SUBJECT: APPROVAL OF BID 73-2001, ANNUAL CONTRACT FOR
HORTICULTURAL CHEMICALS
RECOMMENDATION:
City Council to Consider renewal of contracts for the lowest and best bids meeting City
specifications to Estes Inc., United Horticultural, Turf Industries, and Justin Seed for all
low bid items meeting specifications as shown on the attached schedule of award and
bid tabulation. Annual Contract expenditures will be limited to the budget amount shown
below.

100-42205-312-3 General Fund/Park Maint./Grounds Maint..................$15,000
210-42205-340-2 Lake Enterprise Fund/Course Maint./Grounds Maint... $30,000
BACKGROUND:
Council first approved this contract on February 6, 2001 as shown on the attached
agenda memo. The contract establishes fixed annual pricing for various types of
horticultural chemicals used by both the Parks and Golf Departments.
The contract documents included an option to renew the contract for three additional
one-year periods. This is the first renewal period for this contract. Estes Inc., United
Horticultural, Turf Industries, and Justin Seed all agreed to renew the contract under the
original terms, conditions and pricing. BWI and Lesco declined to renew due to price
increases and products that have been discontinued. It is recommended that the items
originally awarded to these two vendors be awarded to the next low bids for these
products. A copy of the original agenda memo and bid tabulation is attached for review.
Staff recommends that the bid be awarded to all low bidders for each item as shown in
the original bid tabulation and the items originally awarded to BWI and Lesco be
awarded to the next low bidders for each item.

Items 30, 52, and 100 were tie bids. As required by Local Government Code, Chapter
271, Subchapter Z, Section 271.901 (b) lots were cast to determine the recommended
award. BWI was selected on item 30 and Estes Inc. was selected on items 52 and 100.
It is recommended that item 59 be awarded to BWI who is the lowest bid meeting
specifications. The low bid was from Lesco. This bid was considerably out of the price
range. After reviewing the bid it was determined that Lesco did not bid the packaging
requested and therefore did not meet the requested specifications for this item.
It is recommended that item 95 be awarded to the second low bid of Turf Industries
because the product bid by Estes Inc. has an unacceptable analysis.
It is recommended that item 106 be awarded to Estes Inc. The low bid of Lesco was
considerably out of the bid price range and after checking with the vendor it was
determined that they bid a product that did not meet the required specifications.
It is recommended that item 107 be awarded to Turf Industries. The low bid of Estes Inc
was considerably out of the bid price range and after checking with the vendor it was
determined that they bid a product that did not have the correct ingredients.
It is recommended that all other items go to the low bidder as shown on the bid
tabulation.
Staff recommends approval.
