Woods Avenue and is proposed to be platted as Lot 1, Block 1, CVS Addition of Grapevine. The proposed site contains approximately 1.843 acres and has 243 feet of frontage along Ira E. Woods Avenue (S.H. 26) and 216 feet of frontage along Pool Road. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a Conditional Use Permit to establish a retail pharmacy with the retail sale, storage, and off -premise consumption of alcoholic beverages (beer and wine only), drive-through service and one, twenty -foot pole sign. The applicant proposes the development of an 11,957 square foot retail pharmacy that will provide drive-through window service and off -premise alcohol beverage sales. Two drives will serve the site—a shared drive off of Ira E. Woods Avenue and a shared drive off of Pool Road. These shared drives will serve as access to the remainder of the surrounding area when developed in the future. The applicant proposes to erect one, twenty -foot pole sign along Ira E. Woods Avenue and one, monument sign along Pool Road. This site and surrounding property was originally proposed for a shopping center anchored by a grocery store on October 20, 1998 when Council considered a zone change to rezone 0:\ZCU\CU01-55.4 1 October 8, 2001 (10:46AM) M the site to "CC" Community Commercial District. The rezoning request was denied. Subsequently, the subject site and surrounding area was resubmitted as a conditional use request. The applicant proposed the establishment of a planned commercial center along with a grocery store and convenience store both with off -premise alcohol beverage sales and 24-hour operation, leaving the current zoning intact. This request was also denied at Council's August 17, 1999 meeting. At the December 19, 2000 meeting the subject site and surrounding area was once again considered for a rezoning to "CC" Community Commercial District with a conditional use permit to establish a planned commercial center with an Albertson's grocery store. This request was also denied. PRESENT ZONING AND USE: The property is currently zoned "HC" Highway Commercial District and is undeveloped. The subject property was zoned 1-1" Light Industrial District and "C-2" Community Business District prior to the 1984 City Rezoning. A conditional use permit (CU86-07) was granted in 1986 for a convenience store with gasoline sales and off -premise alcohol beverage sales (Seven -Eleven) at the southwest corner of Pool Road and Ira E. Woods Avenue but was never constructed. A zone change request (Z98-23) to rezone the entire site to "CC" Community Commercial District was denied at the October 20, 1998 meeting. A subsequent conditional use request (CU99-20) to develop the site as a planned commercial center with a grocery store with off -premise alcohol beverage sales and convenience store with gasoline sales and off -premise alcohol beverage sales was denied at the August 17, 1999 meeting. The property owners' once again at the December 19, 2000 meeting attempted to rezone the subject site and surrounding area to "CC" Community Commercial District (Z00-16) and establish a planned commercial center (C000-66) with an Albertson's grocery store as the prime retail provider within the center. Both requests were denied. The property is zoned Highway Commercial, HC, which allows a pharmacy. This request is for a Conditional Use Permit for two drive-through windows, the sale of beer and wine for off - premise consumption and one twenty -foot high pylon sign along Highway 26. Who is CVS Pharmacy? CVS;; Pharmacy is entering the metroplex market for the first time and is excited that the Grapevine store will be one of the firsts in the metroplex. CVS Pharmacy was founded in 1963 and is Rhode Island's largest company. CVS is listed on the New York Stock Exchange (CVS). It has become the nation's leading drugstore chain and dispenses more prescriptions than any other pharmacy in America. Nationwide, nearly one prescription in ten is filled at a CVS store. The company has over 97,000 employees and operates more than 4,100 stores in the Northeast, Mid -Atlantic, Southeast and Midwest regions of the country, covering twenty-seven states and the District of Columbia. CVS revenues in 1999 were more than $18 billion. Background: The need for this Conditional Use Permit reflects the characteristics of a modern pharmacy. Drive-through windows, which provide an added convenience for our customers, are very much part of the new pharmacy . In addition, it is very common for a pharmacy to sell beer and wine, just as it is for convenience stores such as the Texaco "C" store across the street, to sell beer and wine. They are located on the back side of the building, adjacent to an outside storage area for railroad ties and other construction materials. The windows will have no adverse impact on the residential area located further to the southeast and will certainly provide an important convenience to our customers. As with the drive-through windows, it is very common for pharmacies to sell beer and wine for off -premise consumption. Over the last generation, pharmacies have evolved from enterprises that just sold drugs and medical merchandise, to full retail operations that serve the busy lives of their customers by selling a wide range of merchandise. Beer and wine sells will offer our customers one-stop shopping and will be compatible with the "C" store across the street. Appropriate signage is necessary for the successful operation of the pharmacy as well as for the safety and convenience of the motoring public. The purpose of the pylon sign is to alert motorist in time for them to safely make appropriate turning movements into the pharmacy. Since traffic moves so fast along Highway 26, a twenty -foot sign is certainly justified. The sign will only have seventy square feet of effective area and will be consistent with the color and materials of the main facility, see attached sign illustration. One detached monument sign will be on Pool Road. We have met with representatives of the homeowners who were very supportive. The following neighbors attended our meeting at the home of Larry and Karen Watkins: Larry and Karen Watkins, Kelly Britain, Brent Gabriel, Steve Early, and Tony McCalla. Although, we do not have their formal support at this time, we anticipate having their support in time for the joint hearing next Tuesday night. After reviewing the facts of our request, we are sure that you will agree that this use makes a lot of sense and is far superior than some other allowable uses that generate significantly more traffic such as a "C" store with gasoline pumps. Woods Avenue) and Pool Road This firm represents Gustine Properties, Inc. in their efforts to construct a new CVS Pharmacy on a 2.1 acre lot located at the southwest corner of the intersection of State Highway 26 (Ira E. Woods Avenue) and Pool Road (the "Property"). In order to construct this pharmacy we are requesting that three (3) Conditional Use Permits be granted. The three (3) permits are required to: 1) allow two (2) drive-through windows for the pharmacy; 2) allow for beer and wine sales for off -premise consumption; and 3) allow for a 20 -foot tall pylon sign on Highway 26 and a 20 -foot tall pylon sign on Pool Road. We are confident that all three of these requests are reasonable and will not cause harm to the value, use or enjoyment of other property in the neighborhood. The Property is currently zoned Highway Commercial (HC) and given its location on Highway 26 at an intersection of a major thoroughfare, sound land planning principles dictate that a commercial or retail land use, such as a pharmacy, is an appropriate use for the Property. A pharmacy is a permitted use in the HC zoning district, but the -need for the Conditional Use Permits is triggered by the characteristics of how pharmacies operate today. All of the major pharmacy chains design their stores with drive-through windows. These windows are a convenience that our customers use and demand. Given the nature of why people come to pharmacies, it is often necessary for our customers to stay in their vehicles to pick up their prescriptions. Great care has been taken to make sure the drive-through windows are positioned properly on the lot. The proposed drive-through windows are located on the west side of the building to ensure that they do not cause traffic circulation conflicts and the operation of the windows do not trigger any negative consequences for the surrounding neighborhood. As with the drive-though windows, it is very common for pharmacies to sell beer and wine for off-premise consumption. Over the last generation, pharmacies have evolved from enterprises that just sold drugs and merchandise that centered on the medical needs of a population to retail operations that serve the busy lives of their customers by providing all manner of convenience goods from common grocery items, school supplies, film processing and beverage sales. Pharmacies have become a destination retail operations where people stop on their way home from work and pick up the items they need, but would rather not go to a grocery store or department store to purchase. Beer and wine sales would offer the nearby residents true one stop shopping which would reduce the need for additional vehicle trips on the adjacent roadways. Given the nature and scale of the alcohol sales, the approval of this conditional use permit would not result in substantial harm to the value, use or enjoyment of other property in the neighborhood. Appropriate signage is necessary for the operation of the pharmacy as well as for the safety and convenience of the motoring public. The purpose of pylon signs is to allow people identify the location of a building before they actually reach the driveway serving the building. Pylon signs help motorists plan their turning movements. Allowing a pylon sign on Highway 26 and on Pool Road will help identify the driveways and will facilitate the movement of vehicles from the travel lanes of Highway 26 and Pool Road into the access drives of the pharmacy. The proposed pylon signs have been designed specifically for this location and the City of Grapevine's sensitivities toward pylon signs were taken into consideration in the design of the proposed sign. The proposed sign has an overall height of 20 feet and a width of just less than ten feet. The overall effective area of the sign face is 70 square feet. Rather than using a single pole, this sign has been designed with two (2) supports which result in a more architecturally pleasing design. The sign materials reflect the color and design of the main pharmacy building. Given the size, massing, locations and intent of the proposed signs, this request is reasonable and the granting of this request will not cause substantial harm to the value, use or enjoyment of other property in the neighborhood. In conclusion, the three conditional use requests that comprise this application are reasonable and necessary forthe successful operation of a CVS Pharmacy at this location. Drive-through windows, beer and wine sales and pylon signs are all common elements in the design of stand alone pharmacies throughout the Metroplex and the rest of the country. The granting the requested conditional use permits will not cause substantial harm to the use and enjoyment of surrounding properties. and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally ORD. NO. 2 particular piece of property is needed, is called for, an is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Conditional Use Permit No. CU01-55 to allow for the development of a retail pharmacy (CVS Pharmacy) with the possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer and wine only), drive-through service, and one 20 foot pole sign in a district zoned "HC" Highway Commercial District within the following described property: Lot 1, Block 1, CVS Addition of Grapevine (3701 Ira E. Woods Avenue) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. The City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. ORD. NO. 3 Section 5. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained. A portion of the site is currently being used as a cross tie storage facility. The remainder of the site is currently undeveloped. 11. STREET SYSTEM: 1. This site has restricted driveway access to State Highway 26 via an access drive with limited right turn movements into and out of the development. This site also has an access drive along Pool Road. 2. The developer will construct the following: a new left turn bay for northbound traffic on Pool Road entering the single drive along Pool Road. • a free right turn lane for southbound traffic on Pool Road entering the single drive along Pool Road. 3. There is approximately 0.057 acres of right-of-way along Pool Road being dedicated with this plat. 4. The developer has proposed to dedicate right-of-way along State Highway 26 for the future widening of State Highway 26. STORM DRAINAGE SYSTEM: 1. This existing grading directs the surface runoff flow in a southwesterly direction to Big Bear Creek. 2. The development of this site will require an extensive amount of fill. A portion of Lot 1 lies within the limits of an existing FEMA 100 year floodplain Is boundary and removal of this designation from Lot 1 will require a LOMR from FEMA. Lot 2 falls within both FEMA floodplain and floodway limits. A Conditional Letter of Map Revision (CLOMR) for Lot 2 will be required prior to any fill activities taking place. Upon completion of the fill activities, FEMA must approve a Letter of Map Revision (LOMR) in order for future development on Lot 2 to occur. 3. An amended plat must be submitted by the applicant upon receipt of the LOMR to relocate the existing 100 -year floodplain to match the improved conditions. 4. The developer will be required to design for on site and off site drainage in accordance with the City of Grapevine Code of Ordinances. IV. WATER SYSTEM: 1. There is an existing 8 -inch waterline with a stubout for this property provided within the Pool Road right-of-way. In addition, there is an existing 8 -inch waterline located along a portion of the State Highway 26 frontage. 2. The existing and proposed water distribution system is adequate to serve the development of this site. V. SANITARY SEWER SYSTEM: 1. There is an existing 8 -inch sanitary sewer line within the State Highway 26 right-of-way. 2. The existing and proposed sanitary sewer collection system is adequate to serve the development of this site. VI. MISCELLANEOUS: 1. Water and Wastewater Impact Fees are due prior to the release of Building Permits. The present fee for commercial development is $5,402.00 per acre. VII. STATEMENT OF FINDINGS: A. The City has determined that the dedications required for streets, utilities, drainage and other municipal needs and services are consistent with the City's ordinances and master plan, are reasonable and are connected to the proposed project in the following manner: 1. The on-site utility easements are necessary to provide for public and franchised utility service to this site and surrounding developments. 2. The on-site access easements are necessary to allow for public access to this site. 3. The on-site drainage easements are necessary to allow for storm drainage through this site. 4. The right-of-way dedicated by this plat is necessary to provide for the development of the surrounding transportation system. B. The City further finds that the required dedication is related both in nature and extent to the impact of the proposed development as follows: 1. The on-site utility, access and drainage easements are consistent with the City's policies for easement dedications where there are existing utilities, where future utilities would be located, along internal driveways, and along necessary drainage patterns. 2. All of the dedications benefit the development to at least the extent of the impact of such on the development. 3.
