Tate Avenue, #350 and is platted as Lot 2, Block 1 , DFW 3 Airporport Towne Center Addition No. 2. The addition contains Hall-Johnson ti0so a 6.557 acres and has approximately 375 feet of frontage along William D. Tate Avenue. Glade Rd. d I _ It c 0 REQUESTED CONDITIONAL USE COMMENTS: The applicant is requesting a conditional use permit to allow retail sales of secondhand goods in an enclosed building where the size of the space exceeds 3,000 square feet and a 20-foot pole sign. Angel's Attic is located at 1635 West Northwest Highway and was approved by the City Council at the May 20, 2014 meeting to allow for retail sales of secondhand goods in an 8,756 square foot lease space. With this request, the applicant proposes moving to this new location and occupying 10,943 square feet within the existing multi-tenant structure for retail sales of secondhand goods. The proposed hours of operation are 10:00 a.m. - 6:00 p.m. Tuesday-Saturday. An after-hours drop box is proposed at the rear along the east side of the building and will be manned Tuesday-Saturday 10:00 a.m. — 6:00 p.m. Total required parking for the shopping center is 343 parking spaces; 343 parking spaces are provided. The required parking for the proposed use is 44 parking spaces. R:Wgenda\2017\2017-10-17\CU17-22.4.doc 1 October 11,2017(10:19AM) The applicant also proposes removal of an existing non-conforming pole sign from the subject site and replacing it with a multi-tenant pole sign 20-feet in height and 108 square feet in size. The applicant expects the proposed sign will add value to the subject site. Many lots along William D. Tate Avenue in the immediate vicinity of the subject site have a 20-foot pole/pylon sign, e.g. Taco Bell, Baja Mexican Grill, Arby's, Jack-In-The-Box, Silver Fox and Chick-fil-A. Additional improvements to the site include removing existing asphalt and adding approximately 2,800 square feet of open space in the form of ground cover adjacent to William D. Tate Avenue. If approved this will be the first reading of an ordinance. The subject site requires approval of a special exception by the Board of Zoning Adjustment due to open space, impervious, front, rear and side yard setback and landscaping requirements on the subject site. These items will be heard by the Board of Zoning Adjustment at their November 5, 2017 meeting. If approved by the Board, the second reading of the ordinance will occur at the Council's November 21, 2017 meeting. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District and is developed with a multi-tenant structure occupied by Jo-Ann Fabrics, Dollar Tree and Petco. HISTORY OF TRACT AND SURROUNDING AREA: The subject property and the areas to the north, south east and west were rezoned from "C-2" Community Business District to "CC" Community Commercial District during the 1984 City Rezoning. On the site to the east Conditional Use Permit CU87-05 (Ord. 87-49) was approved for Elaine's Oven Ready Pizza with alcohol beverage sales. CU89-05 (Ord. 89- 33) was approved for Samir's Restaurant with alcohol beverage sales. Esparza's Too was approved by Council June 18, 1991 (CU91-11 , Ord. 91-38) also with alcohol beverage sales. Conditional Use Permit CU92-05 (Ord. 92-24) was approved March 24, 1992 for Royal Cathay Restaurant with alcohol beverage sales. CU98-06 (Ord. No. 98-39) was approved in March 1998 allowing for the provision of a 20-foot multi-tenant pole sign on the site. CU01-14, approved by the Site Plan Review Committee in March 2001, allowed for the expansion of the bar area in Esparza's Too. CU01-45 (Ord. No. 01-75)was approved in September 2001 allowing a restaurant with on-premise alcoholic beverage sales. CU03- 35 (Ord. No. 03-63) was approved in October 2003 for an existing restaurant with on- premise alcohol sales to enlarge the square footage and provide a take-out counter. Conditional Use Permit CU06-32 (Ord. No. 06-56)was approved in August 2001 to revise the elevations, floor plan and a monument sign for an existing restaurant. Tate Street Plaza, is a planned commercial center with a restaurant with alcoholic beverage sales, an automotive retail service center, and a drive through restaurant. The Hayley Addition, south of the U.S. Post Office was zoned "I-1" Light Industrial prior to the 1984 City Rezoning. The Hayley Addition, currently zoned "HC" Highway Commercial District, is a planned commercial center with a variety of retail uses, including restaurants with on- premise consumption of alcoholic beverages. Conditional Use Permit CU89-15 for a Planned Commercial Center to be developed as four lots with three restaurants (Lubys, Arby's and International House of Pancakes) and one retail center was approved in 1989. A one-year extension of CU99-15 was approved in December 1990. Conditional Use Permit CU91-19 for both a Jack in the Box Restaurant and an amendment to the approved site plan of Luby's Cafeteria was approved in 1991. CU93-05, approved in 1993, again amended the approved site plan and sign for Luby's Cafeteria. Conditional Use Permit CU95-02 (Ord. No. 95-10) was approved in February, 1995, allowing the possession, storage, retail sale and on-premise consumption of alcoholic beverages (beer and wine only) in conjunction with an existing restaurant for Jason's Deli. The Towne Center Addition II which contains 62.47 acres, was rezoned in 1992 (Z92-09 and CU92-23) from "PCD" Planned Commerce Development District to "CC" Community Commercial District with a conditional use permit for a planned commercial center which brought forward the development of the Target store. In 1994, the site plan was amended to include Ross Dress for Less, Barnes and Noble, Famous Footwear, and Showcase Hallmark(CU94-31, Ord. No. 94-100). In 1995 the master site plan was amended again to allow for the development of Linens N' Things on Lot 4R-1 with Mattress Giant and Chesapeake Bagel on Lot 5 (CU95-16). In 1996, the site plan was modified to develop retail space for Barbecue's Galore and Coleman Spas on Lot 9 (CU96-20), Office Depot and Cost Plus on Lot 6R (CU96-29), and a 20,000 square foot retail building on Lot 7 that houses Chuck's Hamburgers, Haltom's Jewelers, and Busybody Home Fitness (CU96-36). CU99-06 allowed the development of a 6,581 square foot restaurant(Mimi's Café)with the possession, storage, retail sale, and on-premise consumption of alcoholic beverages(beer, wine, and mixed drinks) along with an attached 3,295 square foot retail building. Conditional Use Permit CU99-57 was approved in November 1999, allowing outdoor seating at Jason's Deli. Conditional Use Permit C000-11 (Ord. 00-34)was approved at the March 28, 2000 meeting which allowed for a bank with drive-through service. In addition a 50-foot landscape buffer was approved with the request around the remainder of the undeveloped portion of the Towne Center Addition including the bank site to bring the entire planned commercial center into compliance with the landscaping requirements. The Site Plan Review Committee approved Conditional Use Permit CU03-01 in March 2003, allowing the placement of a pole sign for Haltom's Jewelers. The Site Plan Review Committee also approved CU03-02 in March 2003, permitting a revision of the Luby's Restaurant pole sign. At the August 19, 2003 meeting, Council approved a Conditional Use Permit (CU03-26) for modifications to the site plan for the Target retail store. Conditional Use Permit CU04-24 was approved at the August 17, 2004 meeting with allowed for a 132 bed skilled nursing facility within the Towne Center Addition accessed from Ira E. Woods Avenue. At the October 17, 2006 meeting Council approved an amendment to site plan for the planned commercial center (CU06-39) to allow the development of two medical office buildings totaling 6,595 square feet. The Site Plan Review Committee at their August 29, 2007 meeting approved Conditional Use Permit CU07-28 to revise the exterior elevations by adding an outdoor fireplace, fountains and gazebo, revise the landscape plan, and revise the monument sign location of Ferrari's R:\Agenda\2017\2017-10-17\CU17-22.4.doc 3 October 11,2017(10:19AM) I Italian Villa. At the November 20, 2007 meeting Council approved an amendment to site plan for the planned commercial center(CU07-35)to allow the development of two medical office buildings totaling 9,456 square feet. Conditional Use Permit CU08-29 (Ord. 08-71) was approved at the November 18, 2008 meeting to allow a 25-foot landscape setback for all parcels adjacent to Ira E. Woods Avenue and William D. Tate Avenue. Conditional Use Permit CU09-03 (Ord. 98-07) was approved at the March 24, 2009 meeting to allow gasoline sales and alcohol sales for off-premise consumption (beer and wine) and two monument signs in conjunction with a 4,902 square foot convenience store. At the June 15, 2010 meeting Conditional Use Permit CU10-13 (Ord. 2010-28) for a monument sign and to allow the possession, storage, retail sales and on-premise consumption of alcoholic beverages (beer, wine and mixed beverages) along with SU10-05 (Ord. 2010-29)to allow for the use of one billiard table in conjunction with a restaurant were both approved. Conditional Use Permit CU10-30 (Ord. 11-01) was approved at the January 18, 2011 meeting to allow outdoor dining in conjunction with a restaurant. Conditional Use Permit CU10-34 (Ord. 11-04) was approved at the January 18, 2011 meeting to allow a multi- tenant monument sign. At the September 15, 2015 meeting the City Council approved Conditional Use Permit CU15-37 (Ord. 2015-57)to allow for a 20-foot pole sign for Ferrari's restaurant. The Site Plan Review Committee at their August 3, 2016 meeting approved Conditional Use Permit CU16-19 to allow for minor floor plan and exterior elevation changes to Ferrari's restaurant. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "CC" Community Commercial District,—Grapevine Towne Center, Target shopping center along with other various retail stores, Grapevine Medical Lodge SOUTH: "GU" Governmental Use District, "HC" Highway Commercial District— U.S. Post Office, Midas Muffler, In and Out Burger and other various restaurants EAST: "GU" Governmental Use District, "CC" Community Commercial District—U.S. Post Office and various restaurants, Baja Mexican Grill, Peace Burger, Subway, Chick-Fil-A, WEST: "CC" Community Commercial District— Grapevine Towne Center, Target shopping center along with other various retail stores AIRPORT IMPACT: The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance Ordinance No. 2017-075 2 of the City of Grapevine, Texas, same being also known as Appendix"D" of the City Code, by granting Conditional Use Permit CU17-22 to allow for retail sales of secondhand goods in a lease space is excess of 3,000 square feet (Angel's Attic) and a multi-tenant 20-foot pole sign for the center in a district zoned "CC" Community Commercial District within the following described property: Lot 2, Block 1, Towne Center Addition No. 2 (1250 William D. Tate Avenue, Suite 350) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
