WONZ029MM Conditional Use Request CU13 -27 was submitted by Anna Hoard and was approved on the first reading of an ordinance by Council at the November 19, 2013 meeting. The request was to amend the previously approved site plan and revise the site layout for a gasoline station and convenience store with the possession, storage, retail sale and off- premise consumption of alcoholic beverages (beer only) in the "HC" Highway Commercial District. The subject site has lost approximately 10,400 square feet due to the widening of Pool Road and Ira E. Woods Avenue. The applicant's intent is to revise the site layout by replacing the canopy, removing three existing gasoline pumps, adding one new gasoline pump and one seven foot high, 77 square -foot monument sign. The applicant sought approval of a special exception relative to the front yard landscape area requirement. The site is unable to meet the front yard landscape requirement adjacent to Ira E. Woods Avenue and Pool Road because of the loss of frontage from the subject property. The Board approved the special exception request at their December 2, 2013 meeting. /at O:\ZCU \CU 13 -27.41 December 11, 2013 (1:12PM) y \* AN ORDINANCE ISSUING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH SECTION 48 OF ORDINANCE NO. 82 -73, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CITY CODE, BY GRANTING CONDITIONAL USE PERMIT CU13 -27 TO AMEND THE SITE PLAN APPROVED BY ORDINANCE NO. 2000 -69 TO REVISE THE SITE LAYOUT OF A CONVENIENCE STORE WITH GASOLINE SALES AND OFF - PREMISE CONSUMPTION OF ALCOHOLIC BEVERAGES (BEER AND WINE ONLY) IN A DISTRICT ZONED "HC" HIGHWAY COMMERCIAL DISTRICTALL IN ACCORDANCE WITH A SITE PLAN APPROVED PURSUANT TO SECTION 47 OF ORDINANCE NO. 82 -73 AND ALL OTHER CONDITIONS, RESTRICTIONS AND SAFEGUARDS IMPOSED HEREIN; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; PROVIDING A CLAUSE RELATING TO SEVERABILITY; DETERMINING THAT THE PUBLIC INTERESTS, MORALS AND GENERAL WELFARE DEMAND THE ISSUANCE OF THIS CONDITIONAL USE PERMIT; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; AND PROVIDING AN EFFECTIVE DATE (?
