HomeMy WebLinkAboutItem 11 - Charter Amendment Petition MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: OCTOBER 16, 2012 SUBJECT: CHARTER AMENDMENT ELECTION BY PETITION TO AMEND ARTICLE 3.01(e) RECOMMENDATION: Consider the verification results of the Charter Amendment Petition submitted on September 17, 2012 relating to term limits for Mayor and City Council Members. BACKGROUND: On September 17, 2012, Kathleen.Thompson and Aram Azadpour submitted to the City Secretary's Office a Charter Amendment Petition to amend Article 3.01(e) relative to term limits for Mayor and City Council Members. The petition was required to meet the following guidelines: Petition Requirements Petition must comply with Section 9.004 of the LGC, and Chapter 277, Texas Election Code • Signed by qualified voters of the City • 1,172 signatures required for petition to be considered valid = 5% of the number of qualified (active) voters in the City; as of 09/17/12 active registered 23,424. Voters on suspended list are excluded from calculation (4,579) • Each copy of the petition shall have a copy of proposed legislation attached to it • Election shall be held on first available uniform election date upon receipt of the petition (May 11, 2013) • Petition signature is invalid if the signer signed the petition earlier than the 180th day (March 21, 2012) before the date the petition is filed (September 17, 2012) The City of Grapevine contracted with the Tarrant County Elections Office for signature verification services since Tarrant County has the voter registration records and software that aids in the petition verification process. Tarrant County Elections Administrator Steve Raborn submitted to the City Secretary on October 1, the review and findings of the petition, and certifies the following: October 9,2012(9:43AM) Total Signatures Verified 1,580* Signatures Accepted 1,499 Signatures Rejected 81 *The petition was received with approximately 1,772 signatures (with 192 signatures being crossed out by petition circulators prior to submittal). The 186 page petition, containing 1,499 certified signatures, meets State law requirements. Therefore, the petition is considered valid and should by motion and vote be accepted by the City Council.
