BZA APPLICATION 79-6, BUTLER CONSTRUCTION CO. The first order of business was for the Board of Zoning Adjustments to consider BZA Application 79-6 submitted by Butler Construction Company. Mr. Buckner swore in the applicant, Don Butler. Vice Chairman Buckner then explained that the applicant was requesting a 5' 7 3/4" rear yard variance on the property located at 2946 Ridgewood, or Lot 44, Block 17, Oak Creek Estates. Mr. Butler explained that the primary reason for the variance request was to allow the purchaser of the property to have the floor plan of his choice constructed. He noted that every effort had been made to rearrange the -floor plan, but that it was not architecturally feasible and would also alter the preferred floor plan too much. Member Jesse Woods stated that he felt the Council should consider an amendment that would allow a 20' rear yard setback rather than the required 25'. Member Jerry Spencer stated that he did not feel that the subject qq application was a hardship case. Member Jesse Woods commented that he did not feel the basis for the requested variance was a valid one. Following a short discussion, Member Jerry Spencer made a motion to deny the application.
