HomeMy WebLinkAboutItem 11 - Trunked Radio SystemMEMO TO: FROM: MEETING DATE SUBJECT: RECOMMENDATION: M fm // -- - - HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGE APRIL 15, 2003 AMENDMENT TO THE TRUNKED RADIO SYSTEM INTERLOCAL AGREEMENT City Council to consider a resolution to amend the Trunked Radio System Interlocal Agreement, thereby allowing the City of Southlake to join as a full member FUNDING SOURCE: No funding is required for this resolution BACKGROUND: The Northeast Tarrant County Trunked Radio Consortium currently consists of Grapevine, Bedford, Euless, Colleyville and Keller. This interlocal agreement allows for the usage of this radio system by these member cities for public safety and city department radio communications. The current agreement also allows for additional municipalities to buy into the system. On March 4, 2003 the City of Southlake Council approved a resolution, essentially buying into the Trunked Radio Consortium. In order to join the system as a full member, the City of Southlake will pay the City of Grapevine the total sum of $469,775.00. Additionally, Grapevine's portion of the maintenance contract on this system will be reduced from 1/5 to 1/6 of the overall cost of system maintenance. HE April 8, 2003 (9:42AM) INTERLOCAL AGREEMENT AMENDMENT 4) BEDFORD, COLLEYVILLE, EULESS, GRAPEVINE, KELLER ANDSOUTHLAKE THIS AMENDMENT to the Interlocal Agreement relating to the ownership, management, future updates, future membership, maintenance, and operation of the 800 MHz trunk radio system (hereafter known as "The Trunk System') is made this the day of 2003, by and between the CITIES OF BEDFORD, COLLEYVILLE, EULESS, GRAPEVINE, KELLER, and SOUTHLAKE, all being home - rule municipalities, located in Tarrant County Texas (hereinafter collectively known as the "Members"), and WHEREAS, the existing interlocal agreement, passed the 3`d day of March, 2000, in Section 2.3 provides for the addition of future members of The Trunk System, and WHEREAS, Section 2.3 of the existing interlocal agreement specifies the fees to be paid by member number six to the City of Grapevine (1/6`h share of the cost of the initial trunk system infrastructure in the amount of $205,472 and 1/6d' of the Colleyville prime site upgrade $265,302) and, WHEREAS, the City of Southlake has requested membership in The Trunk System agreeing to pay the aforementioned fees to the City of Grapevine ($469,775) in a manner agreeable to the City of Grapevine, and WHEREAS, the City of Southlake will maintain ownership of a 800 MHz frequency to be added to The Trunk System as a requirement of membership, including the filing for all appropriate Federal Communication Commission documents required to merge the frequency into the system infrastructure, and WHEREAS, the City of Southlake has agreed to fund the installation of the required radio equipment to merge the 800 MHz channel into the infrastructure necessary for the merging of the frequencies, including the reprogramming of subscriber and console equipment of the other Members, and WHEREAS, the current Members acknowledge that this amendment to the existing interlocal agreement is intended to include the City of Southlake as member number six as specified in Section 2.3 of the existing interlocal agreement, and WHEREAS, Chapter 791 of the Texas Government Code provides for interlocal agreements for governmental functions such as contemplated by this Agreement, 1 NOW, THEREFORE, upon the mutual covenants, conditions and promises contained herein, the Members agree that Section 2.3 of the existing interlocal agreement be amended by the addition of sub - Section 2.3.1 as follows: Section 2.3.1 Membership - Southlake 2.3.1.1 Membership in The Trunk System is hereby granted to the City of Southlake, provided: 1. Payment of the buy in fees as specified by the interlocal agreement is made to the City of Grapevine. 2. The 800 MHz frequency owned by the City of Southlake is merged into the infrastructure. 3. All necessary infrastructure equipment upgrades, including base stations, are provided by the City of Southlake, and 4. The reprogramming of subscriber equipment, including consoles is provided by the City of Southlake. 5. That the City of Southlake agrees to abide by the provisions of the existing interlocal agreement, this amendment and the by laws of the Technical Committee. 2.3.1.2 Members agree that future members who bring radio frequencies to The System, in addition to paying all buy in fees as required by Section 2.3 of the initial interlocal agreement, shall pay to the City of Southlake an amount equal to twenty-five percent of the upgrade provided by Southlake ($13,307) for each frequency added to the infrastructure. The payments to Southlake are hereby limited to the installation of three additional frequencies as that complete the loading of the upgrade provided by Southlake. NOW, THEREFORE, upon the mutual covenants, conditions and promises contained herein, the Members agree that Section 6.4 of the existing interlocal agreement shall be added as follows: 6.4 - City of Colleyville to serve as payee of associated expenses. 2 6.4.1 - The City of Colleyville shall receive and pay all bills associated with the maintenance and management of the infrastructure of The Trunk System on behalf of all existing and future members. Associated bills shall be submitted to the City of Colleyville by all vendors. 6.4.2 - The City of Colleyville, at least quarterly, shall provide an accounting of associated bills that have been paid and invoice each member for their share of the expenses. Accounting statements and bills may be provided at the regular meetings of the Technical Committee. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AUTHORIZING AN AMENDMENT TO SECTION 2.3 AND THE ADDITION OF SECTION 6.4 OF THE INTERLOCAL AGREEMENT WITH THE CITIES OF COLLEYVILLE, EULESS, BEDFORD AND KELLER TO ALLOW THE CITY OF SOUTHLAKE TO BECOME THE SIXTH MEMBER OF THE TRUNK RADIO SYSTEM AND TO PROVIDE FOR THE PAYMENT OF ASSOCIATED INFRASTRUCTURE EXPENSES AND PROVIDING AN EFFECTIVE DATE WHEREAS, in March, 2000 the City Councils of Bedford, Colleyville, Euless and Keller approved an interlocal agreement to allow the City of Grapevine to become the fifth member of the trunk radio system; and WHEREAS, that interlocal agreement provides for the addition of additional Members; and WHEREAS, the City of Southlake has requested membership in the trunk radio system, including additional infrastructure upgrades and the addition of one (1) 800 MHz radio frequency that will benefit all members; and WHEREAS, the cost of system maintenance and management currently paid by each member city will be reduced by the addition of Southlake to the system; and WHEREAS, the Technical Committee has reviewed system loading and frequency allocations, and recommends membership for the City of Southlake; and WHEREAS, the Technical Committee has agreed to allow one member, the City of Colleyville, to receive and pay all associated bills on behalf of the Members; and WHEREAS, Chapter 791 of the Texas Government Code provides for interlocal agreements for governmental functions such as contemplated by such an Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the above preamble are true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council hereby approves an amendment to Section 2.3 and the addition of Section 6.4 of the interlocal agreement with the cities of Colleyville, Euless, Bedford, Keller and Southlake by the addition of Section 2.3.1 to include the City of Southlake as the sixth member of the Trunk Radio System and Section 6.4 to pay associated infrastructure expenses. Section 3. That this resolution shall become effective from and after the date of its passage.
