HomeMy WebLinkAboutP&Z Item 09 - Minutes STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas met in Regular Session on this the 16th day of May 2017 in the Planning and Zoning Conference Room, 200 South Main Street, 2nd Floor, Grapevine, Texas with the following members present-to-wit: Larry Oliver Chairman B J Wilson Vice-Chairman Gary Martin Member Beth Tiggelaar Member Dennis Luers Member Theresa Mason Alternate Robert Rainwater Alternate constituting a quorum with Monica Hotelling, Jimmy Fechter absent and the following City Staff: Scott Williams Development Services Director Ron Stombaugh Development Services Assistant Director John Robertson Engineering Construction Manager Albert Triplett, Jr. Planner II Susan Batte Planning Technician CALL TO ORDER Chairman Oliver called the meeting to order at 7:01 p.m. BRIEFING SESSION ITEM 1 . Craig Melde updated the Commission regarding the Multi-Family ordinance. ITEM 2. Chairman Oliver announced the Planning and Zoning Commission would conduct a work session relative to the following cases: CU17-07 SHIPLEY DO-NUTS CU17-08 BRICKS AND MINIFIGS HL17-01 523 EAST TEXAS STREET PLANNING & ZONING COMMISSION MAY 16, 2017 Chairman Oliver closed the Briefing Session at 7:24 p.m. JOINT PUBLIC HEARINGS Mayor Tate called the meeting to order at 7:33 p.m. in the City Council Chambers. Items 3-8 of the Joint Public Hearings were held in the City Council Chambers. The Planning and Zoning Commission recessed to the Planning and Zoning Conference Room, Second Floor to consider published agenda items. PLANNING AND ZONING COMMISSION REGULAR SESSION CALL TO ORDER Chairman Oliver called the Planning and Zoning Commission regular session to order at 7:56 p.m. ITEM 4. CONDITIONAL USE APPLICATION CU17-07, SHIPLEY DO-NUTS First for the Commission to consider and make recommendation to City Council was conditional use application CU 17-07 submitted by M J Wright for property located at 604 East Northwest Highway and platted as Lot 8, Block 1 Wall Street Township. The applicant was requesting a conditional use permit to allow for a drive through and outdoor speaker in conjunction with a retail donut shop. The applicant intended to develop a 3,669 square foot multi-tenant structure on the subject site. Shipley Do-Nuts was proposed to occupy 2,000 square feet on the east side of the building with drive-through service on the east side of the structure and a single order lane on the south side of the structure. The donut shop will provide seating for 24 patrons. One outdoor speaker in conjunction with the menu board is proposed. The applicant has provided 24 parking spaces-24 parking spaces are required. In the Commission's regular session, discussion was held regarding the outdoor speaker. B J Wilson moved to approve conditional use application CU17-07 with the condition that the outdoor speaker shall only be used in conjunction with the reader board. Theresa Mason seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Martin, Tiggelaar, Luers, Mason and Rainwater Nays: None ITEM 5. CONDITIONAL USE APPLICATION CU17-08, BRICKS AND MINIFIGS Next for the Commission to consider and make recommendation to City Council was conditional use application CU 17-08 submitted by Scott Zachary for property located at 051617 2 PLANNING & ZONING COMMISSION MAY 16, 2017 2030 West Glade Road #220 and platted as Lot 8R, Block 1 , Mulberry Square. The applicant was requesting a conditional use permit to amend the previously approved site plan of conditional use request CU11-18 (Ord. 2011-31) for a planned commercial center specifically to allow retail sales of secondhand goods in a lease space exceeding 3,000 square feet. The applicant intended to combine two suites (216 & 220) and occupy an approximate 3,919 square foot lease space within an existing multi-tenant structure (formerly Winn- Dixie shopping center) for retail sales of secondhand toys. Bricks and Minifigs is a franchise which consists of sales of new, pre-owned and retired sets of Lego items. In the Commission's regular session Dennis Luers moved to approve conditional use application CU17-08. Gary Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Martin, Tiggelaar, Luers, Mason and Rainwater Nays: None ITEM 6. HISTORIC LANDMARK SUBDISTRICT HL17-01 , 523 EAST TEXAS STREET Next for the Commission to consider and make recommendation to City Council was historic landmark subdistrict HL17-01 for property located at 523 East Texas Street and platted as Lot 6, Block 104, College Heights. The applicant is requesting designation as a historical landmark sub-district. Such sub-district may include buildings, land, areas, or districts of historical, architectural, archaeological or cultural importance or value that merit protection, enhancement, and preservation in the interest of the culture, prosperity, education, and welfare of the people. In the Commission's regular session B J Wilson moved to approve historic landmark subdistrict HL17-01 . Robert Rainwater seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Martin, Tiggelaar, Luers, Mason and Rainwater Nays: None ITEM 7. AM17-01—AMENDMENTS TO SECTION 60 SIGN REGULATIONS Next for the Commission to consider and make recommendation to the City Council was amendments to Section 60, Sign Regulations relative to converted digital billboards. On September 15, 2015 Section 60, Sign Regulations was amended to allow the conversion of very specific off-premise signs to digital billboards. At that time the ordinance permitted such conversion of "legal nonconforming" signs. The City Attorney determined that this language was not ideal, and has asked that the term "legal nonconforming" be replaced with the word "existing". 051617 3 PLANNING & ZONING COMMISSION MAY 16, 2017 In the Commission's regular session Dennis Luers moved to approve amendments to Section 60, Sign Regulations AM17-01 . Gary Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Martin, Tiggelaar, Luers, Mason and Rainwater Nays: None ITEM 8. FINAL PLAT APPLICATION LOTS 2R1 & 2R2, BLOCK 23, ORIGINAL TOWN OF GRAPEVINE Next for the Commission to consider and make recommendation to the City Council was the Statement of Findings and Final Plat Application of Lots 2R1 & 2R2, Block 23, Original Town of Grapevine. The applicant was final platting 0.4709 acres for two residential structures. In the Commission's regular session Theresa Mason moved to approve the Statement of Findings and Final Plat Application of Lots 2R1 & 2R2, Block 23, Original Town of Grapevine. Robert Rainwater seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Martin, Tiggelaar, Luers, Mason and Rainwater Nays: None ITEM 15. CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the April 18, 2017, Planning and Zoning Meeting. Dennis Luers moved to approve the April 18, 2017 minutes.
