HomeMy WebLinkAboutItem 15 - TxDot Removal From State SystemITEM f Li -,-� MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER f*1 MEETING DATE: JUNE 18, 2002 SUBJECT: TxDOT — REMOVAL FROM STATE SYSTEM RECOMMENDATION: City Council consider adopting a resolution concurring with the State's intention to remove a segment of BU 114 L from the State Highway System and take any necessary action. BACKGROUND: City Council originally adopted Resolution # 2001-55 on November 6, 2001 supporting the State's intended removal of the subject segment of BU 114L from the State System. Subsequent to that date, TxDOT has requested that the exhibits be refined to better define the limits of the subject roadway segment being removed from the State System and that a new resolution be adopted supporting the removal. The roadway segment extends from NW Highway south to Wall Street, bordering the Ruth Wall Street / SH 26 / BU 114 L intersection on the west side and provides street access to the businesses immediately west of the intersection. The segment was constructed by TxDOT as part of the NW Highway project reconfiguration of the intersection to insure that access to the neighboring businesses was protected. The segment does not serve any purpose relative the operation of the intersection or the Highway System extending east, west and south from the intersection. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS CONCURRING IN THE STATE'S INTENTION TO REMOVE A PORTION OF BUSINESS 114L FROM THE STATE SYSTEM AND PROVIDING AN EFFECTIVE DATE WHEREAS, the State of Texas has constructed and maintained a segment of roadway as part of Business 114L as described in Exhibit "A" attached hereto and made a part hereof; and WHEREAS, the State of Texas has determined that said roadway segment is no longer needed for the operation of Business 114L; and WHEREAS, the City of Grapevine has requested that the State remove said roadway segment from the State System; and WHEREAS, the City of Grapevine has committed to assume the maintenance responsibilities of said roadway segment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the State's roadway segment shown on the attached Exhibit "A" is no longer needed for use in the operation of Business 114L. Section 2. That the City Council of the City of Grapevine, Texas concurs in the State's plan to remove the roadway segment from the State System in accordance with the established laws and regulations of the State of Texas. Section 3. That the City Council of the City of Grapevine, Texas commits to assume maintenance responsibilities for the roadway segment. Section 4. Leonard Survey, Abstract No. 946, Tarrant County Texas and being part of the Ruth Wall Subdivision, an addition to the City of Grapevine, Texas, according to the plat recorded in Volume 1878, Page 279 of the Deed Records of Tarrant County, Texas;
