HomeMy WebLinkAboutItem 04 - No Parking Zones - Barton Street and Franklin StreetMEMO TO: FROM: MEETING DATE: SUBJECT: RECOMMENDATION: ITEM # nmnm� 4L —� HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER e/ OCTOBER 3, 2000 NO PARKING ZONES — BARTON STREET AND FRANKLIN STREET City Council consider adopting an Ordinance amending Section 23-63, No Parking Zones, Restricted Parking Zones, of the City Code of Ordinances to establish No Parking zones on Barton Street and Franklin Street, and take any necessary action. BACKGROUND: The No Parking zones are being requested on a 25 foot section of Franklin Street (north side only) and a 110 foot section of Barton Street (west side only) at the northwest corner of the intersection of Barton Street and Franklin Street. The No Parking zone on Franklin Street is needed in order to provide better corner visibility for vehicles coming out of Barton Street. Vehicles typically park right up to the intersection corner on the north side of Franklin Street. Currently, vehicles coming out of Barton Street cannot see the eastbound vehicles on Franklin Street unless they pull out so far into the intersection that they are in the path of westbound traffic. The proposed No Parking zone will result in the loss of one on -street parking space. The No Parking zone on Barton Street is needed to provide better visibility to motorists entering and exiting the parking lot located on the northwest corner of the subject intersection. Willhoite's Restaurant management requested the area be designated a No Parking zone. The proposed No Parking zone will result in the loss of one parking space. Staff recommends approving the No Parking zones as they provide for improved traffic safety without significant loss of parking. C6 z 3 , H1bON ~ Z z '1 HaHnHO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 23 TRAFFIC, SECTION 23-63 RELATIVE TO NO PARKING ZONES, RESTRICTED PARKING ZONES; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 23, Section 23-63, No Parking Zones, Restricted Parking Zones of the Grapevine Code of Ordinances is hereby amended by the addition of the following no parking zones: "Barton Street, west side, from the intersection of Barton Street and Franklin Street to 110 feet north of the intersection of Barton Street and Franklin Street." "Franklin Street, north side, from the intersection of Barton Street and Franklin Street to 25 feet west of the intersection of Barton Street and Franklin Street." Section 2. That the City Manager, or his designee, is hereby authorized to have the proper traffic signs erected, constructed, and placed at such points along said highways, streets or alleys, or portions hereof under construction, maintenance or repair so that travelers will be reasonably notified of said traffic regulations. Section 3. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect; provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas, shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding not guilty or nolo contendere, or dismissal. Section 4. Any person violating any of the provisions of this ordinance shall be n"I deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Five Hundred Dollars ($500.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
