BACKGROUND INFORMATION: A zone change application for a 14,000 square foot lot addressed at 210 North Starnes Street was considered at the July 15, 2008 meeting and tabled pending further review at a workshop with the Planning and Zoning Commission to consider zoning and land uses along this portion of North Starnes Street. The applicant was requesting to rezone the subject lot from its current zoning of "R-5.0" Zero Lot Line District to "HC" Highway Commercial District with the intent to replat the property and combine it with the lot immediately adjacent to the south for the development of a 5,800 square foot office building. Discussion during the public hearing centered on the appropriateness of the zoning requested i.e. "HC" Highway Commercial District zoning versus "PO" Professional Office District zoning and the impact to the area if an encroachment of non- residential zoning were to be approved. The Planning and Zoning Commission on August 14, 2008 in a worksession reviewed the actual land uses along North Starnes Street which revealed that the street is a combination of residential and non-residential uses with a distinct demarcation approximately 300-feet north of East Northwest Highway separating the two. The subject lot that was considered for rezoning at 210 North Starnes Street is part of an 11- lot group on both sides of Starnes Street that is primarily developed as single family detached residences. Further to the north on the west side of Starnes Street is a four building complex for the Grapevine Housing Authority. On the east side, opposite the Grapevine Housing Authority property is the Love Chapel, a church which is currently vacant and under review for consideration of a Historic Landmark Subdistrict Overlay. To the west of this 11 lot study area there is non-residential development, primarily retail in orientation that has frontage along North Main Street. To the east the property is also non-residential, comprised of office, warehouse and auto repair uses that has frontage along Central Avenue. In essence the 11 lot study area, currently zoned "R-5.0" Zero R:WGENDA\09-16-081MP08-02.4.docMP08-02.4 � 9/10/2008 2:50:19 PM Lot Line District is a pocket of residential uses surrounded on three sides to the south, east, and west by non-residential uses comprised of "HC" Highway Commercial District and "CN" Neighborhood Commercial District zoning. Prior to the 1984 City Rezoning, the subject and surrounding area was a mixture of residential ("R-1" Single Family District and "R-2" Two-Family District) and non- residential uses ("C-1" Neighborhood Business District and "C-2" Community Business District) in the same basic configuration that is today. The 11-lot study area and the property further to the north, known as the "Hill", was rezoned during the 1984 City Rezoning to "R-MF-1" Multifamily District. In 2001, initiated by the City of Grapevine, this same twelve acre area was rezoned to "R-5.0" Zero Lot Line District. At the worksession the Commission, recognizing there is no real buffer between the commercial uses and residential uses, agreed that the best course of action along North Starnes Street was to amend the future land use map for six lots, three on each side of the street, from Residential, Medium Density and Commercial to Low Intensity Commercial and allow applicant's on a case-by-case basis to apply for a zone change to either "PO" Professional Office District or "CN" Neighborhood Commercial District which are the appropriate zoning districts compatible with this land use designation and more suitable for a transition area from higher intensity commercial uses to residential uses. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Ordinance No. 87-11, as amended, passed by the City Council on February 17, 1987, which adopted the Comprehensive Master Plan 1974- 1994 Update 1987 of the City of Grapevine, Texas is hereby amended by the adoption of an amendment to Map 2 Land Use Plan attached hereto and made a part hereof as Exhibit "A." Section 3. That the Comprehensive Master Plan 1974-1994 Update 1987, Map 2 Land Use Plan, a true and correct copy of which is on file with the City Secretary ORD. That if any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person of circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
