HomeMy WebLinkAboutItem 15 - NE Transportation ServiceMEMO TO: FROM: MEETING DATE: SUBJECT: RECOMMENDATION: CG ITEM . !S HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER��Ci N ` AUGUST 20, 2002 YMCA CONTRACT FOR NORTHEAST TRANSPORTATION SERVICE (NETS) City Council to consider a resolution approving a contract with the YMCA of Metropolitan Fort Worth to provide transportation services on behalf of the Northeast Transportation Service (NETS) member cities and authorizing City Manager to take any necessary action relative to same, including the execution of any additional documents necessary for the NETS program. FUNDING SOURCE: This contract will be funded by through a Federal Transit Administration Grant, state and local funds. The program expenses are approximately distributed as follows: 50% Federal Grant 25% State Grant 25% Local City and YMCA contributions. The City portion is budgeted on a per capita basis and the City of Grapevine's portion will continue to be approximately $19,000 and is budgeted in account 100-4686-120-1. BACKGROUND: On November 6, 2001 a City Council resolution authorized the City Manager to apply for federal grantee status on behalf of the Northeast Transportation Service (NETS) member cities. NETS is a transportation service for senior citizens and persons with disabilities that live in the member cities, Grapevine, Hurst, Euless, Bedford, Colleyville, North Richland Hills, Haltom City, and Keller. Richland Hills also contracts for NETS through its transportation provider, the Fort Worth Transportation Authority. The Federal Transit Administration required an open procurement process as part of the grant application. Per state law, a public notice was placed in the Fort Worth Star - Telegram on June 12 and 19, 2002. One vendor, The YMCA of Metropolitan Fort Worth, submitted a proposal. The YMCA has provided service for the NETS program since its inception in 1991. August 15, 2002 (7:34AM) Worth, submitted a proposal. Staff from the NETS member cities have been meeting on a regular basis over the last several months to determine what can be done to help the YMCA improve the service level of the NETS program. One area of concern is the aging fleet of the program. Many of the vans used are over 10 years old and have exceeded their useful life. One new van has been acquired recently and another van is on the way. The member cities will work with the North Central Texas Council of Governments and the Federal Transit Administration to try and procure capital grants for more vans and computer equipment. The contract is for a two year term. The first year will reimburse the YMCA for operating expenses incurred in FY 2002 . The second year will cover operations for FY 2003. The contract is renewable for five one year terms upon the mutual consent of all parties. Staff recommends approval. Upon execution of this Cooperative Agreement by the Party named below, the Party affirms this award, and enters into this Cooperative Agreement with the City. The Project is defined as the scope of services included in the City of Grapevine Application Package: Transportation Services, along with Provider's Proposal to Application #0402-2002. The following documents are incorporated herein by reference and made part of this Cooperative Agreement: (1) "Federal Transit Administration Master Agreement," FTA MA(8), October 1, 2001, [http://www.fta.dot.gov/library/legal/agreements/2002/ma.html]; and (2) Any notification containing special conditions or requirements, if issued; and (3) City of Grapevine Application Package: Transportation Services; and (4) Provider's Proposal to Application #0402-2002. By entering into this Cooperative Agreement, Provider agrees to provide transportation service to elderly and disabled persons in Northeast Tarrant County, Texas, in accordance with the following specific terms and requirements: 1. Provider shall provide the services required herein for an amount from City not to exceed $260,000.00 per year. The obligations of the CITY in this Agreement are subject to the receipt of sufficient funding from the U.S. Federal Transit Administration. If such funding is not provided by the U.S. Federal Transit Administration, both parties to this Agreement are relieved of any further obligation to the other. All payments to be made by City under this Agreement are subject to the requirements contained in the Federal Transit Administration Master Agreement, referenced hereinabove. 2. Provider shall obtain matching funds in an amount equal to $272,000.00 per year. The total cost and funding of Provider's services under this Agreement shall be $532,000.00 per year. Any payment to be made to Provider under Section 1. herein is subject to City's receipt of proof of Provider's compliance with this matching requirement. 3. Provider shall provide services in accordance with the Application Package from the City of Grapevine entitled City of Grapevine Application Package: Transportation Services (the "Application"). Provider further agrees to be bound by and comply with the commitments made in Provider's Proposal to Application #0402-2002. Lastly, Provider shall provide its services under this Agreement in accordance with the Federal Transit Administration Master Agreement referenced hereinabove. 4. The indemnification provided for in Section 1.12 of the Application shall apply to all conduct and activities of Provider pursuant to this Agreement. 5. Provider shall comply with all provisions of any document incorporated herein by reference above, and execute any such document if required therein. 6. The term of this agreement shall be from October 1, 2001, through October 1, 2003. This Agreement is renewable for up to five (5) additional one (1) year periods upon the mutual agreement of the parties. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS APPROVING A CONTRACT WITH THE YMCA OF METROPOLITAN FORT WORTH TO PROVIDE TRANSPORTATION SERVICES ON BEHALF OF THE NORTHEAST TRANSPORTATION SERVICE, AUTHORIZING THE CITY MANAGER TO EXECUTE SAME AND RELATED DOCUMENTS AND DECLARING AN EFFECTIVE DATE WHEREAS, the City of Grapevine (the "City") is a member City in the Northeast Transportation Services group ("NETS") which provides transportation services to the elderly and disabled; and WHEREAS, the City Council has agreed by resolution to allow the City to serve as the grantee of federal funds from the Federal Transit Administration for the NETS program; and WHEREAS, the City has sought and received proposals for the provision of the NETS services, in accordance with all applicable State, local, and federal law; and WHEREAS, the most favorable response to the application was submitted by the YMCA of Metropolitan Fort Worth; and WHEREAS, the City wishes to execute an agreement with the YMCA of Metropolitan Fort Worth, subject to the receipt of federal funding; and, WHEREAS, the City may be required to execute additional, ancillary documents as part of the NETS program which will not incur any additional, unbudgeted costs to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, THAT: Section 1. That all matters in the preamble are found to be true and correct and are incorporated into the body of this resolution as if copied in their entirety. Section 2. That the City Manager is authorized to execute a contract with the YMCA of Metropolitan Fort Worth to provide transportation services on behalf of the Northeast Transportation Service (NETS) member cities. Section 3. That the City Manager, or his designee, is authorized to execute additional documents necessary for the implementation of the services to be provided by the YMCA of Metropolitan Fort Worth, provided that such documents do not subject the City to any additional, unbudgeted costs.
