The Oath of Truth was administered to Mr. Baddaker who was to speak
representing Mr. David Vilbig relative to his application for variance.
The first item for consideration by the Board was request for a variance
submitted by David Vilbig, BZA-83-09.
Chairman Thompson asked Mr. Baddaker to speak in the absence of Mr.
Vilbig relative to Mr. Vilbig's property located west of Redbird Lane
and north of Dove Pond which is land -locked with the only accessibility
via an easement across adjoining property. Mr. Baddaker advised that
since there is no direct access or frontage on a public street, it would
presently be impossible to meet the Zoning Ordinance's provision for a
minimLun 65 foot frontage; therefore, Mr. Vilbig would require a variance
to the requirement to build a home to replace his mobile home which was
recently destroyed by fire. Mir. Baddaker thanked the Board for calling
this special meting for consideration of this one case prior to
Planning and Zoning Commission and City Council consideration of the
Vilbig plat this same evening.
The Director of Public Works further advised that in studying the
situation, there was no feasibility for elimination of the land -locked
situation in the near future.
Following a very brief discussion, Member Doug Lamb made a motion to
waive the zoning requirement for 65 feet of street frontage and grant
the variance as requested. First Alternate Steve Hall seconded the
motion which prevailed by the following vote:
Ayes: Thompson, Deavers, Lamb, Tischler, Waldrip, Hall &
Troy
Nays: None
