Q bl COMMUNITY DEVELOPMENT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, August 30, 1993, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice -Chairman Randy Howell Secretary Ery Meyer Member Carl Hecht 1 st Alternate Jeff Wood 2nd Alternate constituting a quorum with Member, Chris Coy absent. Also present were the following City Staff: Greg Wheeler Building Official Gerrie Anderson Administrative Secretary Chairman Charles Giffin called the meeting to order at 6:00 p.m. NEW BUSINESS The first item of new business was for the Board of Zoning Adjustment to consider BZA93-27, submitted by Roy Stewart who is requesting a variance for 2822 Harvest Hill Drive, Lot 4, Block 15, Oak Creek Estates. The variance, is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.3., Single Family District Regulations which requires a six foot side yard setback. The variance request is to allow a one foot variance to encroach the six foot side yard as shown on the plot plan, allowing a five foot side yard setback. Greg Wheeler explained the current owners purchased the existing house as currently shown on the plot plan and the encroachment is no fault of the applicant. Mr. Wheeler stated Staff recommended approval of the variance. Roy Stewart, representing the homeowner, Spencer Jefferies, took the Oath of Truth and explained the house was built late in 1978. Mr. Stewart noted the neighbors to the right said they had no objection to the variance. 1 With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing, Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy Patti Bass made a motion that special conditions did exist and the special conditions being the house is already existing and is no fault of the owner. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy Patti Bass then made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.3., Single Family District Regulations to allow a one foot variance to encroach the six foot side yard as shown on the plot plan, allowing a five foot side yard setback for 2822 Harvest Hill Drive. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy The next item of new business was for the Board of Zoning Adjustment to consider BZA93-28, submitted by James Scott Baker who is requesting a variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.D., Supplementary District Regulations for 2942 Robindale Lane, Lot 19, Block 5, Kimberly Estates Addition. The request is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.D., Supplementary District Regulations, which requires a minimum 15 foot side yard setback on the street side for corner lots. The variance request is to allow a one foot variance to encroach the 15 foot side yard as shown on the plot plan, allowing a 14 foot side yard setback on the north property line only as shown on the plot plan. Greg Wheeler stated that Staff recommended approval of the request and that two letters of approval had been received. Christine Baker was present to answer any questions of the Board. Patti Bass seconded the motion which prevailed • the following vote: K Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy Carl Hecht made a motion that a special condition did exist and the special condition being at the time of construction, only a 14 foot side yard was provided instead of 15 feet which is presently required. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy Carl Hecht made a motion to approve the variance request to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.D., Supplementary District Regulations, to allow a one foot variance to encroach the 15 foot side yard as shown on the plot plan, allowing a 14 foot side yard setback on the north property line only as shown on the plot plan. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy The last item of new business was for the Board of Zoning Adjustment to consider BZA93-29, submitted by Wright Development Company, who is requesting a variance for 3316 Briar Cove, Lot 16, Block 9, Countryside Estates Addition. The variance request is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.2., Single Family District Regulations which requires a 25 foot rear yard setback, to allow a proposed house to encroach the required 25 foot rear yard setback ranging from three feet to eight feet as shown on the plot plan. If approved, it will allow the proposed house to have a rear yard setback ranging from 22 feet to 17 feet, as shown on the plot plan. Greg Wheeler explained the special condition for the request is the property is an irregular shaped cul-de-sac lot and is shallow with one side property line just 73.81 feet in length. Martin Schelling of Wright Development Company took the Oath of Truth and explained about the unusual shape of the lot and how difficult it would be for the owner to build a 2 -story house. Mr. Schelling explained the neighbors dump their grass clippings on it and he has trouble controlling the high weeds and grass. Joseph Smith of 3320 Briar Cove, Grapevine, Texas, took the Oath of Truth. Mr. Smith explained he lived next door and was concerned about the detached garage being five feet from the fence. 3 Chairman Giffin explained to Mr. Smith the regulations concerning detached garages. Greg Wheeler -announced staff had received four letters of disapproval and two letters of approval. Patti Bass thought the neighbors wou-Id be. more pleased if the, garage Was not so close to the side property line and brought closer to the front building line. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Randy'Howell seconded the motion which ch prevailed by the following vote, Ayes: Giffin, Bass, Howell, Meyer, Hecht Nays: None Absent: Coy Martin Schelling explained the lot needed to be sold and he might end up building a small house • it, if this variance was not approved. There was further discussion concerning the detached garage. Martin Schelling explained he would work on adjusting the garage or putting an eight foot fence across the back. Randy Howell then made a motion that special conditions did exist and the special conditions being the cul-de-sac lot is irregular shaped and to build a home is very complex under the current zoning regulations. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Bass, Howell, Meyer Nays: Hecht Absent: Coy Abstain: Giffin John Linden, purchaser of the home, took the Oath of Truth, and explained the lot was difficult to build on and that it would not be acceptable to move the garage forward. Randy Howell then made a motion to approve the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.2., to allow a proposed house to encroach the required 25 foot rear yard setback ranging from three feet to eight feet as shown on the plot plan for the principal residence only. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Bass, Howell, Meyer, Hecht Nays: None Absent: Coy Abstain: Giffin Ell Next the Board of Zoning Adjustment considered the minutes of the June 7, 1993, meeting. Patti. Bass made a motion to approve the minutes of the June 7, 1993, meeting. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Hecht, Wood Nays: None Absent: Coy Greg Wheeler informed the Board that Target has an opening date of October 1, 1993, and Luby's Cafeteria should be opening in about 60 days.
