Tate Mayor Ted R. Ware Mayor Pro Tem Sharron Spencer Council Member C. Boyle, Jr. Linda Huff Melisa Leal Jennifer Hibbs CALL TO ORDER City Manager Assistant City Manager City Attorney City Secretary Assistant to the City Manager Assistant to the City Manager Mayor Tate called the meeting to order at 7:01 p.m. ITEM 1. DISCUSS ADOPTION OF 2000 INTERNATIONAL RESIDENTIAL CODE Assistant Director of Development Services Scott Williams advised that Senate Bill 365 adopted the 2000 International Residential Code (IRC) as the municipal residential building code in Texas. The IRC replaces the 1994 Uniform Building Code, 1994 Uniform Mechanical Code and the 1991 Uniform Plumbing Code for one and two family dwellings and multi -family structures with property lines between units three stories or less in height with separate means of egress and their accessory structures only. The legislation allows cities to review and adopt amendments to the IRC. Mr. Williams advised that an item was on the regular agenda to adopt the IRC with amendments. There was no action taken by the City Council. EXECUTIVE SESSION Mayor Tate announced the City Council would conduct a closed session regarding (A) real property relative to leasing property on Main Street and (B) conference with City Manager and Staff to discuss and deliberate commercial and financial information received from business prospects the City seeks to have locate and expand in the City; with which businesses the City is conducting economic development negotiations under Sections 551.072 and 551.086, Texas Government Code. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Roger Nelson stated there was no action necessary relative to (A) real property relative to leasing property on Main Street and (B) conference with City Manager and Staff to discuss and deliberate commercial and financial information received from business prospects the City seeks to have locate and expand in the City; with which businesses the City is conducting 12/04/01 economic development negotiations under Sections 551.072 and 551.086, Texas Government Code. NOTE: City Council continued with the Regular City Council meeting in open session in the Council Chambers. ITEM 1A. CITIZENS COMMENTS, MR. BRUCE RIDER Mr. Bruce Rider, 325 West Worth Street, addressed the City Council regarding the proposal to limit political signs in the right-of-way to 10 days prior to an election. He requested the City Council consider amending the proposed ordinance to allow political signs in the right-of-way at least 20 days prior to the election to include early voting. ITEM 1, ORDINANCE, AMEND CHAPTER 20 STREETS, SIDEWALKS AND OTHER PUBLIC WAYS City Manager Nelson requested approval of an ordinance amending the Grapevine Code of Ordinances, Chapter 20 Streets, Sidewalks and Other Public Ways relative to political signs of a temporary nature in the public right-of-way. The amendment would continue to allow political signs in the right-of-way, but for a period of ten days prior to election day instead of the current 30 days. The proposal does not impact the placement of political signs on private property. Council Member Spencer, seconded by Council Member Wilbanks, offered a motion to approve the ordinance with the amendment that political signs be allowed 17 days prior to election day, or to coincide with the early voting period. The motion prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Stewart Nays: None Absent: Freed ORDINANCE NO. 2001-91 AN ORDINANCE AMENDING THE CITY OF GRAPEVINE CODE OF ORDINANCES, CHAPTER 20, SECTION 20-13.1 SIGNS ON RIGHTS-OF-WAY RELATIVE TO POLITICAL SIGNS OF A TEMPORARY NATURE, DECLARING AN EMERGENCY, PROVIDING A SEVERABILITY CLAUSE, PROVIDING FOR REPEAL OF INCONSISTENT ORDINANCES AND PROVIDING AN EFFECTIVE DATE. CONSENT AGENDA The next order of business for the City Council to consider was the consent agenda items, which were deemed to need little or no discussion and were acted upon as one business item. Mayor Tate asked if there was any member of the audience or the City Council who wished to remove an item from the consent agenda for full discussion. There were none. Item 2. Ordinance, Abandon Street Right -of -Way, Hall Addition Public Works Director recommended approval of an ordinance abandoning 1,525 square feet of street right-of-way located adjacent to Lots H & 1, J. J. Hall Addition. Motion by Council Member Stewart, seconded by Council Member Johnson, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Stewart Nays: None Absent: Freed AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A 2 PORTION OF RIGHT-OF-WAY LOCATED ON THE EAST SIDE OF THE CUL-DE SAC AT THE NORTH END OF STARNES STREET IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED AND PROVIDING AN EFFECTIVE DATE Item 3. Ordinance, Amend Chapter 7 Buildings and Construction Development Services Director recommended approval of an ordinance amending the Grapevine Code of Ordinances, Chapter 7 Buildings and Construction relative to adoption of the 2000 International Residential Code and amendments. Motion by Council Member Stewart, seconded by Council Member Johnson, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Stewart Nays: None Absent: Freed ORDINANCE NO. 2001-93 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 7, BUILDINGS AND CONSTRUCTION, RELATING TO THE ADOPTION OF THE 2000 INTERNATIONAL RESIDENTIAL CODE FOR ONE AND TWO FAMILY DWELLINGS AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, PROVIDING AMENDMENTS TO SAME, REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY, NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00) FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE Item 4. Resolution Award Annual Contract Brodart McNaughton Book Service Staff recommended approval of a resolution declaring Brodart McNaughton Book Service as a sole source supplier of book services for the Grapevine Library for an amount of $17,877.00. Resolution, Authorize Purchase of Laptop Computers Police Chief recommended approval of a resolution authorizing the purchase of laptop computers from Trio Teknologies through the State of Texas Qualified Information Systems Vendor Program in the amount of $80,773.70. Motion by Council Member Stewart, seconded by Council Member Johnson, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Stewart Nays: None Absent: Freed RESOLUTION NO. 2001-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING PARTICIPATION IN THE PURCHASING PROGRAMS OF THE STATE PURCHASING AND GENERAL SERVICES COMMISSION FOR CERTAIN ITEMS; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACTS AND DOCUMENTS; AND PROVIDING AN EFFECTIVE DATE Item 6. Resolution Authorize Purchase of Mobile Radios Fire Chief recommended approval of a resolution declaring Motorola, Inc. as a sole source supplier for the purchase of mobile radios for the Fire Department in the amount of $29,123.00. Motion by Council Member Stewart, seconded by Council Member Johnson, to approve as recommended prevailed by the following vote: 0 Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Stewart Nays: None Absent: Freed RESOLUTION NO. 2001-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, MAKING FINDINGS OF CERTAIN FACTS RELATIVE TO THE PURCHASE OF MOTOROLA PORTABLE RADIOS THAT ARE AVAILABLE FROM ONLY ONE SOURCE AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACTS AND DOCUMENTS AND PROVIDING AN EFFECTIVE DATE Item 7. Award Bid 114-2001 Propane Fuel Annual Contract Public Works Director recommended award of Bid 114-2001 Propane Fuel Annual Contract to the lowest and best bidder meeting specifications, Northwest Butane Company. Motion by Council Member Stewart, seconded by Council Member Johnson, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Stewart Nays: None Absent: Freed Item 8 Award Contract Wallis Building Remodeling, Keltner Construction, Inc. Convention & Visitors Bureau Director recommended approval of the award of a contract to Keltner Construction, Inc. for remodeling at the Wallis Building in the amount of $19,418.40.
