HomeMy WebLinkAboutItem 01 - Canvass Results of the November 8, 2016 Special ElectionMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER 1,J� MEETING DATE: NOVEMBER 22, 2016 SUBJECT: CANVASS NOVEMBER 8, 2016 SPECIAL ELECTION RECOMMENDATION: Consider a resolution canvassing the Special Election held on November 8, 2016 to consider the legal sale of all alcoholic beverages for off -premise consumption only, certify the results and take any necessary action. BACKGROUND: A Special Election was held on November 8, 2016 to consider the legal sale of all alcoholic beverages for off -premise consumption only. As of October 12, 2016, the City of Grapevine had 31,922 registered voters. 22,293 ballots were cast on November 8, which equated to 69.84% of the registered voters in the City. The unofficial results are as follows.- Absentee ollows: Absentee Early Voting Election Day Total % For 352 7,441 1,985 9,778 45.89% Against 297 9,331 1,902 11,530 54.14% Total 649 16,772 3,887 21,308 There were 984 Under Votes (Grapevine residents who received a ballot but did not vote on Proposition 1 or had an error on their ballot) and one Over Vote (voter marked both options). The Early Voting Ballot Board finalized the results ahead of schedule, so the numbers above reflect the final returns. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, DECLARING THE RESULTS OF THE NOVEMBER 8, 2016 CITYWIDE SPECIAL ELECTION RELATED TO THE LEGALIZATION OF THE LEGAL SALE OF ALL ALCOHOLIC BEVERAGES FOR OFF -PREMISE CONSUMPTION ONLY WHEREAS, on July 5, 2016 the City Council of the City of Grapevine, Texas duly authorized a citywide special election to be held within the City on November 8, 2016, for the purpose of submitting to the resident qualified voters a local option election proposition to consider legalizing the legal sale of all alcoholic beverages for off -premise consumption only; and WHEREAS, on September 6, 2016 the City Council of the City of Grapevine, Texas approved an agreement with the Tarrant County Elections Administrator to conduct said election; and WHEREAS, the Charter of the City of Grapevine, Texas provides that the Election Code of the State of Texas is applicable to conducting City elections, and in order to comply with said code, an order declaring the results of said election is required; and WHEREAS, the citywide local option Special Election was duly and legally held on November 8, 2016 in the City in conformity with the election laws of the State of Texas, including, but not limited to, Texas Election Code, Title 17; and WHEREAS, the results of the Special Election, including the early voting results, have been certified and returned by the Tarrant County Elections Administrator; and WHEREAS, the City Council has considered the returns of said citywide local option Special Election to consider legalizing the legal sale of all alcoholic beverages for off -premise consumption only, and it appearing from said returns, duly and legally made, that there were cast at said election 22,293 valid and legal votes resulting in the following: The legal sale of all alcoholic beverages for off -premise consumption only. Absentee Early Voting Election Day Total Number of Votes Received For 352 7,441 1,985 9,778 Against 297 9,331 1,902 11,530 Total 649 16,772 3,887 21,308 Over Votes 0 0 1 1 Under Votes 77 669 238 984 WHEREAS, all legal prerequisites for the adoption of this resolution have been met, including but not limited to the Local Government Code, the Election Code, and the Open Meetings Act; and WHEREAS, the City Council hereby declares that the approval of this resolution is in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the above preamble are true and correct and are incorporated herein as if copied in their entirety. Section 2. That said election was duly called; that notice of said election was given in accordance with law; and that said election was held in accordance with law. Section 3. In accordance with the canvass and tabulation of the results of the citywide local option Special Election, the legal sale of all alcoholic beverages for off - premise consumption only was not approved by a majority of qualified voters by a vote of 9,778 in favor to 11,530 opposed. Section 4. It is found and determined that the results of the citywide local option Special Election as canvassed and tabulated reflect the expressed desires of the electors. Based on the results of the citywide Special Election, and pursuant to State Law, the proposed measure failed. Section 5. That this resolution shall become effective from and after the date of its passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 22nd day of November, 2016.
