HomeMy WebLinkAboutItem 11 - Hidden Lake EstatesMEMO TO: FROM: MEETING DATE SUBJECT RECOMMENDATION: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER 9V AUGUST 6, 2001 EASEMENT ABANDONMENT — LOT 6, BLOCK 3, HIDDEN LAKE ESTATES City Council consider adopting an ordinance abandoning a 15 foot wide utility easement located along the western portion of Lot 6, Block 3, Hidden Lake Estates, and take any necessary action. BACKGROUND INFORMATION: The owner of Lot 6, Block 3, Hidden Lake Estates has requested that the 15 -foot utility easement be abandoned for the addition of a swimming pool. A 10 -foot wide utility easement is being dedicated back to the City under separate instrument by the owner. The City does not have utilities in this easement and the franchised utility companies are in agreement with the abandonment and re -dedication. Staff recommends approval. JLH/cst RAAGENDA\08-06-01\HLE ABM.doc ORDINANCE NO. t AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A FIFTEEN FOOT (15') UTILITY EASEMENT IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the property owners of Lot 6, Block 3, Hidden Lake Estates, recorded in Cabinet A, Slide 713, Plat Records of Tarrant County, Texas, the property containing a fifteen foot (15') utility easement, more specifically described in Exhibit "A" attached hereto and incorporated herein for all purposes, has requested the utility easement, as herein after described be abandoned and vacated; and WHEREAS, the utility easement is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating the said utility easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the utility easement located within the property described in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar as all public right, title, interest in and to said utility easement is concerned. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 4. The fact that the utility easement is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such utility easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained. NO. 2 EXHIBIT "A" UTILITY EASEMENT PROPOSED FOR ABANDONMENT A Fifteen (15') foot strip of land located along the westerly side of Lot Six (6), Block Three (3), Hidden Lake Estates, Phase One, an Addition to the City of Grapevine, Tarrant County, Texas as shown on the plat recorded in Cabinet A, Slide 713 of the Plat Records of Tarrant County, Texas, more particularly described as follows: Beginning at the Northwest Corner of said Lot Six (6), thence southeasterly along the common line of said Lot Six (6) and Lot Seven (7) in said Block Three (3) in said Hidden Lake Estates Addition on a platted bearing of South 89 degrees 19 minutes 32 seconds East a distance of Fifteen and Twenty-four hundredths feet (15.24') to a non -tangent concave curve, said curve being parallel with and Fifteen feet (15') easterly of the westerly line of said Lot Six (6), said curve having a radius of Five Hundred Forty-five feet (545'), a chord bearing South 09 degrees 11 minutes 05 seconds East and a chord distance of One Hundred Twenty-five and One tenth feet (125.10'); v y Thence southeasterly along the arc of said curve a distance of One Hundred Twenty-five and Thirty-eight hundredths feet (125.38') to a point on the common line between said Lot Six (6) and Lot Five (5) of said Block Three (3) in said Hidden Lake Estates Addition, said line being non -tangent to the aforementioned curve; Thence southwesterly along said common line between said Lot Six (6) and said Lot Five (5) on a bearing of South 49 degrees 43 minutes 57 seconds West a distance of Sixteen and Forty-four hundredths feet (16.44') to the Southwest Corner of said Lot Six (6) said corner being a point on a non -tangent convex curve, said curve being the westerly line of said Lot Six (6) and having a radius of Five Hundred Sixty feet (560'), a chord bearing North 09 degrees 23 minutes 40 seconds West and a chord distance of One Hundred Thirty-eight and One hundredth feet (138.01'); Thence northwesterly along the arc of said curve a distance of One Hundred Thirty-eight and Thirty-six hundredths feet (138.36') to the point of beginning.
