HomeMy WebLinkAboutItem 12 - Golf Course Environmental AssistanceMEMO TO: FROM MEETING DATE SUBJECT: RECOMMENDATION: ITEM • %2 NNEENUMMUNNOW HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER // FEBRUARY 18, 2003 AMENDMENT TO GOLF COURSE ENVIRONMENTAL ASSISTANCE CONTRACT City Council to authorize the City Manager to execute an amendment to a contract with Freese & Nichols, Inc. for environmental compliance assistance for the Cowboy's Golf Course in the amount of $30,740. FUNDING SOURCE: Funding is available in the Lake Enterprise Fund — Professional Services 210-445540- 340-2 - $20,740 and 210-12050-000-0 - $10,000. BACKGROUND: The Cowboy's Golf Course is constructed on U.S. Army Corps of Engineers land, sub- leased from the City. The owners have had to meet extensive environmental compliance and mitigation requirements. The City is required to ensure compliance with all environmental conditions; however, EAGL/Cowboy's are paying all costs related to construction of the golf course and to mitigation construction. The mitigation requirements include planting a large number of trees off-site in the upper end of Lake Grapevine as well as construction of additional wetlands and planting of trees on the golf course. The initial planting of the off-site mitigation area was accomplished in 2001. The City was required to submit quarterly reports on the progress of the mitigation and to conduct tree survival studies in 2001 and the 2002 growing seasons. Analysis of the progress at the end of 2002 indicated that another 14.1 acres of trees are required to be planted in order to meet the USACE requirements for complete mitigation. This contract amendment will cover the environmental reviews necessary at the end of 2002 for approval of the planting strategy for the additional acreage and for continued quarterly monitoring for 2003 and 2004. With this final addition to the contract, the total amount over the life of the contract is $173,720. The cost for the compliance requirements is being reimbursed to the City by EAGL through the lease/rental fee of 3% of gross receipts. Staff recommends approval. The services covered by this modification request are described on the enclosed forms and include items related to permit compliance monitoring and coordination efforts with the Corps of Engineers and Evergreen Alliance Golf Limited (EAGL) for the off-site mitigation area. As you know, we are awaiting a determination from the Corps as to whether any further work must be done regarding the on-site mitigation. I estimate that this budget modification will carry us through 2004, barring any unforeseen issues that might arise. The Corps' decision to require the remedial planting will require biannual monitoring reports for two years (2003 and 2004), assuming that the plantings meet the success criteria. Expenditures in the coming two years relate to permit compliance monitoring, including tree survival counts in the off-site mitigation area, preparation of compliance reports, and consultation with the Corps and EAGL. I anticipate the following activities in 2003; • January — one field visit to observe remedial plantings, including planting techniques and seedling condition, • February — one field visit to observe aerial extent of the completed plantings, • April — one field visit to make observations and prepare a biannual report due to the Corps in April, • August — one field visit to observe field conditions relative to seedling survival and to prepare for seedling, counting in the fall, • October — Conduct seedling survival count (may take two days) and prepare report due to the Corps in October. Activities for 2004 are similar to those in 2003 and include; • April — one field visit to make observations and prepare a biannual report due to the Corps in April, • August — one field visit to observe field conditions relative to seedling survival and to prepare for seedling counting in the fall, • October — Conduct seedling survival count (may take two days) and prepare report due to the Corps in October. Our estimated fee assumes that an EAGL representative will be present during all site visits to discuss observations. EAGL will be given the option of accompanying us during the seedling survival counts. This should allow us to point out any deficiencies that might be observed without having to make a second site visit to meet with EAGL's staff. Freese and Nichols, Inc. will send two scientist to conduct the seedling survival counts. Thank you for the continuing opportunity to serve the city of Grapevine on this project. Conduct a tree survival survey at the end of the year 2003 growing season, analyze the data, and document the results in the biannual monitoring report. 5. Consult with the City, the Golf Course Developer, and the Corps regarding permit compliance issues at both the off-site mitigation area and the golf course. 6. Conduct permit compliance monitoring and prepare biannual reports through the year 2004. 7. Conduct a tree survival survey at the end of the year 2004 growing season, analyze the data, and document the results in the biannual monitoring report. Compensation shall be adjusted as follows: 1. Permit compliance monitoring services rendered in 2002 $7,890.00 2. Permit compliance activities estimated for 2003 $12,850.00 3. The above described services shall proceed upon return of this Contract Change Authorization. Services will be billed as they are done.
