopting an ordinance abandoning a nine foot portion of a ten foot utility easement located within Lot 10R, Block 1, Creekwood Estates, and take any necessary action. BACKGROUND INFORMATION: The owner of Lot 10R, Block 1, Creekwood Addition has requested that a nine foot portion of a ten foot utility easement be abandoned. The owner has requested the abandonment for building a new deck and garage structure. In exchange for the abandonment, the owner is dedicating another four foot width utility easement. Public Works and the franchise utilities are agreeable to this abandonment and re -dedication. Staff recommends approval. JLH/saj EXHIBIT "A" UTILITY EASEMENT ABANDONMENT DESCRIPTION BEING 675 square feet of land and being a 9 foot wide strip of land crossing Lot IOR, Block 1, CREEKWOOD ESTATES, an Addition to the City of GRAPEVINE, Tarrant County, Texas, according to the plat recorded in Cabinet "A", Slide 8687 of the Plat Records of Tarrant County, Texas. Said 675 square feet of land being more particularly described by metes and bounds, as follows: NTNG at a point lying in the East lot line of the aforesaid Lot IOR, Block 1, and lying S 15. 55' 18" W 1.0 a foot, from the most Westerly angle point of the East boundary line of said Lot 10R, Block 1; 1 S 15' 55' 18" W 9.00 feet, along said East lot line of Lot IOR, to a point in the South line of a 10 foot wide utility easement as shown on the plat of said CREEKWOOD ESTATES; THENCE N 74' 13' 10" W 75.00 feet, along said South line of said 10 foot wide easement, crossing said Lot IOR, to a point in the West lot line thereof; THENCE N 15' 53' 43" E 9.00 feet, along the West lot line of in the aforesaid West lot line of Lot IOR to a point; THENCE S 74' 13' 10" E 75.00 feet, crossing said Lot 10R, Block 1, to THE PLACE OF BEGINNING, containing 675 square feet of Land. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A PORTION OF A UTILITY EASEMENT IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the property owner of Lot 10R, Block 1, Creekwood Estates, recorded in Cabinet A, Slide 8687, Plat Records of Tarrant County, Texas, the property containing a nine foot portion of a ten foot utility easement, recorded in Cabinet A, Slide 8687, Plat Records, Tarrant County, Texas, more specifically described in Exhibit "A" attached hereto and incorporated herein for all purposes, has requested said nine foot portion of a ten foot utility easement, as herein after described, be abandoned and vacated; and WHEREAS, the nine foot portion of a ten foot utility easement is not needed for public use and will not be needed in the future for public use; and WHEREAS, the property owner is dedicating another four foot width utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the nine foot utility easement located within the property described in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, interest in and to said nine foot utility easement is concerned. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the nine foot utility easement is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such utility easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
