HomeMy WebLinkAboutItem 09 - Speed LimitsSTEM a 2_ MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER MEETING DATE: NOVEMBER 7, 2000 SUBJECT: SPEED LIMITS — CAPITOL STREET, HANOVER DRIVE, MUNICIPAL WAY, TRINITY PARKWAY, EULESS-GRAPEVINE ROAD, WESTPORT PARKWAY AND MUSTANG DRIVE RECOMMENDATION: City Council consider adopting an Ordinance amending Section 23-26, Speed Limits - Schedule for Certain Public Streets and Ways, of the City Code of Ordinances to establish the following speed limits: 35 mph speed zone in both directions on Capitol Street between Municipal Way and Trinity Parkway • 40 mph speed zone in both directions on Hanover Drive between South Main Street and Minters Chapel Road • 30 mph speed zone in both directions on Municipal Way between Nash Street and Capitol Street • 35 mph speed zone in both directions on Trinity Parkway between Hanover Drive and State Highway 114 Westbound Service Road • 40 mph speed zone in both directions on Euless -Grapevine Road between State Highway 360 and Westport Parkway • 40 mph speed zone in both directions on Westport Parkway between Stone Myers Parkway and Euless -Grapevine Road 45 mph speed zone in both directions on Mustang Drive between State Highway 121 Northbound Service Road and South Main Street, and take any necessary action. BACKGROUND: The following is a brief description of the subject streets. The majority of the streets were recently constructed and speed limits have never been posted. October 31, 2000 (10:45AM) ■ Capitol Street is a short street, approximately 2,000 feet long, that runs between Municipal Way and Trinity Parkway. The existing development is concentrated on the section between Municipal Way and approximately 400 feet east of Municipal Way. The remaining section has no development. It is a four -lane roadway with no parking on either side. ■ Hanover Drive runs from South Main Street to Minters Chapel Road. It is a four -lane roadway, approximately 4,200 feet long, with no development adjacent to the street (a new development is under construction at the corner of Main Street and Hanover Drive). There is an all -way Stop control at Municipal Way. Parking is prohibited on both sides. ■ Municipal Way runs from Nash Street to Capitol Street and is approximately one half mile long. It has a two-lane section between Nash Street to 600 feet south of Vine Street. The Grapevine Community Activity Center, Grapevine Library and the Grapevine Convention Center are all located on this section. South of this section, the roadway widens to accommodate a center turn -lane. There is currently no development on this section. There are all -way Stop controls at Vine Street, Hanover Drive and Capitol Street. Parking is prohibited on both sides. ■ Trinity Parkway is a short street that runs from Hanover Drive to State Highway 114 Westbound Service Road. This is a four -lane divided roadway, approximately 1,200 feet long. Parking is prohibited on both sides. No development currently exists along Trinity Parkway. ■ The section of Euless -Grapevine Road between Westport Parkway and State Highway 360 is a two-lane asphalt rural roadway section approximately 3,200 feet long. There is no curb, gutter or sidewalk over a majority of the street section. Parking is prohibited on both sides. ■ The section of Westport Parkway between Euless -Grapevine Road and Stone Myers Parkway is a four -lane roadway, approximately 4,600 feet in length. Development along Westport Parkway consists mainly of distribution/ warehouse facilities. Parking is prohibited on both sides. ■ The section of Mustang Drive between State Highway 121 Northbound Service Road and South Main Street is a four -lane roadway with a center median. Mustang Drive currently provides access to the rear of the Tinseltown Movie Theater. A secondary access driveway provides access to Stacy's Furniture, Holiday Inn Express, Main Event, the Freeman dealership and several other restaurants. The street segment is approximately 2,300 feet long. The current speed limit on Mustang Drive is 35 mph. However, citizens have voiced concerns that this speed limit is too low. As per the Texas Transportation Code, streets meeting the definition of an Urban District have a prima facie speed limit of 30 mph. If the street does not meet the definition of an October 31, 2000 (10:45AM) Urban District, the prima facie speed limit is 60 mph in daytime and 55 mph in nighttime (the speed limit is 50 mph for a school bus). The State law allows municipalities to alter the speed limit from the prima facie speed by means of an engineering and traffic investigation. The subject streets do not meet the definition of an Urban District. Therefore, an engineering and traffic investigation was conducted to provide a safe and reasonable speed limit. The investigation typically involves measuring the actual speeds of free- flowing vehicles and determining the speed at or below which the majority of the vehicles (85%) are traveling. The speed limit is set close to this 85th percentile speed. However, if a sufficient sampling of traffic volumes cannot be obtained, the speed study may be conducted by the trial run method. In the trial run method, the roadway is driven at different speeds in order to determine the speed that is most comfortable to drive. On Mustang Drive, a sufficient volume sample existed to measure the 85th percentile speed and it was determined to be 45 mph. Due to the limited number of vehicles observed on the remaining six streets, trial runs of the roadway were conducted. Based on the trial runs, the most comfortable speed on Municipal Way was 30 mph, on Trinity Parkway and Capitol Street it was 35 mph and on Hanover Drive, Euless -Grapevine Road and Westport Parkway it was at 40 mph. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 23 TRAFFIC, SECTION 23-26 SCHEDULES FOR CERTAIN PUBLIC STREETS AND WAYS, ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTIONS 167 AND 169 OF ARTICLE XIX, R.C.S. 6701 d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF GRAPEVINE AS SET OUT IN THE ORDINANCE; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Sections 167 and 169 of Article XIX, R.C.S. 6701 d, Uniform Act Regulating Traffic on Highways, provide that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 23 Traffic, Section 23-26 Schedule for Certain Public Streets and Ways of the Grapevine Code of Ordinances is hereby amended upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Sections 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act. Regulating Traffic on Highways, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: Street and Location Speed Limits (Miles Per Hour) "Capitol Street from Municipal Way to Trinity Parkway, eastbound and westbound ..... 35 Euless -Grapevine Road from Westport Parkway to northbound State Highway 360, northbound and southbound..... 40 Hanover Drive from South Main Street to Minters Chapel Road, eastbound and westbound..... 40 Municipal Way from Nash Street to Capitol Street, northbound and southbound..... 30 Trinity Parkway from Hanover Drive to State Highway 114 Westbound Service Road, northbound and southbound..... 35 Westport Parkway from Stone Myers Parkway to Euless -Grapevine Road, eastbound and westbound..... 40 Mustang Drive between State Highway 121 Northbound Service Road and South Main Street, eastbound and westbound..... 45" Section 2. That the City Manager, or his agent, is hereby authorized to have the proper traffic signs erected, constructed, and placed at such points along said highways, streets or alleys, or portions thereof under construction, maintenance, or repair, so that travelers will be reasonably notified of said traffic regulations. I Section 3. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas shall be deemed repealed only when all such cases filed and pending under such ordinance or ORD. NO. 2 ordinances have been disposed of by a final conviction or a finding of not guilty, nolo contendere, or dismissal. Section 4. That any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction in the Municipal Court, shall be fined in an amount not to exceed the sum of Five Hundred Dollars ($500.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in the ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas do not adequately regulate the traffic within the City creates an emergency and the preservation of the public health, safety, and welfare requires that this ordinance take effect immediately from and after the date of its passage.
