MEETING DATE: AUGUST 15, 2017 SUBJECT: AMENDMENT TO THE MASTER THOROUGHFARE PLAN — HERITAGE AVENUE AT BIG BEAR CREEK RECOMMENDATION: City Council consider adopting an ordinance amending the City of Grapevine Master Thoroughfare Plan, as amended in its entirety by Ordinance No. 2006-29, to reflect the removal of Heritage Avenue at Big Bear Creek from the Master Thoroughfare Plan, and take any necessary action. BACKGROUND: Heritage Avenue has been included in several iterations of the City's Master Thoroughfare Plan (MTP), the last adopted by the City Council in 2006. Earlier this year, staff proposed the construction of the missing segment of Heritage Avenue over Big Bear Creek to be considered in the November 2017 Bond Election. On July 18th, 2017, the City Council held a Public Hearing to solicit input from the community regarding the proposed roadway projects. In the written and verbal comments, significant opposition to the project was raised. On August 10th, 2017, the City Council held a special meeting to discuss the proposed projects. In that meeting, the City Council voted to remove the Heritage Avenue at Big Bear Creek project from the proposed November 2017 Bond Election. Given the removal of the project from the November election and the fact the last segments of Heritage Avenue corridor in this area were constructed in the late 1980's, staff has concerns that the adopted MTP does not represent the current nor likely future needs of the community. With the removal of the Heritage Avenue at Big Bear Creek segment, staff will commence an analysis of the entire MTP, including the impacts of the removal of the Heritage Avenue segment, and report those findings and any recommended modifications to the MTP at a future date. Staff recommends approval. ORDINANCE NO. 2017-055 AN ORDINANCE OF THE CITY OF GRAPEVINE AMENDING ORDINANCE NO. 2006-29, RELATING TO THE THOROUGHFARE PLAN OF THE CITY OF GRAPEVINE, TEXAS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council sought public input on staff recommended roadway capital projects for voter approval in November of 2017; and WHEREAS, the Heritage Avenue Bridge at Big Bear Creek was one of the proposed improvements; and WHEREAS, the Thoroughfare Plan 1987-2030 has been amended from time to time with the passage of a series of ordinances; and WHEREAS, the City Council held a public hearing on July 18, 2017 to solicit community input on the proposed projects; and WHEREAS, as an outcome of the July 18, 2017 Public Hearing, the City Council has found that the passage of this Ordinance serves the best interests of the health, safety, and welfare of the public; and WHEREAS, all constitutional and statutory prerequisites for the approval of this ordinance have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this ordinance is in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. The Thoroughfare Plan, a true and correct copy of which is on file with the City Secretary of the City of Grapevine, Texas, is hereby amended to reflect the removal of Heritage Avenue at Big Bear Creek from the Master Thoroughfare Plan as reflected in Exhibit A. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance become effective form and after the date of its passage and it is accordingly so ordained.
