ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND
POSTED ON THIS THE 1ST DAY OF JULY, 1983 AT

The Board of Zoning Adjustments of the City of Grapevine, Texas met in
Regular Session on Thursday, July 7, 1983, at 6 P.M. in the Council
Chambers of City Hall, 413 Main Street, with the following persons
present, to wit:

constituting a quorum, with Chairman James Buckner absent, and the
following City Staff, to wit:

Vice -Chairman Gerald Thompson called the meting to order, stating the
procedures and purposes of the meeting®
The first item of business was for the oath of truth to be administered
to those present who wished to speak relative to the items on the
evening's agenda.
Vice Chairman Thompson administered the "Oath of Truth" to Mr. Roy
Stewart, Mr. Frank Snerbeck, Mr. Jim Sutton and Mrs. Conna Sutton.

The next item for consideration by the Board was BZA 83-03, submitted by
Mr. Roy Stewart.
Members and those present were advised that the request for a 10 foot
variance was submitted by Mr. Stewart on June 13, 1983, when at that
time, he made application to construct a 40 x 225 foot commercial retail
building on property zoned "C-2", Community Business District, located
on the Northeast corner of Vine and Ball Street. The permit was denied
because the building did not met the minimum fifteen (15) foot rear
yard requirement of Section 7-502(2) of the Appendix A Zoning Ordinance.
The proposed building as submitted by Mr. Stewart, had a five (5) foot
rear yard.
Mr. Stewart explained the proposed use of the area as indicated on the
site plan. He advised that it was for the purpose of securing adequate
parking spaces to serve the building. He further advised that rezoning
of the property had been accomplished recently to secure "one lot" the
size necessary for the proposed strip shopping center. The ingress and
egress would utilize Ball and Vine Streets.
k5mber Deavers questioned Mr. Stewart as to the number and response of
the residences that abutt the rear of the property nearest the requested
adjustment in the required backyard clearance and from what type
material would the 6 foot fence be built® Mr® Stewart replied there are
two homes and one vacant lot and the fence was to be wooden and the
buildings masonry® He said there had been no negative response®

There was reportedly no correspondence relative to the subject adjust-°
ment. case, and no one was present to speak for or against Mr. Stewart's
request.

There being no further discussion relative to BZA83-03, Vic-

ompson called for a motion. Doug Lamb made a motion to accept
application for variance as submitted, and Steve Hall seconded thel
motion, which prevailed by the following vote -
Ayes: Thompson, Lanb, Deavers, Stiner and Hall
Nays: None
Absent: Buckner
BOARD OF ZONING ADJUSTLVJENT CASE BZA83-04 SUBMITTED BY MR. REGIS J.
GRIFFIN
The next item for consideration by the Board was BZA83-04, submitted by
Mr. Regis J. Griffin.
On June 14, 1983,Mr. Griffin submitted an application for variance to
construct a residence at 3008 Creekview, which met all code requirements
except the minimum. twenty five (25) foot rear yard requirement specified
in 7-102(2) of the Appendix A, Zoning Ordinance. The house, as
submitted would have a 16 foot 11 inch rear yard.
Mr. Smerbeck, representing Mr. Griffin, advised that originally, the
house was designed for a detached garage which would put the garage 6
feet from the backyard property 'Line; however, the residents would
prefer the security of an attached garage since Mr. Griffin's occupation
requires that he travel, and there were plans for a pool as well. Mr.
Smerbeck further advised that he believed the neighborhood would
appreciate the more esthetic appearance frcirL the attached garage even
though it would necessitate a 16 foot, 10 inch rear yard variance.
Those present expressing objection to the proposed variance, were Mr.
and Mrs. Sutton.
There was no correspondence relative the to subject request for
variance.
There was a lengthy discussion during which Board Members expressed
concern primarily that the house should have been smaller, thus designed
for the smaller lot, but since the house did met the continuity of the
neighborhood, it might be more appropriate for the area despite being
somwhat oversized. Merit)= Deavers expressed objection to granting a
variance since objections by neighboring property owners had been
expressed. Member LaiTb expressed a desire to hear further from others
in the neighborhood. Mr. Richardson advised that the required
notification had been mailed permitting adequate time for response from
the neighborhood. Following further deliberation, Doug LaiTb made a
motion to table a decision pending further input from neighbors other
than M1r. & Mrs. Sutton. Glenn Deavers seconded the motion which failed
by the following vote:
Ayes: Lairb and ravers
Nays: Th son, Stiner and Hall
Absent: Buckner
Member Stiner Fade a suggestion that Mr. & Mrs. Sutton discuss further
the subject case while the board recessed.

After a private conversation and when the Board reconvened, Mr. and Mrs.
Sutton expressed no further objections to the requested variance. Then,
following a brief discussion, Steve Hall made a motion to approve the
variance as requested, and Glenn Deavers seconded the motion which
prevailed by the following vote:
Ayes: Thompson, Deavers, Lamb, Stiner and Hall
Nays® None
Absent: Buckner
The next item to be considered by the Board of Zoning Adjustments, was
the minutes of the meting of May 5, 1983.
Vice Chairmn Than pson requested a name -spelling change be made on the
first page: ThaTpkins to Thompson. Joel Stiner made a motion to approve
the minutes, then as amended, and Steve Hall seconded the motion, which
prevailed by the following vote:
Ayes: Thompson, Deavers, Lamb, Stiner and Hall
Nays: None
Absent: Buckner

Joel Stiner announced, informally, that he would be moving to Dallas,
therefore must resign his membership. He stated further that he would
be returning to law school.

There being no further business to come before the Board of Zoning
Adjustments this evening, Doug Lamb made a motion to adjourn the
meeting, and Steve Hall seconded the motion, which prevailed by the
following vote:
Ayes: Thomson, Deavers, Lamb, Stiner and Hall
Nays: None
Absent: Buckner
