Z MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER i0 MEETING DATE: MARCH 5, 2002 SUBJECT: ZONING ORDINANCE AMENDMENT REQUEST TO SECTION 21, "R -MF -1" MULTIFAMILY DISTRICT SUBMITTED BY MR. JERRY STONE OF DUKE INCORPORATED RECOMMENDATION: Staff recommends Council consider a request by Mr. Jerry Stone of Duke Incorporated to amend paragraph C.8 Conditional Uses, of Section 21, "R -MF -1" Multifamily District relative to the locational distance from the Grapevine Mills Mall for apartments with reduced building separation and three story building height, and take any action necessary. BACKGROUND INFORMATION: Mr. Jerry Stone has submitted a zone change request to rezone approximately 61 acres located immediately east of F.M. 2499 (adjacent to the city limit line with the Town of Flower Mound), from "PID" Planned Industrial Development District to "R -MF -1" Multifamily District. Mr. Stone would like to construct approximately 600 units according to the same development criteria that was used on his three-phase apartment project to the south and west of the subject site. The ordinance as it is currently written allows three story building height and reduced building setback as a conditional use for multifamily zoned property within 3/ of a mile north northeast of property zoned and developed as a planned commercial center in excess of 1,000,000 square feet of gross leasable space and located north of Grapevine Mills Boulevard. The subject site exceeds the 3/ mile distance criteria. The applicant requests that this section of the ordinance be modified to expand the distance criteria to the Grapevine/Flower Mound City limit line. Box 95104 Grapevine, Texas 76099 PLANNING RE: The Riverwalk Apartments Dear Mr. Stombaugh: Duke, Inc. is proposing a 600 -unit upscale apartment project on the east side of FM 2499 north of Grapevine Mills Mall. This project will feature a significant amenity and landscaping package including water features, trails, and a park area. Construction will be similar to our recently completed Silver Oaks Apartment project on the west side of FM 2499. We will be requesting the property be rezoned to R -MF -1 to allow this project to be developed. A portion of the text of this zoning category reads: "C. Conditional Uses: 8. The following conditional uses may be permitted, provided they meet the provisions of Section 48, are located within an area that is no greater than 3/4 of a mile due north and northeast of property zoned and developed as a planned commercial center containing in excess of 1,000,000 square feet of gross leasable space and north of Grapevine Mills Boulevard, and a Conditional Use Permit is issued." The project site is within the 3/4 mile limit in the ordinance, but the City Attorney has determined that the entire project must be within the prescribed area. With this in mind, we respectfully request a text change to the ordinance to expand the limit from 3/4 mile to the Grapevine -Flower Mound city limit line.
