HARDY, DIRECTOR OF DEVELOPMENT SERVICE DATE: JUNE 19, 2001 SUBJECT: CONDITIONAL USE REQUEST CU01-20, MILLS CORPORATION AND FINAL PLAT OF LOTS 1R2, 2, 3, 4, AND 5, BLOCK 1, GRAPEVINE MILLS ADDITION, PHASE 1 RECOMMENDATION Staff recommends Council accept the applicant's request to withdraw without prejudice, Conditional Use Request CU01-20 and the final plat of Lots 1 R2, 2, 3, 4, and 5, Block 1, Grapevine Mills Addition, Phase 1, and take any other action necessary. BACKGROUND INFORMATION Conditional Use Request CU01-20, submitted by Louise Halprin of Morley Architects on behalf of the Mills Corporation relates specifically to the subdivision and replatting of four areas (Polar Ice, Sun & Ski, Sega Gameworks, and a future anchor tenant site) within the mall proper. Before this could occur, a building code issue relative to the fire - resistance rating of walls adjacent to property lines needed to be resolved. It has still not been resolved. This request was tabled at the May 15th meeting pending the resolution of this building code issue. Council amended Section 67, Amendments, to require a one year waiting period for requests (zone change, conditional and special uses) that have been withdrawn by the applicant prior to and/or after the public hearing. That decision was based on the concern that applicants were abusing the option to "withdraw" a request as a means of gauging public sentiment, the Planning and Zoning Commission's and the City Council's opinions of their request. By withdrawing, the applicant avoided the one-year waiting period for denied requests. The City Attorney has determined that a "withdrawn without prejudice" motion would avoid the one year waiting period, and, in this case, would allow the Mills to appear before Council as soon as the issue is resolved. /rs OAZWCU01-20.42 11 ► • 01► Ct► 8 ,► , •, June 12, 2001/REVISED Mr. Ron. As you know this Conditional Use and Final Plat represented revisions to the lot z�ailfigurations @ Grapevine Mills Mall. Due to Uniform Building Code issues that could nVt be worked out on paper, this item was initially tabled from last month's meeting, .iv hopes that the Code issues could be worked out with the Building inspections Departaiegt this month.
