HomeMy WebLinkAboutItem 17 - No Parking Zones, Industrial BoulevardMEMO TO: FROM: MEETING DATE: SUBJECT: RECOMMENDATION: ITEM % r HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER JANUARY 15, 2002 NO PARKING ZONES — INDUSTRIAL BOULEVARD City Council consider adopting an Ordinance amending Section 23-63, No Parking Zones, Restricted Parking Zones, of the City Code of Ordinances to establish a No Parking zone on Industrial Boulevard as follows: "Industrial Boulevard, west side, for a distance of approximately 1,500 feet, starting at the north property line of 500 Industrial Boulevard and ending at the south property line of 650 Industrial Boulevard." "Industrial Boulevard, east side, for a distance of approximately 1,200 feet, starting at the north property line of 525 Industrial Boulevard and ending at the % south property line of 671 Industrial Boulevard." and take any necessary action. BACKGROUND: Industrial Boulevard is a two lane, 40 -foot wide street located in a light industrial zoned area in western Grapevine. It extends from State Highway 114 Eastbound Service Road to Nolen Drive. Portions of Industrial Boulevard already have posted No Parking zones as shown in Exhibit A. The City was approached by the tenant at 500 Industrial Boulevard requesting that the 500 and 600 blocks of Industrial Boulevard be posted as No Parking zones to improve safety of vehicles turning into and out of the driveways. City Staff conducted a detailed study and, as part of the investigation, spoke with several tenants along Industrial Boulevard. Letters were given out to the tenants and mailed to the property owners requesting their comments regarding parking prohibition. Several of the tenants voiced similar concerns, e.g., that with vehicles parked on both sides of the street, visibility was restricted. Some tenants also indicated that large trucks servicing their facility could not make the turns into and out of Industrial Boulevard due the parked vehicles. A petition signed by several of the tenants in favor of No Parking zones was also provided to the City. January 10, 2002 (8:16AM) The majority of the vehicles currently parking on the street belong to employees of Four Seasons and Dunbar Armored. These two businesses will be the most impacted by the proposed parking restrictions. However, both businesses are agreeable to the parking restrictions. The only tenant opposed to the parking prohibition along Industrial Boulevard is located at 601 Industrial Boulevard, which has approximately 100 feet of frontage. The tenant is opposed to the parking restrictions because their business needs street parking on occasion and they feel that the current on -street parking does not pose much of a problem to traffic. Industrial Boulevard currently carries approximately 2800 vehicles/day. The accident data from August 1999 to December 2001 indicates three accidents that could be attributed to obstructed visibility at the driveways. The data suggests that traffic safety can be improved by removing on -street parking. Staff recommends approving the No Parking zones as they provide for improved traffic safety and access to and from facilities along Industrial Boulevard. In addition, a majority of the property owners are favorable to the No Parking zones. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 23 TRAFFIC, SECTION 23-63 RELATIVE TO NO PARKING ZONES, RESTRICTED PARKING ZONES; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 23, Section 23-63, No Parking Zones, Restricted Parking Zones of the Grapevine Code of Ordinances is hereby amended by the addition of the following no parking zones: "Industrial Boulevard, west side, for a distance of approximately 1,500 feet, starting at the north property line of 500 Industrial Boulevard and ending at the south property line of 650 Industrial Boulevard." "Industrial Boulevard, east side, for a distance of approximately 1,200 feet, starting at the north property line of 525 Industrial Boulevard and ending at the south property line of 671 Industrial Boulevard." Section 2. That the City Manager, or his designee, is hereby authorized to have the proper traffic signs erected, constructed, and placed at such points along said highways, streets or alleys, or portions hereof under construction, maintenance or repair so that travelers will be reasonably notified of said traffic regulations. Section 3. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect; provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas, shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding not guilty or nolo contendere, or dismissal. Section 4. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
