HomeMy WebLinkAboutWS Item 01 - Voluntary Deed RestrictionsMEMO TO FROM: MEETING DATE: SUBJECT: BACKGROUND: w K nm HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER X MAY 15, 2001 WORKSHOP —VOLUNTARY DEED RESTRICTIONS Over the past year, Staff has experienced difficulty in obtaining signed voluntary deed restrictions from applicants after an ordinance has been approved by the City Council. Therefore, official documents in the City Secretary's Office are incomplete until the signed deed restrictions are submitted. We have had instances where documents have been incomplete for almost one year. Staff recommends that when voluntary deed restrictions are submitted with a zoning application, that Council consider the ordinance on two readings. The motion offered would set the second reading of the ordinance to a date certain to include the signed voluntary deed restrictions. At the second reading, if the signed deed restrictions were not submitted, it would be Council's decision to table the second reading to a date certain, or take whatever action they deemed appropriate.
