HomeMy WebLinkAboutItem 15 - DFW Airport BoardMEMO TO: HONORABLE MAYOR AND MEMBERS OF T CITY COUNCIL LA f FROM: ROGER NELSON, CITY MANAGER MEETING DATE: AUGUST 21, 2001 SUBJECT: INTERLOCAL AGREEMENT WITH IRVING, EULESS AND COPPELL ESTABLISHING THE DFW AIRPORT BOARD EX - OFFICIO MEMBERSHIP ROTATION RECOMMENDATION: The City Manager recommends that the City Council approve the attached interlocal agreement with Irving, Euless and Coppell which establishes the rotation for the shared ex -officio position on the DFW Airport Board. BACKGROUND: Senate Bill 569, as adopted, provides an ex -officio member to the DFW Airport Board to be shared by the four host cities. The rotation was determined by a drawing of lots with Irving serving from September 1, 2001 through August 31, 2002. Irving's appointee to the position is Council Member Terry Waldrum. The following term will be served by Grapevine's appointee, followed by Euless and then Coppell. At the end of each four- year period the rotation schedule will be repeated. Grapevine Council Member Darlene Freed was appointed as the Council's liaison to the Airport Board in June, 2001. The agreement requires the representative to communicate with the other three cities on a monthly basis and to that end, Irving Council Member Terry Waldrum has already scheduled the initial meeting of the host cities for the month of August. Irving has already approved the interlocal agreement. Euless and Coppell have both placed it on their agendas and it is expected that all four cities will have approved the agreement prior to the next Airport Board meeting on September 6, 2001. RN August 16, 2001 (10:04AM) M, INTERLOCAL AGREEMENT REGARDING NONCONSTITUENT MUNICIPALITY REPRESENTATION ON THE JOINT BOARD STATE OF TEXAS § COUNTIES OF TARRANT AND DALLAS § This Agreement is made and entered into this the day of , 2001, by and between the City of Coppell, the City of Euless, the City of Grapevine, and the City of Irving, hereinafter collectively referred to as the "Cities". WITNESSETH: WHEREAS, Sentate Bill 569 was approved by the Texas legislature and signed by the Governor on May 26, 2001; and WHEREAS, Sentate Bill 569 provides the Joint Board for Dallas Fort Worth International Airport shall include one (1) non-voting member from the airport's nonconstituent municipalities; and WHEREAS, the Cities are constituent municipalities of the DFW Airport; and WHEREAS, Sentate Bill 569 provides that the Cities' member on the Joint Board shall serve one (1) years terms on a rotating basis among the Cities, subject to the provisions of an agreed on system; and WHEREAS, the Cities wish to memorialize the terms of their agreement regarding the Cities' member on the Joint Board; and WHEREAS, the Cities are authorized by the Interlocal Cooperative Act, Chapter 791 Texas Government Code, to enter into this joint agreement for the performance of governmental functions and services including administrative functions normally associated with the operation of government; and WHEREAS, the Cities agree that each party paying for the performance of governmental functions under this agreement shall do so from current revenues available to the paying party; and WHEREAS, it is deemed in the best interest of the Cities that the Cities do enter into this mutually satisfactory agreement; and WHEREAS, it is agreed by the Cities that this Agreement will be extended for additional one(l) year period(s) of time unless otherwise agreed by all parties. NOW, THEREFORE, the Cities, in consideration of the mutual covenants and conditions contained herein, promise and agree as to each of the other parties and as to all of the parties as follows: Section 1. All matters stated in the preamble are found to be true and correct and are incorporated herein by reference. Section 2. The Cities agree that their member on the Joint Board will be appointed by each respective municipality as follows: Year 1- The City of Irving Year 2- The City of Grapevine, Year 3- The City of Euless, Year 4- The City of Coppell. Thereafter, the member shall be rotated on an annual basis in the above order. The member shall serve in the capacity provided for by Senate Bill 569. Section 3. The appointing municipality may appoint their member in any manner they so choose. Section 4. The city serving as the ex -officio member will communicate with the other three host cities on a monthly basis concerning the items to be considered by the airport board as well as any actions taken by the airport that could affect one or all of the host cities. Likewise, the three cities not serving on the board will communicate to the serving city any concerns or needs that should be brought to light at the meeting by the representative. Section S. If any section, subsection, sentence, clause, phrase or portion of this Agreement is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
