HomeMy WebLinkAboutRES 2010-005 RESOLUTION NO. 2010-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AUTHORIZING A GRANT AGREEMENT WITH THE COMPTROLLER OF PUBLIC ACCOUNTS ADDRESSING FUNDING PARTICIPATION LEVEL, PROJECT SCOPE AND TERMS FOR "TRAFFIC SIGNAL SYNCHRONIZATION OR REPLACEMENT CITY OF GRAPEVINE" PROJECT TO ADD AN ADAPTIVE SIGNAL SYSTEM WITHIN THE CITY OF GRAPEVINE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the United States Congress enacted and the President signed the American Recovery and Reinvestment Act of 2009, Public Law 111-5 (2009) (ARRA) to promote economic recovery, investment and creation of new jobs and opportunities for all Americans including Texans in the form of stimulus grant funds for projects that meet the requirements of both ARRA and Comptroller's SECO programs, funded through the United States Department of Energy (DOE); and WHEREAS, the Comptroller of Public Accounts (Comptroller) Stimulus Program (the "Program") has applied for and the Comptroller has been awarded ARRA funds to support the Comptroller's State Energy Program for energy efficiency, renewable energy, energy assurances and other initiatives, which are managed by the State Energy Conservation Office (SECO); and WHEREAS, Chapters 403, 447, and 2305, Texas Government Code; 42 U.S.C. §§ 6321, et seq, and the Act, P.L. 111-5, (2009), authorize the Comptroller and SECO to consider applications for and award ARRA stimulus funds to local governments, municipalities, and other governmental organizations to fund approved grant-funded projects and activities; and WHEREAS, the Comptroller published a Notice of Availability and Request for Applications (RFA) for ARRA grant funding in order to make competitive awards of grants; and WHEREAS, the City of Grapevine is eligible to receive an award of ARRA grant funding as a result of the RFA process to be utilized for purposes authorized by ARRA; and WHEREAS, the Comptroller wishes to award ARRA grant funding to City of Grapevine (Grantee) and the Comptroller and the Grantee wish to enter into a Grant Agreement (the "Agreement"); and WHEREAS, in consideration of Grantee's compliance with all eligibility and other requirements of the Program and this Agreement, Comptroller agrees to award ARRA funds to Grantee on a cost reimbursement basis in an amount not to exceed $308,000.00; and Whereas, the foregoing grant amount shall be utilized by Grantee solely for the purposes of the Program and Comptroller's requirements regarding same, in addition to requirements as may be provided by Comptroller throughout the term of this Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this resolution are true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council of the City of Grapevine approves entering into this Agreement. Section 3. That this resolution shall become effective from and after the date of its passage.
