ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 1ST DAY OF JUNE, 1979, AT 9:00 A.M. lity SecrV STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustments of the City of Grapevine, Texas met on this the 7th day of June, 1979, at 7:00 P.M., with the following persons present to -wit: A. J. Harper Chairman - James Buckner Member Charles Cox Member Jerry Spencer Member constituting a quorum with Members Jesse Woods and Tommy Zimmerer absent, with the following City Staff Member present: Shirley Armstrong City Secretary The meeting was called to order by Chairman Harper. BZA APPLICATION NO. 79-5, APPLICANT -GRAPEVINE PROPERTIES, INC. The first order of business was for the Board to consider applica- tion No. BZA 79-5, submitted by Grapevine Properties, Inc. Chairman Harper explained that the applicants were requesting a three foot, six inch (3'6") side yard variance on the north side of Lot Eight (8), Block One (1), The Vineyard Addition to the City of Grapevine. He added that the house was already completed and under contract for purchase. Mr. Harper advised that Mr. Neil Gibson, representing the applicants, was unable to attend the meet- ing because of unavoidable prior committments, but that he and Mr. Gibson had a lengthy discussion on the matter on the evening of June 6, 1979. Mr. Harper then asked the Board members to read a letter from Mr. Gibson addressed to Mr. Harper. (Said letter is attached as Exhibit "A" and made a part hereof to the Board of Zoning Adjustments Meeting minutes of June 7, 1979). Chairman Harper then read into the record a letter from Timberline Develop- ment Corporation (a property owner within 200 feet) which advised the Board that they did not object to the requested variance. (Said letter attached hereto as Exhibit "B" and made a part hereof to the Board of Zoning Adjustments Meeting minutes of June 7, 1979). The City Secretary advised the Board that she had not received any opposition to the requested variance. Mr. Harper advised the Board that the City Inspection Department had recently been instructed to inspect a site prior to the pour- ing of a foundation to assist in preventing errors of this nature, but added that the house in question was started before such instruc- tions were given. Mr. Harper reminded the Board that Grapevine Prop- erties, Inc. had recently submitted two (2) prior applications which were similar in nature to the one being considered at the present time, both of which were granted. He noted that during a lengthy conversation with the City Attorney on this date, he had been advised that fines could be assessed for violations of this nature if cita- tions were given prior to a variance being authorized by the Board of Zoning Adjustments. The Secretary was then instructed to advise Grapevine Properties of receipt of Mr. Gibson's letter and to further advise them that the Board did not intend to be lenient in the event another such error was made and resulted in an application before the Board. Member Jerry Spencer stated that he would prefer that the purchasers of Lots Seven (7) and Eight (8), Block One (1), The Vineyard be re- quired to submit an agreement relieving the City of Grapevine of any responsibility in the event of drainage problems. Following a lengthy discussion, Member Charles Cox made a motion to grant the variance as requested contingent upon the construction of a suitable retainer wall between Lots Seven (7) and Eight (8), Block One (1), The Vineyard, and further contingent upon the City of Grapevine's receipt of written acknowledgment from the purchasers of Lots Seven (7) and Eight (8), Block One (1), The Vineyard, that they are aware of the variance granted by said Board. The motion was seconded by Member James Buckner and prevailed by the following vote: Ayes: Harper, Buckner, Spencer, and Cox Nays: None Absent: Woods and Zimmerer ELECTION OF OFFICERS - 1979-80 The next order of business was for the Board of Zoning Adjustments to elect officers for 1979-80. Chairman Harper advised that nominations were in order for Chairman. Member James Buckner nominated A. J. Harper. Member Jerry Spencer made a motion that nominations cease and that Mr. Harper be elected by acclamation. The motion was seconded by Member Charles Cox and pevailed by the following vote: Ayes: Buckner, Spencer, and Cox Nays: None Abstain: Mr. Harper Absent: Woods and Zimmerer Chaiman Harper then advised that nominations were in order for Vice - Chairman. Member Charles Cox nominated James Buckner. Member Jerry Spencer made a motion that nominations cease and that Mr. Buckner be appointed by acclamation. The motion was seconded by Member A. J. Harper and prevailed by the following vote: Ayes: Harper, Spencer, and Cox Nays: None Abstain: Mr. Buckner Absent: Woods and Zimmerer MINUTES The next order of business was consideration of the Minutes of May 3, 1979. Member Jerry Spencer made a motion to waive the reading of the minutes of May 3, 1979, and approve them as written. The motion was seconded by Member Charles Cox and prevailed by the following vote: Ayes: Harper, Buckner, Spencer, and Cox Nays: None Absent: Woods and Zimmerer M M There being no further business to come before the Board, Member Jerry Spencer made a motion to adjourn. Drawer 1547 Grapevine, Texas 76051 - Dear Chairman Harper: June 5, 1979 EXHIBIT "A" On May 7, 1979 I was appointed as Agent for the Hilon Development Company and made responsible for completion of that Company's Grapevine project, The-- Vinyard. he-Vinyard. Soon after my appointment I learned that the Hilon home built at 8 Windy Knoll was incorrectly placed on the lot with respect to the side yard set -back require- ment. To close the sale of this $100,000 home I caused to be submitted to your Board a request for a zoning variance on the insufficient side yard set -back, Because I have since learned that this variance request is not the first for Hilon I felt that it was only fair to you and the other Board.members for me to explain the measures I have instituted at The Vinyard to insure that this prob- lem does not occur again. For the three homes now under construction and for all future homes it is Hilon policy to site all slabs based on a survey made of the lot at the time of staking the foundation. This survey, of course, will include placement of the appropriate set -backs on all sides of the new home. Homes not built with this requirement in the past have, unfortunately, brought about several requests for zoning variances at The Vinyard and were a.major factor in the dismissal of the Building Super- intendent and the local Vice President. Because the house was constructed at the time of determination of the zoning error Hilon requests that the variance be granted by your Board. Hilon believes that the newly instituted foundation siting procedures will eliminate the need for additional zoning variances.
