HomeMy WebLinkAboutItem 23 - Grapevine Cemetery MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER Y� MEETING DATE: APRIL 18, 2017 SUBJECT: COST PARTICIPATION AGREEMENT — GRAPEVINE CEMETERY RECOMMENDATION City Council consider approving: • a Cost Participation Agreement with Grapevine Cemetery, • the purchase of pipe material including 14", 24" and 30" PVC wastewater pipe, bypass pumping rental, embedment, backfill, manholes and connections, 1 curb inlet and connecting storm drain pipe • miscellaneous site repair costs including sidewalks, pavement, fence and sod repairs and take any necessary action. FUNDING: Funding for this purchase is available in the Utility Fund Account 201-48930-534-9- 161000 (Dooley/Dove Sewer Locations). BACKGROUND: The Cost Participation Agreement provides the City the means to utilize the services of a private contractor, Wright Construction, to construct the Dooley Street / Dove Loop Wastewater Line Relocation. The contractor will perform the construction of the wastewater line relocation and inlet and connecting pipe installation including all backfill placement and compaction for an estimated cost of $60,000. The City will supply all materials including replacement pipe, bypass pumping rental, embedment, backfill materials, manholes, connections and related appurtenances, curb inlet and connecting pipe, sidewalk and pavement repair, and miscellaneous repair costs for the relocation of the wastewater lines at an estimated cost of $175,000.00. In 2016, Staff briefed the Council on the lack of clearly defined boundary lines between the Grapevine Cemetery and the City Street right-of-way lines for Dooley Street and Dove Loop adjacent to the Cemetery. This briefing identified a 24" wastewater line bordering the Cemetery along Dooley Street that was located on Cemetery property and needed to be relocated to establish a final boundary. An existing 14" Wastewater Force Main was also identified along Dove Loop that was located on Cemetery property and needed to be relocated. The City staff has concluded from studies along this line that the 14" line can be connected to the 24" near the intersection of Dooley St and Wildwood Lane and will eliminate the need for the construction of 150 LF of new 14" Force Main. The old 14" line will be removed from the Cemetery property with the 24" line once the new line work is complete. When this work is accomplished all public utilities adjacent to the cemetery will be within the limits of the right of way. The proposed participation between the contractor installing the new lines, and the City providing the needed materials and removing the old lines will provide significant savings to the City. Staff recommends approval. STATE OF TEXAS COUNTY OF TARRANT § COST PARTICIPATION AGREEMENT CITY OF GRAPEVINE WHEREAS, The Grapevine Cemetery Association, hereinafter referred to as "Owner," is the owner of land in the City of Grapevine, Tarrant County, Texas, a Texas home-rule City, hereinafter referred to as "City", which land ("Property") is more specifically described as The Grapevine Cemetery, City of Grapevine, Tarrant County, Texas, incorporated herein for all purposes; and WHEREAS, the City currently has wastewater facilities located on the Property for which there is no easement or right of way in place for same; and WHEREAS, the Owner's ability to fully utilize the Property for its intended purposes is negatively impacted by the existence of the City's facilities; and WHEREAS, the Owner has proposed an agreement to establish a common boundary between the Property and the City of Grapevine street right of way bordering North Dooley Street and East Dove Loop; and WHEREAS, the boundary agreement necessitates that both parties construct improvements to establish the agreed upon boundary and locate their respective facilities upon their respective property; and WHEREAS, the boundary agreement and relocation of the City's wastewater facilities to its own property will allow Owner to fully utilize its property for its intended purposes; and WHEREAS, the Owner is undertaking the construction of their facility improvements to establish the limits of their Property and prepare for additional burial plots; and WHEREAS, the relocation and construction of the City's wastewater facilities to vacate the Property will be in close proximity to the Owner's construction efforts; and WHEREAS, the close proximity of the construction efforts by the City and the Owner necessitates close coordination between the two efforts; and WHEREAS, this Agreement is entered into to provide for the sharing of costs for public improvements as provided for in Chapter 212 of the Local Government Code; and WHEREAS, all legal prerequisites for entering into this Agreement have been met. NOW, THEREFORE, the parties to this Agreement, the City and the Owner, do enter into this Cost Participation Agreement, for good and valuable consideration, the receipt and sufficiency of such consideration being hereby acknowledged, and in the mutual promises and mutual benefits that flow to each party, do hereby contract, O:\contract&interlocal1Developer Contract\Cemetery WW Line Cost Participation Agreement 4-18-17 1 covenant, warrant, and agree as follows: Section 1. That all matters stated in the preamble above are found to be true and correct and are incorporated into the body of this Cost Participation Agreement as if copied verbatim in their entirety. Section 2. The City hereby agrees to engage a contractor to remove and relocate the City's wastewater lines off of the Property at the City's cost, estimated to be $60,000. Section 3. The City agrees to provide the materials necessary to relocate its wastewater lines at its cost. Section 4. This Agreement shall not be assignable without the express written consent of City and "Owner." Executed this Day of , 2017.
