ON 4TH ♦ OF 1993, AT • COMMUNITY DEVELO MENT DIRECTOR STATE OF TEXAS COUNTY OFTARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, June 7, 1993, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice -Chairman Randy Howell Secretary Chris Coy Member constituting a quorum with members, Ery Meyer, 1 st Alternate Ron Williams and 2nd Alternate Al Zimmerman absent. Also present was Council Representative, Gil Traverse and the following City Staff: Greg Wheeler Building Official Marcy Ratcliff Planner Gerrie Anderson Administrative Secretary CALL TO ORDER The meeting was called to order at approximately 6:00 P.M. NEW BUSINESS BZA93-12, CALAIS CONSTRUCTION INC. The first item of new business was for the Board of Zoning Adjustment to consider Board of Zoning Adjustment Case BZA93-12, submitted by Calais Construction, Inc., who is requesting a variance for 3369 Pecan Hollow Court, Lot 20, Block 3, Western Oaks Estates, Section II. The variance is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.H., R-7.5, Single Family District Regulations, which requires a 40 foot buffer area setback when abutting a non-residential district. The variance is to allow a five (5) foot variance to encroach the forty (40) foot rear yard buffer requirement as shown on the plot plan. If approved, it will allow a thirty-five (35) foot buffer yard setback on the rear property line, as shown on the plot plan. Marcy Ratcliff explained that a building permit was submitted on November 24, 1992. The plot plan was approved November 25, 1992, meeting all required setbacks for the 1 front, sides and rear yard. The building permit was issued on December 7, 1992. Ms. Ratcliff explained that at some point between the setback inspection and the foundation inspection, the house was moved back on the lot approximately five (5) feet. Since the original site plan showed that the proposed residence went from the thirty (30) foot front building line to the rear buffer building line of forty (40) feet, moving this structure back from the front building line resulted in the encroachment currently shown on the plot plan dated April 12, 1993. Richard Edgington, with Calais Construction took the Oath of Truth. Mr. Edgington explained the house was not moved at any time. The reason for the mistake was that the property abuts a large vacant piece of property and they used old survey pins located at the back of the lot. With no one else to speak either for or against the variance, Patti Bass made a motion to close the public hearing. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman After further discussion, Patti Bass made a motion that a special condition did exist. Ms. Bass explained the special condition being the set of old survey pins caused the form survey to be incorrect. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Patti Bass made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.H., to allow a five foot variance to encroach the forty (40) foot rear yard buffer requirement as shown on the plot plan. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman The next item of new business was for the Board of Zoning Adjustment to consider BZA93-13, submitted by David Weekley Homes for Lot 4, Block 2, Timberline South Addition, addressed as 2729 Springhill Drive. The variance requested is from K Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.3., R-7.5, Single Family District Regulations which requires a six (6) foot side yard. The variance requested is to allow a 6 inch variance to encroach the 6 foot side yard as shown on the plot plan. Marcy Ratcliff explained the special condition for the variance request. David Weekley Homes built an accessory garage as shown on the plot plan without providing the deed restricted 100% masonry. The accessory garage does meet the Grapevine Comprehensive Zoning Ordinance 82-73 Section 15.G., Side Yard Setback requirements. When the structure was completed, it was noted by the Homeowners Association that the accessory structure did not meet the deed restrictions for masonry requirements on a detached garage. The applicant is requesting this 6 inch encroachment for a 6 inch brick ledge to be built allowing the garage to be bricked. David McClendon, Project Manager for David Weekley Homes took the Oath of Truth. He explained after the garage was built, a neighbor had called inquiring whether the garage was in compliance with the deed restrictions. Martin Schelling, with Wright Development Company, took the Oath of Truth. He explained that the deed restrictions do require 100% masonry and was an oversight on the contractor pouring the slab. Mr. Schelling also explained that since the slab had already been poured, would create a hardship to tear it out. Marcy Ratcliff noted that staff had received three letters of approval for this case. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Patti Bass made a motion that a special condition did exist and the special condition being the slab is already poured and the hardship would be to remove the slab at this time. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Patti Bass then made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.3, R-7.5, Single Family District Regulations to allow a 6 inch variance to encroach the 6 foot side yard as shown on the plot plan, 3 allowing a 5-1/2 foot side yard setback for 2729 Springhill Drive. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman The next item of new business for the Board of Zoning Adjustment to consider was BZA93-14, submitted by J. F. and Melissa Denis who are requesting a variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.C.3., Supplementary District Regulations, which requires accessory buildings to be 6 feet from the rear property line. The variance request is to allow the storage building a 5 foot variance to encroach the 6 foot rear yard setback at 2741 Springhill Drive, Lot 1, Block 2, Timberline South Addition. Marcy Ratcliff explained there is an area in front of the current detached garage for the storage building or some of the landscaping could be removed to provide enough area for the storage building. Ms. Ratcliff explained that staff recommended denial to the variance request. J. F. and Melissa Denis, applicants, took the Oath of Truth, and explained they had bought the house in October and chose to locate the storage building behind the detached garage, •- the previous • had • • •• in this area and it -• to •• the •- location. Mr. Denis explained he had e• the Inspection Department and asked if he needed a permit for a 6 x 16 foot storage building, and was told he did not need a permit. Tammy Sisco of 2808 Springhill, Grapevine, Texas, took the Oath of Truth. Ms. Sisco explained she was part of the neighborhood's Homeowner's Association and the storage building does not meet what the City code requires. Ms. Sisco noted there are other storage buildings in the neighborhood that do meet the City requirements. Greg Puklicz of 2732 Rosecliff Terrace, Grapevine, Texas, took the Oath of Truth and explained the storage building was right in view of their family room. Mr. Puklicz asked the Board to support the City code. Cybill Long of 2736 Rosecliff Terrace, Grapevine, Texas, took the Oath of Truth and explained she lives directly behind this property. Ms. Long explained when they put a contract on the house, the storage building had not been built, and two weeks later, after they bought the house, the storage building had been built. V, Mr. Denis spoke again and explained if he reconstructed the shed elsewhere in the back yard, the neighbors would still be able to see it from their houses. After further discussion Chris Coy made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman After further discussion from the Denis' and the neighbors, Patti Bass made a motion that a special condition did not exist. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman The variance was denied. The next item of new business was for the Board of Zoning Adjustment to consider BZA93-15, submitted by Leslee Nelson and Edwin White, Jr., for Lot 7R, Block 1, Labrador Estates Addition, addressed as 2856 Peninsula Drive. The variance request is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1., R-7.5, Single Family District Regulations which requires a thirty foot front yard setback. The variance request is to allow the ten (10) foot variance to encroach the thirty (30) foot front yard setback as shown on the plot plan, allowing a twenty (20) foot front yard setback. Marcy Ratcliff explained that this unusually large lot, containing 16,804 square feet with the reduction of the 572 area, has less than 50% buildable area left. In addition, with the thirty (30) foot front building line and side building lines of 6 feet, the building pad area is reduced considerably. Ms. Ratcliff also explained that more than 50% of the lot was located below the elevation of 572.00 feet, where no habitable structures are allowed to be built below this elevation level. Ms. Ratcliff explained with approval of this variance, the building site area would be increased to the point where a one-story structure could meet the minimum 1,200 square foot floor area requirement. Kim Sontos of 1130 Bear Creek Parkway, Euless, took the Oath of Truth and explained she was wanting to purchase this lot to build a home. E Ron and Mariann Brown took the Oath of Truth and explained they had purchased 2915 Peninsula Drive, a year ago. The Browns explained they opposed the need to waive the 30 foot front yard setback. Bob Tantangelo of 3525 Redbird Lane, Grapevine, Texas, took the Oath of Truth and explained he was the brother-in-law of the applicant and feels the variance will not detract from the neighborhood. Elva Tantangelo of 3525 Redbird Lane, Grapevine, Texas, took the Oath of Truth, and also explained the property will only add value and not detract from the neighborhood. With no one else to speak either for or against the request, Chris Coy made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman After further discussion, Chris Coy made a motion that special conditions did exist and the special conditions being the lot has an unusual shape and more than 50% of the lot is below the elevation of 572 feet which would make the lot hard to build on. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Chris Coy then made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.6.1., R-7.5, Single Family District Regulations, to allow the ten (10) foot variance to encroach the thirty (30) foot front yard setback as shown on the plot plan, allowing a twenty (20) foot front yard setback. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman The next item of new business was for the Board of Zoning Adjustment to consider BZA93-16, submitted by Quang Lam who is requesting the following variances from Grapevine Comprehensive Zoning Ordinance 82-73, for his property located at 709 East Texas Street, Lot 10, Block 105, College Heights Addition. R-1 1. Section 43.E.3., Changing Nonconforming Uses and Structures Regulations requires approval of the Board of Zoning Adjustment to remodel or enlarge a nonconforming use, when such an enlargement would not tend to prolong the life of a nonconforming use. The special exception request is to allow the expansion of the nonconforming use of a single family residence located in the R -MF -2 Multi -Family Zoning District by adding a front and rear porch and a carport. Staff recommends the Board approve the front and rear porch expansions and deny the carport expansion of the nonconforming structure. 2. Section 22.G.1. & 3., R -MF -2 Multi Family District Regulations requires a forty (40) foot front yard and twenty (20) foot side yard setbacks. Front Porch Staff recommends approval of the request to build a front porch that would encroach the 40 foot front yard setback by 24 feet, which would allow a 16 foot front yard setback. The front porch addition would appear like the surrounding properties. Staff recommends approval of the request to build the front porch that would encroach the east 20 foot side yard setback by 5 feet, and the west 20 foot side yard by 14 feet, which would allow side yard setbacks of .15 feet and 6 feet respectively. The front porch would be the same width as the existing house. Rear Porch Staff recommends approval of the request to build a rear porch that would encroach the east 20 foot side yard setback by 5 feet, and the west 20 foot side yard by 15, which would allow side yard setbacks of 15 feet and 5 feet respectively. The rear porch would be the same width as the existing house. Carport Staff recommends denial of the request to build a carport that would encroach the 40 foot front yard setback by 17 feet, which would allow a 23 foot front yard setback. Staff recommends denial of the request to build a carport that would encroach the east 20 foot side yard setback by 19 feet, which would allow a 1 foot side yard setback. The existing house is not located in the area proposed for the carport. Greg Wheeler explained how Mr. Lam came about these variances. M Mr. Lam was not present at the meeting. Patti Bass made a motion to close the public hearing. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Patti Bass made a motion to grant the special exception to Section 43.E.3., of the Grapevine Comprehensive Zoning Ordinance 82-73, Changing Nonconforming Uses and Structures in order to remodel or enlarge a nonconforming use, and would not tend to prolong the life of the use. The special exception is to allow the expansion of the single family residence located in R- -2, Multi Family Zoning District, to allow the expansion for a front and rear porch, and to deny the carport expansion of the nonconforming structure. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Patti Bass made a motion to grant a variance to Section 22.G.1. & 3., R -MF -2 Multi - Family District Regulations for Lot 10, Block 105, College Heights Addition, addressed as 709 East Texas Street. The variance will allow a 16 foot front yard setback, which will encroach 24 feet into the 40 foot front yard setback to allow for a front porch only. Also to allow a sideyard setback of 15 feet and 6 feet, to allow construction of the front porch. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: • Absent: Meyer, Williams, Zimmerman Patti Bass made a motion to grant a variance to Section 22.G.1. & 3, R -MF -2, Multi Family District Regulations to allow construction of a rear porch and approve variances that would allow the rear porch to encroach the east 20 foot side yard by 5 feet and on the west side, by 15 feet, thus allowing setbacks of 15 feet and 5 feet respectively. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman The next item of new business was for the Board of Zoning Adjustment to consider BZA93-17, submitted by Robert Poole, representing Shelton Cleaners and Shelclean, L.L.C., for the development located at 1140 South Main Street. Greg Wheeler explained when Shelton Cleaners was built approximately 15 years ago, the building was in compliance with the zoning Ordinance in existence at the time it was constructed. Shelton Cleaners is updating their equipment and adding new equipment due to the increase of business; therefore, needing approval of the three following special exceptions to Grapevine Comprehensive Zoning Ordinance 82-73: 1. Section 68.H.2., Board of Zoning Adjustment to hear and decide special exceptions to the terms of this Ordinance upon which the Board is required to pass under this Ordinance, if any. The special exception request is to allow the current development to exist as is. If approved, it will allow the existing use to be a legal nonconforming use. 2. Section 43.E.3., Nonconforming Uses and Structures regulations require the Board of Zoning Adjustment to approve the remodeling or enlargement of a nonconforming use in which an enlargement would not tend to prolong the life of the nonconforming use. The special exception request is to allow the enlargement of a nonconforming use. If approved, it will allow the applicant to expand the size of the building. 3. Section 27.G.4., P0, Professional Office District regulations requires a 10 foot side yard setback. The special exception request is to allow a 5 foot encroachment into the required 10 foot side yard setback as shown on the plot plan. If approved, it will allow a 5 foot side yard setback. Robert Poole, applicant, of 1840 Hunters Creek, Southlake, Texas, 76092, took the Oath of Truth and explained the necessity of installing additional equipment to handle the increased business. 0 Roy Stewart, of 309 Drexel, Grapevine, Texas, took the Oath of Truth and explained that he owned the property to the west of the cleaners and sees that the variance has no bearing to any of the surrounding property. Mr. Stewart stated he was in favor of the request. George Frost of P. 0. Box 1715, Fort Worth, Texas, 76101, took the Oath of Truth and stated he was in favor of the request, but did want to see renderings. of the property. After further discussion, Chris Coy made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Chris Coy then made a motion that special conditions did exist for Section 68.H.2., Board of Zoning Adjustment to hear and decide special exceptions to the terms of this Ordinance upon which the Board is required to pass under this Ordinance. The special conditions are that the business has been in operation at this location for 15 years, and the development on this property was built in accordance with Zoning Ordinance 70-10. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Chris Coy made a motion to grant the special exception request to allow the current development to exist as is, allowing the existing use to be a legal nonconforming use. Randy Howell seconded the motion which prevailed by the following vote: kut Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Chris Coy made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Nonconforming Uses and Structures regulations requires the Board of Zoning Adjustment to approve the remodeling or enlargement of a nonconforming use in which an enlargement would not tend to prolong the life of the nonconforming use. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Next, Chris Coy made a motion that special conditions did exist for Section 27.G.4., PO, Professional Office District Regulations, and the special conditions being the encroachment will not impact the existing parking and is the only area where the building can expand. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Chris Coy made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 27.G.4., to allow a 5 foot encroachment into the required 10 foot side yard setback as shown on the plot plan, allowing a 5 foot side yard setback. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman IMIAILOICIS • P, The last item of new business was for the Board of Zoning Adjustment to consider BZA93-19, submitted by Glenda Fisher who is requesting a special exception to Grapevine Comprehensive Zoning Ordinance 82-73, Section 68.H.2. and 3., Board of Adjustment Regulations, which has the power to hear and decide special exceptions to the terms of the Ordinance, if any. Also, it has the authority upon appeal in special cases, such special exceptions from the terms of the Ordinance as will not be contrary to the public interest, where, owing to special conditions the literal enforcement of the 11 provision of the Ordinance will result in unnecessary hardship, so that the spirit of the Ordinance shall be observed and substantial justice done. Greg Wheeler explained the special exception is to allow the reinstatement of a single family residential use in a commercial zone for the property located at 703 East Wall Street. Staff recommends the special exception for a single family use shall remain in place as long as the structure is used for single family residential purposes only. Staff would also recommend if a commercial business is issued a Certificate of Occupancy at this location, the special exception shall cease to exist forever. Mr. Wheeler explained this structure has been used as a residence and has been a nonconforming use since the City Rezoning in 1984. The property has been vacant in excess of six months, as a result, the nonconforming single family use has expired. The applicant has not been able to get a commercial tenant to occupy this location and meet the parking and other requirements of the Grapevine Comprehensive Zoning Ordinance 82-73. Because the property is vacant, the applicant has been unable to obtain insurance. Glenda Fisher, applicant of 610 East Texas Street, Grapevine, Texas took the Oath of Truth and explained why she needed the property to be residential. Marcy Ratcliff explained that one of the requirements of going back to commercial is the off-street parking would need to be placed in the rear where the property is shallow and would be difficult to construct. Chris Coy made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Coy Nays: None Absent: Meyer, Williams, Zimmerman Chris Coy made a motion that a special condition did exist and the special condition being the existing structure was built for single family use and to convert the structure for commercial use and develop the required parking spaces on the property results in an unnecessary hardship.
