HomeMy WebLinkAboutItem 16 - Emergency Sanitary Sewer Line and Storm Drain Line Relocation11TM 0 .�/ � MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER#!/ MEETING DATE: -OCTOBER 16, 2001 SUBJECT: EMERGENCY SANITARY SEWER LINE AND STORM DRAIN LINE RELOCATION CONTRACT RECOMMENDATION: City Council consider adopting a resolution declaring an emergency and awarding a construction contract to Wright Construction Company in the amount of $15,000.00 for the relocation of a 6" sanitary sewer line and an 18" storm drain crossing Lot 14, Block 8, Second Section of Placid Peninsula Addition that are currently outside of the dedicated easement and in conflict with the building pad of a new home, authorize staff to execute said contract, and take any necessary action. The City Of Grapevine installed sanitary sewer mains for this area in 1973. Storm drainage was constructed after the installation of the sanitary sewer. The sanitary October 10, 2001 1 :40PM segment of line was designed to follow the contours of the land and crossed four lots in Block 8 between Mercury Drive and Peninsula Drive. Recently, a builder set slab forms to begin construction of a house on Lot 14 of Block 8. While preparing to make a sewer tap for the lot, the City crew noticed that the forms crossed over the sanitary sewer main and subsequently informed the Development Services Department about the situation. Public Works Staff has determined that a majority of the sanitary sewer and storm drain line located in Lot 14 were installed outside the easement dedicated by the owners in 1973. Due to the fact that the sewer and storm drain lines were not discovered until the builder was on site and beginning construction, the normal bidding process for construction of this type will result in a delay for the builder. The City Attorney has reviewed the situation and agrees that this case qualifies as an emergency and that the City should contract for this relocation as quickly as possible. Due to the depth of the sanitary sewer main, city personnel are unable to perform the relocation work. Staff has negotiated a contract with Wright Construction Company to perform the work with reasonable unit costs considering the emergency nature of the work. Staff recommends approval. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, DECLARING AN EMERGENCY TO COMPLETE THE NECESSARY CONSTRUCTION WORK TO RELOCATE AN EXISTING 6" SANITARY SEWER AND 18" STORM DRAIN LINE IN CONFLICT WITH HOME BUILDER FOUNDATION IN PROGRESS IN THE SECOND SECTION OF PLACID PENINSULA ADDITION; AUTHORIZING EXPENDITURES FOR THE COMPLETION OF SAID WORK; AWARDING A CONTRACT AND PROVIDING AN EFFECTIVE DATE WHEREAS, a home builder has begun construction of a house on Lot 14, Block 8 of the Second Section of Placid Peninsula Addition; and WHEREAS, the City has an existing 6" sanitary sewer line and an existing 18" storm drain line located outside the existing 10' utility easement that conflicts with the proposed house plans; and WHEREAS, delays by the City in relocating these lines result in delays to the ° homebuilder, and WHEREAS, services and material purchases related to the completion of the work must be accomplished expeditiously in order to complete the work in as timely a manner as possible, and if not accomplished expeditiously will result in a greater expense to the homebuilder and potentially the City; and WHEREAS, the City Council finds and concludes that an emergency exists that requires the immediate appropriation of funds to preserve the property of the City, to protect the public health and safety of the City's residents and to preserve the safety of the City and its citizens; and WHEREAS, this emergency obligates the City to complete the work in the most efficient, economical manner; and WHEREAS, the City Council finds and concludes that the citizens are best served by the City completing the work without the necessity of accepting additional competitive bids pursuant to Chapter 252, Texas Local Government Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, THAT: Section 1. That all matters in the preamble are found to be true and correct and are incorporated into the body of this resolution. Section 2. That the City Manager, or his designee, is authorized to expend up to a total amount not to exceed $15,000.00 to relocate the 6" sanitary sewer and 18" storm drain lines in conflict with the house project. Section 3. That the City Manager, or his designee, is authorized to enter into an agreement for the relocation of the 6" sanitary sewer and 18" storm drain lines with Wright Construction Company in an amount not to exceed $15,000.00. Section 4. This resolution shall take effect from and after its date of passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 16th day of October, 2001.
