HomeMy WebLinkAboutItem 05 - Tarrant County Public Health Department ���i�] � MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER �� MEETING DATE: FEBRUARY 5, 2008 SUBJECT: INTERLOCAL AGREEMENT BETWEEN CITY OF GRAPEVINE AND TARRANT COUNTY PUBLIC HEALTH DEPARTMENT RECOMMENDATION: Staff recommends that City Council enter into an interlocal agreement with the Tarrant County Public Health Department to utilize the Community Activities Center as a point of distribution site in the event of a catastrophic chemical or biological attack on the citizens of Tarrant County. BACKGROUND: Under a grant from the Texas Department of State Health Services, Tarrant County Public Health Department is required to plan and prepare for a public health emergency which may result from natural or man-made causes. During such emergency, it may be necessary to immunize or treat massive numbers of people. The Tarrant County Public Health Department has determined that they do not possess facilities adequate to treat the volume of citizens within the county and therefore, are seeking to enter into interlocal agreements with municipalities and school districts within the county that possess adequate facility space. It has been determined that the City of Grapevine Community Activities Center has adequate facility space and parking to serve as a point of distribution site for immunizations or other medical prophylaxis. Under the proposed agreement, the City of Grapevine Community Activities Center would be utilized as a point of distribution site only if notice was received from the State of Texas Department of Health Services that an actual event had occurred within Tarrant County and the facility was available for use. The City of Grapevine would retain the right to decline use of the Community Activities Center as determined by city staff. Several Tarrant County municipalities and independent school districts have entered into agreements with Tarrant County Public Health for use of facilities during a public health emergency. � . January 30, 2008 (11:03AM) , STATE OF TEXAS § � § KNOW ALL MEN BY THESE PRESENTS COUNTY OF TARRANT § INTERLOCAL AGREEMENT This Agreement is made and entered into this day of , 2007, by and between the City of Grapevine Texas and the County of Tarrant, acting thru the Tarrant County Health Department ("DEPARTMENT"), of Tarrant County, State of Texas, witnessed: WHEREAS, the Department is a Local Health Department under Chapter 121 of the Health and Safety Code; and WHEREAS, this agreement is governed under the Interlocal Cooperation Act, Government Code Chapter 791. I. PURPOSE Under a grant from the Texas Department of State Health Services, the "� Department is required to plan and prepare for a public health emergency which may result from natural or man-made causes. During such an emergency, it may be necessary to immunize or treat all or massive numbers of people. The Department has concluded that the City of Grapevine possesses facilities and personnel that are qualified to serve if mass immunization or treatment is necessary. The City of Grapevine desires to be as helpful as possible in the event of a public health emergency, and agrees to make its facilities and personnel available for purposes of mass immunization or treatment of its employees and family members under the terms set out below. The City of Grapevine and the Department have concluded that this contemplated use of the facilities and personnel is a "governmental function" as defined in the Interlocal Agreement Act. II. PUBLIC HEALTH EMERGENCY This agreement will go into effect only if: 1. The local health authority declares that large scale immunization or treatment is necessary as a control measure for an outbreak of communicable disease. 2. The Grapevine Community Activity Center will not be open for regular business. � -1 - ��, III. OBLIGATIONS OF THE DEPARTMENT 1. The Department will supply or arrange for all equipment, vaccine, and medicine to the extent available and necessary to administer the vaccine or medication. 2. The Department will supply or arrange for all equipment and personnel necessary for staffing, security, crowd control and other tasks, except as described in Section IV below. 3. The Department will be responsible for disposal of inedical waste following its use for the emergency. 4. The Department will be responsible for the acts and negligence of its employees or volunteers, under state and federal law. IV. OBLIGATIONS OF THE CITY OF GRAPEVINE 1. The City of Grapevine is responsible for allowing the use of the Grapevine Community Activities Center and all utilities (gas, electric, and water) normally "�`` associated with its use. '� 2. The City of Grapevine is responsible for providing use of the Grapevine Community Activities Center facility, fixtures, and equipment existing at the facility that the Department regards as necessary for on site use during the period of the emergency. 3. The City of Grapevine will provide at least one person on-site during the period of emergency use with access to the facilities, fixtures and equipment described above. 4. The City of Grapevine is responsible for the acts and negligence of its employees or volunteers, under state and federal law. V. TERM This agreement becomes effective when approved by the governing body of the City of Grapevine and the Department. It may be canceled by either party by giving thirty (30) days notice to the other party, otherwise it remains in effect for five (5) years and may be renewed by mutual agreement. �� -2 - ���.�,.�„�,��.��.� �.,. _ ,.�a�.
