The addition Hall -Johnson u's m p I T--- o contains approximately 28.304 acres and has 1402 Glade Rd. `m _� feet of frontage along State Highway 121 North. r c 0 REQUESTED SPECIAL USE AND COMMENTS: The applicant is requesting a Special Use Permit to amend the approved site plan of SU02- 02 (Ord. 02-39) for a church that exceeds the 50 -foot height requirement specifically to extend the four year time limit on the existing modular preschool building for another six years per letter and agreements dated December 11. 2002 between Fellowship Church and the City of Grapevine. Special Use Request SU98-01 (Ord. 98-28) was considered and approved by Council at their February 17, 1998 meeting which modified a previously approved site plan for the Fellowship Church to allow the addition of a 26,000 square foot modular structure to be utilized as the church's preschool building. This request was approved at that time with the stipulation that the modular structure would be removed within four years of the issuance of a certificate of occupancy for the structure. January 8, 2003 will be the end of the four 0:\ZCU\SU02-05.41 1 December 12, 2002 (11:49AM) year time limit for the modular structure. This request was originally heard at the November 19, 2002 meeting. The applicant at that time was requesting to eliminate the four year timeline on the existing preschool buildings and allow the addition of another 11,000 square feet of modular classroom space. The request was tabled in order to give the applicant time to respond to the Councils' comments relative to the need for this change in status of the existing modular buildings, and the need for the additional 11,000 square feet of modular structures. Since that time, Staff and representatives of the Fellowship Church have met to discuss in depth the church's current situation and its future needs relative to it's plans for expansion and the need for the existing preschool buildings. Due to the churches phenomenal growth rate the church is modifying its original request and is now asking for an extension of six years for the existing modular preschool buildings and is eliminating the request for an additional 11,000 square feet of modular classroom space. See the attached letter. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District and is developed as a church. The subject property and surrounding areas were rezoned in the 1984 City Rezoning from "I-1" Light Industrial District to "PID" Planned Industrial District. Conditional Use Permit CU93-07 was approved on July 20, 1993 for a church in a Planned Industrial District under the standard development option with deed restrictions. Construction on the project did not occur within the allotted time frame and the conditional use permit expired. The site was rezoned (Z96-13) in June 1996 to "CC" Community Commercial District as directed by Council. The GE Computer Services property to the south was rezoned from 1-1 Light Industrial District to "LI" Light Industrial District in the 1984 City Rezoning. Council approved special use request SU96-14 (Ordinance 96-103) at the December 17, 1996 joint public hearing allowing the Fellowship of Las Colinas to develop a church with a height of 60.5 feet, exceeding the 50 foot maximum height allowed in the "CC" Community Gommercial District. The site was later revised (SU97-08; Ordinance 97-109) to include an 87,300 square foot Phase 2, Children's Education Center and to increase the number of fixed auditorium seating by 1,255 seats for a total of 4,092 seats. At the February 17, 1998 meeting, Council approved (SU98-01) a revision to the site plan allowing for an approximate 26,500 square foot temporary building to be utilized as the church's preschool structure. This addition of a temporary building to the site plan was approved with the stipulation that it would be removed within four years of the issuance of a certificate of occupancy for the structure. Special Use Permit S000-01 was approved by Council at their January 16, 2001 meeting and allowed for a revision to the previously approved creative communications building and the addition of an atrium/food court. The Site Plan Review Committee, at their June 20, 2001 meeting approved a slight amendment to the site plan associated with the Fellowship Church specifically reducing the size of the Creative Communications building from 155,972 square feet to 144,100 square feet. Council approved at the May 21, 2002 meeting a revision of the site plan for the Fellowship Church (SU02-02) specifically allowing a modification to the west exterior elevation, the landscaping in the bookstore courtyard area and allowing the addition of six flagpoles near the main entrance to the site. The Grapevine Mills property was rezoned from "HCO" Hotel Corporate Office to "CC" Community Commercial (Z95-13) and received an initial conditional use permit (CU95-36) for a planned commercial center in excess of 1,000,000 square feet of gross leasable area. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "CC" Community Commercial District - vacant SOUTH: "Ll" Light Industrial District, "BP" Business Park, "CC" Community Commercial District, "GU" Governmental Use District - GE Computer Services and DFW International Airport EAST: City of Coppell - vacant WEST: "CC" Community Commercial District, "PID" Planned Industrial District, "HCO" Hotel Corporate Office - Grapevine Mills Mall The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B, the following uses may be considered only if sound treatment is included in building design: multi family apartments, motels, office buildings, movie theaters, restaurants, personal and business services. Single Family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone with proper sound attenuation. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a commercial land use. The proposed development is in compliance with the Master Plan. 0AZCU\SU02-05.41 3 December 12, 2002 (11:49AM) nr THOROUGHFARE PLAN APPLICATION: The Thoroughfare Plan designates Bass Pro Drive a Type E Collector, which requires a minimum right-of-way of 75 feet to be developed as four lanes. State Highway 121 is a Type A Major Arterial requiring a minimum 100 feet of right-of-way developed as six lanes with a median. /rs OAZWSU02-05.41 4 December 12, 2002 (11:49AM) December 11, 2002 Roger Nelson City Manager City of Grapevine Re: SU02-02 (ORD. 02-39) Dear Roger: In February of 1998, Fellowship Church appeared before the City Council of Grapevine, TX and requested a "Move -In" building permit for its Modular Pre -School buildings, as well as an amendment to the existing SU96-14 (Ordinance 96103) for the approved site pian. SU98-01 set a time frame of 4 years from the Certificate of Occupancy for the Modular Buildings (January 1999). This time frame was levied by the City Council because it was the general feeling that in four (4) years Fellowship Church would be prepared to build additional pre-school space. In the last four (4) years Fellowship Church's attendance has grown from 5,000 in attendance each weekend to 15,000 each weekend, a growth rate of 350%. During this time period Fellowship Church has added new facilities, as originally represented to the City Council, through acquisition and new construction of 120,000 sq. ft, of which approximately 80,000 sq. ft. are dedicated to children. Fellowship Church currently offers five (5) identical services each weekend. The additional buildings and the number of services offered each weekend are in place to accommodate the large number of people attending each weekend, as such, the Pre -School Modular buildings are still needed. Fellowship Church requests an extension of six (6) years on the existing 26,000 sq. ft. Modular Pre -School buildings. Fellowship Church will need two (2) years to monitor growth, program, consider issues and determine a course of action. The following two (2) years will be utilized in raising capital and finalizing the Design and Construction plans, seeking a Permit and addressing any outstanding items related to the construction. Finally, during the last two years, Fellowship Church will build the new building(s). Master planning for the future is already underway. Fellowship Church is currently considering two options for growth. Option one is design and Construction of an entirely new, larger Worship Center in the locations of the current Modular Pre - School buildings. Option Two is the expansion of the existing Worship Center to the South. Both options require the completion of the second phase of the CCC Building. Fellowship Church request that the term "Temporary" be removed and "Modular" be replaced from any and all language with respect to the existing 26,000 sq. ft. Pre - School Buildings. ►. 0Grapevine,.000 . • Fellowship Church realizes that a 6 year extension will allow for the fund raising and planning processes set for above, and that the Church is not prohibited from seeking further consideration or utilization of the Modular Pre -School buildings by submitting another application, should same be necessary, during the additional six year term. Fellowship Church will provide the application and present a proposal in such a manner that is consistent with the standards of excellence of both The City of Grapevine and Fellowship Church. In lieu of requesting the addition of 11,000 more square feet of Modular Buildings, Fellowship Church, as will be indicated in the site plan, simply expects the need to move a portion of the current Modular Pre -School buildings as growth, expansion and future construction continue. Fellowship Church desires to and commits to meeting bi-annually with the City Manager and the Staff of the City of Grapevine to both inform the City of Fellowship's progress towards meeting the commitment of the six (6) year extension and to hear from the City its plans in regard to improvements of infrastructure and new developments that add to the quality of life in the City of Grapevine. adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City finds that a compelling governmental interest exists necessitating the special regulation of modular buildings and that the least restrictive means of regulating the use of modular buildings is to restrict their use to a fixed and limited period of time; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and ORD. NO. 2 determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, an is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City does hereby issue a special use permit in accordance with Section 49 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code, by granting Special Use Permit No. SU02-05 to amend the site plan approved by Ordinance No. 2002-39 to permit the existing modular preschool buildings to remain in place for an additional period of six years from and after the issuance of the Certificate of Occupancy for such buildings on January 8, 1999, through January 8, 2009, in a district zoned "CC" Community Commercial District Regulations within the following described property: Lot 1 R, Block 1, Fellowship of Las Colinas (2450 State Highway 121 North) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: This ordinance is passed with the understanding that all fairness and reasonableness will be used by both Fellowship Church and the City at all levels prior to or after the expiration of this six (6) year extension to consider the relocation and/or use of the modular buildings in a way that is beneficial to the Fellowship Church in a manner that is consistent with the standards of excellence of the City and Fellowship Church. Section 3. The City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 4. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 5. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent ORD. NO. 3 ONE& overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 6. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 7. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 8. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 9. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
