HomeMy WebLinkAboutItem 10 - ROW Abandonmen Inwood StreetMEMO TO: =•AT MEETING DATE SUBJECT: RECOMMENDATION: rNmo � /0 __ HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER( ,i. k MAY 7, 2002 RIGHT OF WAY ABANDONMENT — INWOOD STREET City Council consider adopting an ordinance abandoning a 7,000 square foot segment of street right of way located adjacent to Lot 6, Block 3, Manor Oaks Addition (157 Manor Way) and take any necessary action. BACKGROUND INFORMATION: The owner of Lot 6, Block 3, of the Manor Oaks Addition, has requested the abandonment of a 7,000 square foot segment of street right of way within the west portion of Inwood Street, adjacent to Lot 6, Block 3, Manor Oaks Addition, Lots 14 and 15, Block 2, Autumn Hills Addition, and Lots 20 and 21, Block 1, Brookside Addition. The segment of Inwood Street right-of-way proposed for abandonment is a 140' long by 50' wide dead-end segment, which is currently only used by adjacent property owners as a grassed extension to their yards. The City has not used this portion of Inwood Street right-of-way for roadway or utilities purposes since its dedication with the Manor Oaks Addition. The segment proposed for abandonment is not needed by the City for right-of-way purposes. Since the City has no plans to use the segment, Staff recommends approval of the abandonment. P.0 Box 820253 Fort Worth, Texas 76184.0253 F/r✓ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A 7,000 SQUARE FOOT PORTION OF RIGHT-OF-WAY LOCATED AT THE WEST END OF INWOOD STREET IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the property owner of Lot 3, Block 6, Manor Oaks Addition, recorded in Volume 388-40, Page 34, Plat Records, Tarrant County, Texas, the property containing a right of way, more specifically described in Exhibit "A" attached hereto and incorporated herein for all purposes, has requested the right of way, as herein after described be abandoned and vacated; and WHEREAS, the right of way is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating the said right of way will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the right of way located within the property described in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, interest in and to said right of way is concerned. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the right of way is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such right of way creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
