ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S, AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 8TH DAY OF APRIL, 1977 AT 10:00 A.M. City Se4etary MINUTES OF BOARD OF ZONING ADJUSTMENTS April 12, 1977 PRESENT : A. J. Harper, Conrad Heede, Jesse Woods, James Buckner LATE ARRIVAL : Jerry Spencer CITY STAFF MEMBERS: Joe Lipscomb, Shirley Armstrong IThe meeting was called to order by Chairman A. J. Harper. The first order of business was for the Board of Zoning Adjustments to consider Application BZA 77-2 submitted by Mr. Tommy Henderson. The applicant explained that he was requesting a six foot variance in the 25' rear yard setback requirement. The City Secretary pro- vided board members with plats of LaPaloma Estates and pointed out the lot in question to be Lot 6 of Block 2. Mr. Lanny Tate, owner and developer stated that the lot was 100' deep and that the desired house plan would allow a rear yard setback of only 191. Members A. J. Harper and Jesse Woods suggested that a blanket variance be considered for lots five thru fourteen, block two since it appeared the rear yard setback requirement would create constant variance requests. It was also mentioned that those lots abutted Corp property and the variance would obviously not create a hardship to neighboring property owners. Developer Lanny Tate stated that he would be glad to submit such an application if that was the desire of the board. Member Conrad Heede commented that he would not be in favor of granting a blanket variance because it would encourage property owners not to comply with the city zoning code. There was little other discussion. Member Conrad Heede made a motion to grant a six foot rear yard variance for Lot 6, Block 2 of LaPaloma Estates as requested by the applicant. The motion was seconded by Member Jesse Woods and prevailed by the following vote: Ayes : Harper, Woods, Heede, & Buckner Nays : None Absent: Jerry Spencer The next order of business was consideration of the minutes of January 31, 1977. Member Conrad Heede made a motiorAo approve the minutes as published. The motion was seconded by Member James Buckner and all present voted aye. There being no further business to c ' ome before the board, Member Conrad Heede made a motion to adjourn. The motion was seconded by Member James Buckner and all present voted aye. Shortly after the meeting adjourned, Member Jerry Spencer arrived and expressed apologies for being late. PASSED & APPROVED on this the If day of April, 1977. City Secr ary
