Galbreath 1 f i t t i t � I LH. 1635 m Northwest PROPERTY LOCATION AND SIZE: The subject property is located at 1601 West State 1 Sy DFW Highway 114 and is proposed to be platted as Lots 1 Hall -Johnson iso Airp0" 1 and 2, Block 1, Wal-Mart Addition. The addition r--- o contains 40.955 acres. The property has L_ 21 Glade Rd. — —I —� approximately 803 feet of frontage along State Highway 114 and 2,584 feet of frontage along State 3 Highway 26/Ira E. Woods Avenue. REQUESTED ZONE CHANGE AND CONDITIONAL USE AND COMMENTS: The applicant is requesting to rezone a 40.955 acre tract of land from "LI" Light Industrial District to "CC". Community Commercial District. CU01-71 is a request for approval of a conditional use permit for a planned commercial center including a request for an automotive repair facility, gasoline sales the possession storage retail sale and off premise consumption of alcoholic beverages (beer and wine only) in conjunction with a retail store, and approval of one 40 -foot pole sign and two 20 -foot pole signs The proposed retail development includes plans for a 204,167 square foot Wal-Mart Supercenter and 152,261 square foot Sam's Club. The two buildings are separated by a proposed public access easement that will connect State Highway 26 with Industrial Boulevard. The public access easement's intersection with State Highway 26 aligns with the new Earnest Dean Parkway to the south that provides access to Best Buy and 0:/ZCU/CU01-71.4 January 9, 2002 (1:47PM) 0:/ZCU/Z01-19.4 Academy Sports. The portion of Industrial Boulevard connecting Grapevine Industrial Park with Heritage Business Park will be vacated to accommodate the development, as will Regional Road, which currently serves the G.E. Modular Office Building Rental facility. Three access drives are proposed off of State Highway 114, and two access drives are proposed off of State Highway 26. The two access drives from State Highway 26 will cross over the existing 100 -foot Dallas Area Rapid Transit right-of-way. To reduce congestion on the Wal-Mart site, an electric gate and breakable bollards have been placed on the north and south sides of the building, respectively, to force trucks making deliveries and pickups to use Industrial Boulevard from Heritage Business Park to access the rear of the building. Conversely, customer traffic from Wal-Mart will not be able to cut -through the Heritage Business Park development. The electric gate will provide police and other emergency vehicles access for routine patrol. Both the Wal-Mart Supercenter and Sam's Club are proposing to sell alcoholic beverages (beer and wine only) for off -premise consumption. Gasoline sales are proposed on the Sam's Club site. A total of three pole signs are proposed for the development. Two 20 - foot pole signs, one for each site, are proposed along State Highway 26. One 40 -foot pole sign is proposed along State Highway 114, which will identify both Wal-Mart and Sam's Club. A large amount of the existing trees have been preserved on the site, although most of these trees are located in the rear yards of the Wal-Mart or Sam's Club. Landscaping located in the established rear yard that is in excess of the minimum landscaping requirements shall not count towards the minimum open space requirement. However, in order to preserve the existing vegetation, effectively maintaining natural buffers to existing development and enhancing the overall aesthetics, Staff suggests this landscaping be counted towards meeting the 20% open space requirements. As you may recall, Section 25.M.6 of the Zoning Ordinance states the following: "The Planning and Zoning Commission may recommend and the City Council may require buffering, screening, fencing and landscaping requirements on any ... conditional use permit ... in addition to or in lieu of buffering, screening, fencing or landscaping requirements set out specifically in each use district when the nature and character of surrounding or adjacent property dictate a need to require such methods in order to protect such property and to further provide protection for the general health, welfare and morals of the community in general." With the inclusion of these natural landscape buffers, open space accounts for approximately 24% of the entire project. Part of the site is developed with a G.E. Modular Office Building Rental facility and the remainder of the site is undeveloped. - 10 W • W A The eastern portion of the subject property as well as those surrounding areas to the north and south were rezoned in the 1984 City Rezoning from "1-1" Light Industrial district to "Ll", Light Industrial District. The western portion of the subject site was rezoned from 1-2", Heavy Industrial District to "Ll", Light Industrial District at that time. SU97-03 approved the installation of a 35 -foot telecommunications tower with the accompanying equipment cabinet in February 1997. It was not installed and the special use permit expired. CU95- 14, approved in June 1995, provided for the development of mini -storage warehouses with outside storage to the north of the subject site. CU95-25, approved in November 1995, revised the site plan of the mini -storage warehouse facility and the fagade of the accompanying office building. CU99-67 (Ord. No. 99-177) for a planned commercial center was approved for the property to the south on December 7, 1999. CU00-65 (Ord. No. 01- 03) 1-03) was approved in January 2001, providing for the development of Lots 2, 3 and 7 as well as amending the landscape plan for the site. CU01-17 (Ord. No. 01-32) was approved in April 2001, allowing for the development of Lots 5 and 6 with an Academy Sports store. CU01-56, approved in October 2001, allowed the possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine and mixed drinks) in conjunction with a restaurant located on Lot 2. The property located to the west was not within the City of Grapevine prior to the 1984 City Rezoning, but was located within the City's Extraterritorial boundary. In 1986 this property and nearby surrounding property (approximately 63.53 acres) was annexed into the City and immediately rezoned to "Ll", Light Industrial District. Since that time, the area has seen a high level of development activity as an industrial park. The property to the east was rezoned from "PD", Planned Development in the 1984 City Rezoning to "PCD", Planned Commerce Development District. Zoning Case Z87-09, approved in June 1987 rezoned the site to "CC", Community Commercial District. CU92- 06 was approved in May 1992, thus expanding the Baylor Medical Center site into this property. In "Zone B" the following uses may be considered only if sound treatment is included in building design: multifamily apartments, motels, office buildings, movie theaters, restaurants, personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as Industrial. The proposed retail stores do not comply with this designation. There are two proposed points of access across DART ROW to Ira E. Woods Ave. (SH 26). The most easterly drive access is proposed to lineup with the recently constructed Ernest Dean Parkway signalized intersection. (The westerly drive will be a right in/right out access, with no signals at SH 26, providing access to and from the Wal -Mart's front entrance.) Both access points will require railroad crossing signal standards at the rail crossing. 4. Industrial Boulevard right-of-way will be abandoned with this development at both the west and north property line of Lot 2. Truck operations for the proposed Wal-Mart site will access from the west on Industrial Boulevard and will use an electric gate to access from Industrial Boulevard from the north. Industrial Boulevard to the north will connect to a proposed 36' wide public access easement, which terminates at the Ernest Dean Parkway intersection at Ira E. Woods Ave. STORM DRAINAGE SYSTEM: 1. The western half of the proposed development drains west into two existing detention ponds constructed with the Heritage Business Park Development. Flows from the southern pond discharge south into Creek 16, a tributary of Big Bear Creek. The eastern half of the proposed development will flow to a proposed detention pond behind the Sam's Club Building. Flows from this pond will discharge north into an existing storm drain system that drains northeast to Farris Branch West, a tributary of Lake Grapevine. 2. The developer will be required to address downstream drainage improvements for fully developed conditions in accordance with the City of Grapevine Code of Ordinances. IV. WATER SYSTEM: 1. There are four existing 12" water lines that supply water on all sides of the proposed 39.9 -acre development. The developer is proposing an on site water distribution system with fire hydrants to serve this site which will connect to all four 12" main lines. 2. The developer will be required to provide a water system adequate to serve the domestic and fire protection needs for this site in accordance with the City's Development Standards. V. SANITARY SEWER SYSTEM: 1. There are two existing 8" sanitary sewer mains that supply service to the proposed building sites. The developer has proposed an on site collection system that ties into the existing 8" lines. 2. The existing and proposed sanitary sewer collection systems are adequate to serve the development of this site. VI. MISCELLANEOUS: 1. Water and Wastewater Capital Recovery Impact Fees are due prior to the issuance of any building permits. (Current Fee is $5,402.00 per acre) 2. A Developer Agreement for the railroad crossings and access connection to Ira E. Woods Ave. (SH 26) improvements must be approved by Council, DART, and TxDOT prior to the release of public infrastructure construction. 3. The developer will be responsible for the construction of all driveway, signals, striping, utility relocations, water main, sanitary sewer main, and storm drainage infrastructure associated with the development of this site. VII. STATEMENT OF FINDINGS: A. The City has determined that the dedications required for access, streets, utilities, drainage and other municipal needs and services are consistent with the City's ordinances and master plan, are reasonable and are connected to the proposed project in the following manner: 1. The on-site utility easements are necessary to provide for public and franchised utility service to this site and surrounding developments. 2. The on-site access easements are necessary to allow for public access through this site. 3. The on-site drainage easements are necessary to allow for storm drainage through this site. B. The City further finds that the required dedication is related both in nature and extent to the impact of the proposed development as follows: 1. The on-site utility, access and drainage easements are consistent with the City's policies for easement dedications where there are existing utilities, where future utilities and internal drives would be located, and along necessary drainage patterns. 2. All of the dedications benefit the development to at least the extent of the impact of such on the development. VIII. Woods Avenue (State Highway 26). II. STREET SYSTEM: 1. This site has access to State Highway 114 southbound frontage road to the east, Ira E. Woods Ave. to the south, and Industrial Boulevard to the north. Truck traffic only will have access to Industrial Boulevard to the west. 2. There are three proposed drives to the State Highway 114 southbound frontage road. The most northerly drive provides access to the Sam's Club dock areas, the middle drive will provide access to the front door of Sam's Club and continues access to the Wal-Mart site, and the south drive will provide access to Sam's Club parking lot and the proposed gas station. 3. There are two proposed points of access across DART ROW to Ira E. Woods Ave. (SH 26). The most easterly drive access is proposed to lineup with the recently constructed Ernest Dean Parkway signalized intersection. (The westerly drive will be a right in/right out access, with no signals at SH 26, providing access to and from the Wal -Mart's front entrance.) Both access points will require railroad crossing signal standards at the rail crossing. 4. Industrial Boulevard right-of-way will be abandoned with this development at both the west and north property line of Lot 2. Truck operations for the proposed Wal-Mart site will access from the west on Industrial Boulevard and will use an electric gate to access from Industrial Boulevard from the north. Industrial Boulevard to the north will connect to a proposed 36' wide public access easement, which terminates at the Ernest Dean Parkway intersection at Ira E. Woods Ave. III. STORM DRAINAGE SYSTEM: 011 1. The western half of the proposed development drains west into two existing detention ponds constructed with the Heritage Business Park Development. Flows from the southern pond discharge south into Creek 16, a tributary of Big Bear Creek. The eastern half of the proposed development will flow to a proposed detention pond behind the Sam's Club Building. Flows from this pond will discharge north into an existing storm drain system that drains northeast to Farris Branch West, a tributary of Lake Grapevine. 2. The developer will be required to address downstream drainage improvements for fully developed conditions in accordance with the City of Grapevine Code of Ordinances. IV. WATER SYSTEM: 1. There are four existing 12" water lines that supply water on all sides of the proposed 39.9 -acre development. The developer is proposing an on site water distribution system with fire hydrants to serve this site which will connect to all four 12" main lines. 2. The developer will be required to provide a water system adequate to serve the domestic and fire protection needs for this site in accordance with the City's Development Standards. V. SANITARY SEWER SYSTEM: 1. There are two existing 8" sanitary sewer mains that supply service to the proposed building sites. The developer has proposed an on site collection system that ties into the existing 8" lines. 2. The existing and proposed sanitary sewer collection systems are adequate to serve the development of this site. VI. MISCELLANEOUS: 1. Water and Wastewater Capital Recovery Impact Fees are due prior to the issuance of any building permits. (Current Fee is $5,402.00 per acre) 2. A Developer Agreement for the railroad crossings and access connection to Ira E. Woods Ave. (SH 26) improvements must be approved by Council, DART, and TxDOT prior to the release of public infrastructure construction. 3. The developer will be responsible for the construction of all driveway, signals, striping, utility relocations, water main, sanitary sewer main, and storm drainage infrastructure associated with the development of this site. VII. STATEMENT OF FINDINGS: A. The City has determined that the dedications required for access, streets, utilities, drainage and other municipal needs and services are consistent with the City's ordinances and master plan, are reasonable and are connected to the proposed project in the following manner: 1. The on-site utility easements are necessary to provide for public and franchised utility service to this site and surrounding developments. 2. The on-site access easements are necessary to allow for public access through this site. 3. The on-site drainage easements are necessary to allow for storm drainage through this site. B. The City further finds that the required dedication is related both in nature and extent to the impact of the proposed development as follows: 1. The on-site utility, access and drainage easements are consistent with the City's policies for easement dedications where there are existing utilities, where future utilities and internal drives would be located, and along necessary drainage patterns. 2. All of the dedications benefit the development to at least the extent of the impact of such on the development.
