W119� COMMUNITY DV LOPMENT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, April 5, 1993, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Al Zimmerman 2nd Alternate constituting a quorum with Vice -Chairman, Patti Bass and 1 st Alternate, Ron Williams, absent. Also present was City Council Representative, Gil Traverse and the following City Staff: Greg Wheeler Gerrie Anderson Building Official Administrative Secretary Chairman, Charles Giffin, called the meeting to order at approximately 6:00 P.M. The first item of new business for the Board of Zoning Adjustment to consider was BZA93-04, submitted by Sheila Almon who is requesting a variance from Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1., "R-7.5", Single Family District Regulations which requires a 30 foot front yard building setback. The request is to allow the existing house a one foot variance to encroach the 30 foot front yard setback from the property line as shown on the plot plan for the property located at 2919 Scenic Drive, Lot 20, Block 3, Trail Lake Addition. Greg Wheeler explained the applicants received notice from Lawyers American Title Company during a recent real estate transaction that the survey showed a building line encroachment into the front yard setback. Mr. Wheeler explained the encroachment was not the fault of the applicant. With no one to speak either for or against the request, Ery Meyer made a motion to close the public hearing. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Zimmerman Nays: None Absent: Bass, Williams A With no further questions, Randy Howell made a motion that special conditions did exist and the special conditions being that the encroachment was no fault of the applicant, the structure is existing and the applicants were not aware of the encroachment when they purchased the home. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Zimmerman Nays: None Absent: Bass, Williams Randy Howell then made a motion to approve the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1, "R-7.5", Single Family District Regulations, to allow a one foot variance to encroach the 30 foot front yard setback, allowing a 29 foot front yard setback, Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Zimmerman Nays: None Absent: Bass, Williams The next item of new business for the Board of Zoning Adjustment to consider was BZA93-06, submitted by Dwight Newsom who is requesting a variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 31.G.4., Light Industrial District Regulations, Side Yard Setbacks, for 318 E. Dallas Road. The request is to allow an accessory building to be erected within the fifteen foot side yard setback to be used as a warehouse/maintenance shop as shown on the plot plan. Greg Wheeler explained that Dwight Newsom submitted an application for the construction of an office facility to be developed on Dallas Road for Tri -Dal Excavation and Utilities, Inc. The development has an L-shaped lot with the widest portion being the rear half of the property to be used for storage and equipment repair. The warehouse/maintenance facility is proposed to set in the northwest corner of the rear portion of the lot. Greg Wheeler explained that Staff recommended denial of the request because the applicant has not demonstrated that meeting the requirements of the Grapevine Comprehensive Zoning Ordinance 82-73 will prevent him from accessing his property, or it eliminates the ability of the truck/trailer rigs to maneuver on site for accessibility to the maintenance building. John Pierce of Pierce Contractors Inc., 4100 Amon Carter Boulevard, Fort Worth, Texas, took the Oath of Truth and explained that he represented the owners of Tri -Dal Excavation and Utilities, Inc. Mr. Pierce explained the warehouse/maintenance building would be at the rear of the property and out of the way. Greg Wheeler noted that two letters of approval had been received. 9 With no one else to speak either for or against the request, Randy Howell made a motion to close the public hearing. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Zimmerman Nays: None Absent: Bass, Williams Randy Howell asked if he had thought about moving the building where it would conform to the setback requirements. Mr. Pierce explained that the location where they want to locate the warehouse/maintenance building is in an area where it would be tucked out of the way and would be located to where vehicles coming off of Nash Street go directly to that building. Brian Holdgate, of 3147 High Timber, Grapevine, Texas, and owner of the property, took the Oath of Truth and explained to the Board that a seven foot high screening fence would be erected along Nash Street to the east and along the north property line. Richard J. Mueller, of 198 Sand Bass Ridge, Southlake, Texas, and also owner of the property, took the Oath of Truth. Mr. Mueller explained where they want to locate the warehouse/maintenance building would be the best area because of the location of a drainage swale on the property. After further discussion from the Board concerning the building being too close to the other surrounding properties to the west and north, Mr. Pierce said they could comply with the west side setback being the required 15 feet if the north side setback could be left at five feet. Council Representative, Gil Traverse, noted that the unusual shape of the property did make this case different. Ery Meyer then made a motion that a special condition did exist and the special condition being the size and shape of the lot creates an inconvenience for the owner to properly place the warehouse on this lot. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: Zimmerman Absent: Bass, Williams Ery Meyer made a motion to allow the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 31.G.4., Light Industrial District Regulations, Side Yard Setback, allowing an accessory building to be erected with a five foot setback on the north property line, but holding the 15 foot setback on the west property line. Randy Howell seconded the motion which prevailed by the following vote: 3 Ayes: Nays: Absent: MINUTES Giffin, Howell, Meyer, Coy Zimmerman Bass, Williams Next, the Board of Zoning Adjustment considered the minutes of the February 1, 1993, meeting. Ery Meyer made a motion to approve the minutes of the February 1, 1993, meeting. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Zimmerman Nays: None Absent: Bass, Williams With no further discussion, Ery Meyer made a motion to adjourn the meeting.
