HomeMy WebLinkAboutItem 19 - Oak Grove Park Restrooms and Parking LotITEM # /Q - MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER MEETING DATE: NOVEMBER 21, 2000 SUBJECT: APPROVAL OF A RESOLUTION FOR RENOVATONS OF THE OAK GROVE PARK RESTROOMS AND PARKING LOT AS REQUIRED BY THE TEXAS DEPARTMENT OF LICENSING AND REGULATION RECOMMENDATION: City Council to consider approval of a resolution to renovate the restrooms and parking lot at Oak Grove Park as required by the Texas Department of Licensing and Regulation. The total cost of this purchase is not to exceed $27,990.55. FUNDING SOURCE: Funding for this purchase is currently available in account: 174-74099-000-000 Street Maintenance/Capital Replacement/Reserved-Future Parks Maintenance... $27,990.55 BACKGROUND: This procurement will be made as an exemption to the general bidding procedure and in accordance with Texas Local Government Code, Chapter 252.022 (a) (2) which authorizes political subdivisions to make a procurement necessary to preserve or protect the public health or safety of the municipality's residents. This request is for the renovation of the Oak Grove Park Restrooms and Parking Lot in order to be in compliance with the Texas Department of Licensing and Regulation. The Dallas Regional Office of the TDLR notified staff that the facilities and parking lot were in non-compliance with the provisions of the Architectural Barriers Act, Article 9102, of the Texas Civil Statutes. Because of this notification and in order to eliminate any possible endangerment to the Citizens of Grapevine Staff has contracted with T. W. Foster, Inc. to make all necessary renovations to the Oak Grove facilities. Staff recommends approval. CD November 8, 2000 (10:53AM) 0 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE MAYOR TO APPROVE A CONTRACT FOR THE RENOVATION OF THE OAK GROVE PARK RESTROOMS AND PARKING LOT IN ORDER TO BE IN COMPLIANCE WITH THE STATE OF TEXAS PROVISIONS OF THE ARCHITECTURAL BARRIERS ACT, ARTICLE 9102, TEXAS CIVIL STATUTES AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas is a local government in the State of Texas and as such is empowered by the Texas Local Government Code, Section 252.022 (a) (2) to enter into a contract as an emergency to preserve or protect the public health or safety of the municipality's residents; and WHEREAS, the Dallas Regional Office of the Texas Department of Licensing and Regulation has notified the City of Grapevine that certain repairs need to be completed to the Oak Grove Park restroom facilities and parking lot in accordance with the Architectural Barriers Act, Article 9102, Texas Civil Statutes; and WHEREAS, the City of Grapevine, Texas, has contracted with T. W. Foster, Inc. to complete said repairs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the above preamble are true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council of the City of Grapevine authorizes the repairs required by the Texas Department of Licensing and Regulation for a total cost not to exceed $27,990.55. Section 3. That the City Manager, or his designee, is authorized to take all steps necessary to consummate said repairs.
