HomeMy WebLinkAboutItem 08 - Easement Abandonment, Glade Corners AdditionITEM 0 9 mwll�� - MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER MEETING DATE: FEBRUARY 19, 2002 SUBJECT: EASEMENT ABANDONMENT — LOT 1, BLOCK 1, GLADE CORNERS ADDITION RECOMMENDATION: City Council consider adopting an ordinance abandoning a 25 foot wide drainage easement located within Lot 1, Block 1, Glade Corners Addition, and take any necessary action. BACKGROUND INFORMATION: The owner of Lot 1, Block 1, Glade Corners Addition, has requested that the 25 -foot drainage easement be abandoned. The easement was dedicated a number of years ago when the property was undeveloped. The developer of the Glade Corners subdivision has completed construction of drainage improvements associated with the development. The new drainage improvements do not utilize the old easement and there is no longer a need for the existence of this easement. Minter survey, Abstract No 1083, Tarrant County, Texas, being a tract of land conveyed to Ellsworth R Suttee as recorded 'In Volume 3444, Page 196, and also recorded as Lot 1, Block 1, Glade Corners Addition, as recorded in Cabinet A, Slide 6296, Ptat Records, Tarrant County, Texas and being 12.5 feet either side of the following described centerline; COMMENCING at the right of way intersection of the east right-of-way line of Euless Grapevine road (variable R.O.W> and the North right-of-way line of Glade road ( variable R.O.W), said point being the southwest corner of said Lot 1, Block 1, Glade Corners Addition; THENCE North 01 degrees 07 seconds 28 degrees west along the west line of said Lot 1, Block 1, Glade corners Addition a distance of 334.50 feet to the POINT OF BEGINNING: THENCE North 73 degrees 00 minutes 00 seconds a distance of 314 feet, to a point for corner; THENCE North 40 degrees 50 minutes 00 seconds a distance of 302,08 feet to a point in the North tine of said Lot 1, Block 1, Glade Corners Addition and the end of said 25 foot wide drainage easement and containing 0.35 acres of land more or less, ORDINANCE NO. 11, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A TWENTY-FIVE FOOT (25') DRAINAGE EASEMENT IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the property owners of Lot 1, Block 1, Glade Corners Addition, recorded in Cabinet A, Slide 6296, Plat Records of Tarrant County, Texas, the property containing a twenty-five foot (25') drainage easement, more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein for all purposes, has requested the drainage easement, as herein after described be abandoned and vacated; and WHEREAS, the drainage easement is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating the said drainage easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the drainage easement located within the property described in Exhibits "A" & "B", attached hereto and incorporated herein for all purposes, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, interest in and to said drainage easement is concerned. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the drainage easement is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such drainage easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
