I LH 1635 Northwes 24,10PROPERTY LOCATION AND SIZE: Iwo The subject property is located at 203 South Church Hall-Johnson Street and platted as a portion of Lot 27, Original town of Grapevine. The subject property contains I i0.3115 acres and has approximately 105 feet of LJ ; HGlade Rd. m -L_ frontage along South Church Street and c approximately 105 feet of frontage along West Wall Street. REQUESTED ZONE CHANGE AND COMMENTS: The applicant is requesting a zone change to rezone 0.3115 acres from "CN" Neighborhood Commercial District to "CBD" Central Business District. The applicant intends to convert an existing 3,300 square foot single family dwelling, located at the southeast corner of West Wall Street and Church Street, to office related uses and to continue the use of an existing 700 square foot structure, located on the east side of the lot, as a yoga studio. Proposed site improvements include the following: • eliminate existing parking spaces adjacent to the garage which are partially within the right-of-way of West Wall Street • construct a sidewalk along West Wall Street and along Church Street to the south property line of the subject site Required parking for the proposed use is 21 parking spaces; 43 parking spaces are O:1ZCU\Z17-03.4 1 proposed to meet the required parking as follows: • seven parking spaces on the subject site • four inset parallel parking spaces, three along Church Street and one along West Wall Street • thirty two off-site parking spaces within the public parking lot immediately adjacent to the south PRESENT ZONING AND USE: The property is currently zoned "CN" Neighborhood Commercial District and is developed with two structures, including an existing single family dwelling on the west side of the lot, and a structure used as a yoga studio on the east side of the site. HISTORY OF TRACT AND SURROUNDING AREA: The subject site and the property to the east, north and south were zoned "C-2"Community Business District prior to the 1984 City Rezoning. A portion of the property to the north and the property to the west were zoned "R-3" Multiple Family Dwelling District prior to the 1984 City Rezoning. The City Council at their October 18, 2016 meeting approved Zone Change Application Z16-08 (Ord. 2016-76) to rezone 0.534 acres from "CN" Neighborhood Commercial District to "R-5.0" Zero-Lot-Line District for three single family lots. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "HC" Highway Commercial District—existing and proposed office uses SOUTH: "GU" Governmental Use District—public parking lot EAST: "CN" Neighborhood Commercial District—single family dwelling WEST: "R-5.0" Zero-Lot-Line District—single family dwelling AIRPORT IMPACT: The subject tract is not located within any of the noise zones as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Commercial Low Intensity land use. The applicant's proposal is not in compliance with the Master Plan. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two thousand dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
