HomeMy WebLinkAbout1978-11-16STATE OF TEXAS X COUNTY OF TARRANT X CITY OF GRAPEVINE X The Board of Zoning Adjustments met on this the 16th day of November, 1978 at 5:00 P.M. with the following persons present to -wit: A. J. Harper Jesse Woods Jerry Spencer Tames Buckner Tommy Zimmerer Chairman Vice -Chairman Member Member Member constituting a quorum with Member Charles Cox absent, with City Staff member Shirley Armstrong, Secretary. CALL TO ORDER Chairman A. J. Harper called the meeting to order. The first order of business was for the Board of Zoning Adjustments to consider BZA 78-4 submitted by Grapevine Properties, Inc. Chairman A. J. Harper introduced guests Mr. Max Holderby (representing Grapevine Properties) and Mr. Winston Beam. It was then noted that the applicants had requested a twelve foot variance in the thirty foot front yard require- ment on Lot 13, Block 1, The Vineyard, or #5 Whispering Vine. He further advised that the house had already been constructed and ready for occupancy prior to learning of the setback error. A lengthy discussion followed as to why the house was built eighteen feet from the property line when the construction plans submitted with the building permit application clearly showed a thirty foot front yard setback. Mr. Beam advised that it was simply a misunderstanding in measuring procedure derived from a general discussion with a city building inspector. It was then suggested that the building inspection department be required to check setbacks prior to foundation completion. Member Jesse Woods stated that the Building Inspection Depart- ment could be required to check the setbacks, but that in the final analysis, the builder was responsible for building the house in accordance with the construction plans submitted when the building permit was issued. Chairman A. J. Harper asked the City Secretary if she had received any opposition to the requested variance. She answered no. There being no further discussion, Member Jerry Spencer made a motion that the application be approved allowing a twelve (12) foot front yard variance on Lot 13, Block 1, The Vineyard. The motion was seconded by Member James Buckner and prevailed by the following vote: Ayes: Harper, Woods, Spencer, Zimmerer, & Buckner Nays: None Absent: Charles Cox The City Secretary was then requested to ask for a ruling from the City Attorney pertaining to whether or not a builder could vary from the setbacks shown on construction plans (submitted when the building permit was issued) as long as the house was built within the limits of the re- quired setbacks. Member Jesse Woods then made the following motion: To strongly recommend that the Building Inspection Department ascertain (before approval of the first inspection) that the house is located on the lot in accordance with the site plan submitted with the building permit application. The motion was seconded by Member James Buckner and prevailed by the following vote: Ayes: Harper, Woods, Spencer, Zimmerer, Buckner Nays: None Absent: Charles Cox The next order of business was to consider the minutes of the meetings of October 4, and October 30, 1978. Member Tommy Zimmerer made a motion to waive the reading of the minutes and approve them as published. Member Jesse Woods seconded the motion and it prevailed by the following vote: Ayes: Harper, Woods, Spencer, Zimmerer, & Buckner Nays: None Absent: Charles Cox There being no further business to come before the board, Member Tommy Zimmerer made a motion to adjourn. The motion was seconded by Member James Buckner and all in attendance voted aye. -1 PASSED AND APPROVED on this the_ day of Lf 1978. Shirley Armstrong City Secretary
