HomeMy WebLinkAbout1971-01-20Reel 15 Side 2 Start 613 ZONING BOARD OF ADJUSTMENTS January 20, 1971 On the 20th day of January, 1971 at 8:00 P.M., the Zoning Board of Adjustments of the City of Grapevine, Texas held a public hearing in the City Hall for the purpose of giving interested persons an opportunity to be heard in connection with the application of J. L. Mitchell for a non -conforming use permit for the reconstruction of the building housing the Grapevine Mattress Factory which was burned beyond 605vo of replacement cost. Members of the Board present were: Chairman Harold Kaker } Floyd Deacon Members ) Bill Yancey A. J. Harper Alternate Member Don Stiles Dori Stiles, Alternate Board Member, served in the absence of Board Member Robert Brown. Persons present in interest of the application were: Joe Shannon, Sr, attorney for J. L. Mitchell, Larry Mitchell, Mr. & Mrs. Frank Pilney, Ann Carlson, J. L. Woods and Harlen Joyce. Chairman Kaker called the meeting to order, introduced the appeal of J. L. Mitchell and explained the responsibility and the authority of the Board in accordance with the City's Zoning Ordinance No. 70-10. Joe Shannon, Sr., Attorney for J. L. Mitchell requested that the Board authorize the reconstruction of the Grapevine Mattress Factory. Persons present were given an opportunity to be heard. Persons speaking in interest of the application were J. L. Mitchell, Ann Carlson, Frank Piley, J. L. Woods and Harlen Joyce. Chairman Kaker read three letters from nearby property owners. The letters were from A. E. Harwell, C. L. Chambers, and J. S. Page. Said letters are on file in the City Records. Chairman Kaker declared a recess to give the Board an opportunity to study the Board's jurisdiction and responsibility. After recess Chairman Kaker called the meeting to order and informed persons present that the Board of Adjustments de- termined that the property involved carries a temporary Single Family Zoning category and that the Board shall re- quest from the Planning and Zoning Commission and the City Council their recommendation on the permanent zoning of the concerned property and area. Chairman Kaker declared the hearing recessed until February 17, 1971. February 2, 1970 The Zoning Board of Adjustments reconveined the hearing on J. L. Mitchell's request to be allowed to reconstruct the Grapevine Mattress Factory, on February 2, 1970 7:30 P.M. with the following members present: Chairman Harold Kaker Members W. Floyd Deacon Bill Yancey A. J. Harper Chairman Kaker called the meeting to order. The Board studied the city's master plan to which the city Council and Planning and Zoning commission referred them to use as a guide in passing proper judgement on the Mitchell Appeal. It was the opinion of the Board that inasmuch as the area under question is planned for single family development, the Board does not have the jurisdiction to authorize the granting of Mr. Mitchell's appeal.
