III, CONSIDERATION OF THE MINUTES (July 18, 1977) IV. MISCELLANEOUS REPORTS AND/OR DISCUSSIONS V. ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 21ST DAY OF JULY, 1977 AT 10:30 A.M. City Secretary July 26, 1977 PRESENT: A.J. Harper, Jerry Spencer, Jesse Woods, Conrad Heede, Charlie Cox CITY STAFF MEMBERS: Joe Lipscomb Chairman Harper called the meeting to order and took as the first order of business the consideration cEthe minutes of July 18. Jesse Woods made a motion to approve the minutes as printed. The motion was seconded by Jerry Spencer. Ayes: Harper, Spencer, Woods, Heede, Cox Nays: None The next order of business was BZA application 77-7 by Rudolf Fernandez,. Chairman Harper asked if there had been any response to the notices that had b6e'n mailed out. Joe Lipscomb read three letters that had been received all in opposition. A discussion followed in which board members and neighbors Joe Kennedy, Bob Murphy and Mr. and Mrs. Ken Wray expressed opposition to the application. Rudolf Fernandez suggested he could change his request to a 15 foot rear yard and a 30 foot front yard which would only require a 10 foot variance in the rear yard requirement. Joe Kennedy stated he had no objection to the revised request if the rear yard was properly screened. Mr. Fernandez reconsidered his revised request and decided that by turning his house he would need only a four(4) foot variance in the rear yard. The board discussed this request. Conrad Heede made a motion to allow a four(4) foot variance in the rear yard set back of lot 28, Shorecrest Addition with a six(6) foot wood fence required for screening. The motion was seconded by Jesse Woods. Ayes: Heede, Woods, Harper, Spencer, Cox Nays: None The -next order of business was application BZA-77-8. Upon review of Mr. Doss' plans it was discovered that a two (2) foot fireplace had not been included in his request. chairman Harper asked if Mr. Doss would mind making the variance in the rear instead of the front. After an involved discussion Jerry Spencer made a motion to approve a three(3) foot variance in the rear yard setback provided that the two (2) foot encroachment by the fireplace in the front yard would be considered an architectural projection by the City Attorney. The motion was seconded by Conrad Heede. Ayes: Spencer, Heede, Harper, Cox, Woods Nays: None There being no further business the meeting was adjourned.
